The regular meeting of the Eagle City Council was called to
order by Mayor Deckard on August 12, 1980 at 7:30 P. M. at
the Eagle City Hall.
DECKER, HALEY, KRASEN, PEARMAN were present.
Moved by KRASEN and seconded by HALEY to approve the minutes
of the previous meeting of July 22, 1980 as printed.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN,
PEARMAN. Motion carried.
Ordinance ~56 - ZONING ORDINANCE AMENDMENT
Moved by KRASEN and seconded by PEARMAN that in accordance
with 50-902, Idaho Code that this council dispense with the
rule requiring an ordinance be read on three (3) different days
and requiring the ordinance be read in full.
Roll call on the motion resulted as follows: AYE: DECKER,
HALEY,KRASEN, PEARMAN. Motion carried.
Mayor Deckard read Ordinance #56 by title only.
Moved by KRASEN and seconded by DECKER to adopt Ordinance
%56.
Roll call on the motion resulted as follows: AYE: DECKER,
HALEY, KRASEN, PEARMAN. Motion carried.
Ordinance #57 - BUILDING CODE ORDINANCE
Moved by KRASEN and seconded by PEARMAN that in accordance
with 50-902, Idaho Code that this council dispense with the
rule requiring an ordinance be read on three (3) different
days and requiring the ordinance be read in full.
Roll call on the motion resulted as follows: AYE: DECKER,
HALEY, KRASEN, PEARMAN. Motion carried.

Ordinance #58 - FIRE CODE ORDINANCE
Moved by KRASEN and seconded by HALEY that in accordance with
50-902, Idaho Code that this council dispense with the rule
requiring an ordinance be read on three (3) different days and
requiring the ordinance be read in full.
Roll call on the motion resulted as follows: AYE: DECKER,
HALEY, KRASEN, PEARMAN. Motion carried.

Moved by KRASEN and seconded by PEARMAN to adopt ordinance
#58.
Roll call on the motion resulted as follows: AYE: DECKER
HALEY, KRASEN, PEARMAN. Motion carried.
Moved by PEARMAN and seconded by KRASEN to authorize the mayor
and city clerk to sign a municipal audit-letter of understanding
with Jackson, Messuri & Bates for the purpose of examining the
financial statements for the City of Eagle for the period from
October 1,1979 to September 30, 1980 with a total estimated
fee not to exceed $775.00.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN,PEARMAN.
Motion carried.
KRASEN and DECKER gave a report on APA and a current Economic
Development Project Proposal for a civic center complex.
KRASEN reported on an Elderly Housing Project and Sewer in
Eagle.
Mayor Deckard will set up a meeting with the APA Executive
Director and his staff and the Eagle City Council to discuss
the present program.
KRASEN reported that the committee that was charged with re-
viewing the current comprehensive plan had met and that their
recommendation would be that the current plan be revoked in
its entirety and are now pursuing the financial cost of com-
piling the statistical data necessary for a new plan.
Bill Knickrehm, representing L B Properties presented the council
with a letter and plot plan regarding proposed changes for
Eagle Ranch Subdivision No. 4-A, 4-B.
A parks discussion will be placed on the Agenda for August 26, 1980.
Moved by HALEY and seconded by KRASEN that the city council direct
the city attorney to investigate and advise the council as to the
legal steps necessary to acquire the property that is immediately
South of Lions Park between the Lions Park and the existing fence.

Moved by KRASEN and seconded by HALEY that the final plat of
Eagle Village ~3 be approved subject to the developer complying
with the following conditions:
1. That the developer's request to change the name to Eagle
Ridge be approved.
2. That the irrigation ditches or canals through/adjacent
to the subdivision be fenced or covered or a bond in the amount
of 120% of the estimated improvement cost be posted prior to
the final recording of the plat.
3. That the developer construct a 4' high chain link fence
with heavy-duty terminal posts at the ends suitable for corner
posts or gate posts along the northerly easement line of the
New Dry Creek Canal in the proposed Eagle City Parksite (Lot
24 Block 5). Arrangements for the construction of the fence
within the park site shall commence two (2) weeks after the
developer receives the request for construction of the
fence from the City.
4. Approved fire protection facilities are to be provided to comply
with the requirements of the Eagle Fire Department and the Eagle
Ranch Water Company.
5. Installation of service utilities are to comply with the
requirements of the public utilities providing service.
6. The final plat is to be reviewed by the Ada County Assessor
prior to submitting the final plat for recording.
7. The bridge constructed across the New Dry Creek Canal at
Palmetto Drive is to meet ACHD standards and be acceptable to
the New Dry Creek Canal Company.
8. Drainage water into the New Dry Creek Canal will meet the
requirements, if any, of the New Dry Creek Canal Company.
Further, that the developer is responsible for removing any
foregin material that rolls into the New Dry Creek Canal
from the developer's property.

Ada County Rezone Request #80-22-~C for Donald Wilder.
Moved by KRASEN and seconded by DECKER that the Ada County
Zoning Commission be notified of the following:
That the Eagle City Council recommends disapproval of the
application for the following reasons:
A. Policy ~2, Community Design, page 55 of the Eagle
Comprehensive Plan states: "the shopping district along with

governmental, cultural, and entertainment uses should form
the core of the Eagle Impact Area and should be identified as
the town center." The proposed rezone for a shopping center
is outside this area defined supra.
B. The Community Design Map No. XII, page 77 of the Eagle
Comprehensive Plan shows the proposed rezone to be in a
r~sidential district to be zoned five (5) dwelling units
per acre.
C. The Land Use Map No XIII, page 78 of the Eagle Comprehensive
Plan shows the proposed rezone to be in an urban residential
district.
D. Until the currently zoned commercial areas are reasonably
utilized, it is the policy of the Eagle City Council not to
grant further rezones for shopping centers.

Moved by DECKER and seconded by PEARMAN to confirm the appointment
of Jim Hill to the Planning and Zoning Commission for a term of
three years.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN,
PEARMAN. Motion carried.
Moved by KRASEN and seconded by PEARMAN to approve the claims
against the city.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN,
PEARMAN. Motion carried.
A public hearing will be held on the Area of Impact on
August 14, 1980 at the Eagle Elementary School at 7:30
P. M.
There being no further business to come before the council,
