Jerry Deckard Council: Floyd Docker Carol Haloy Orval Krasen LeRoy Pearman May 13, 1980 The regular meeting of the Eagle City was called to order on May 13, 1980 at 7:30 P. M. at the Eagle City Hall by Mayor Deckard. DECKER, HALEY, KRANSEN and PEARMAN were present. Moved by KRANSEN and seconded by PEARMAN that the minutes of the previous meeting of April 23, 1980 be approved as printed. Fire commissioners PIESER, WAGNER and RICHARDS were in attendance at the meeting. Commercial construction and regulation flow rate were discussed, and a future meeting planned for all concerned with potable water and fire protection flow for the Eagle area. Mayor Deckard announced that this was the time and the place for a public hearing to be held for the Nazarene Church to construct a church and day care center in a R-5 zone class- ification. James Gibson, architect for the project spoke. There being no public testimony, the public hearing was declared closed. Moved by KRANSEN and seconded by HALEY that the Conditional Use Permit be granted to the Nazarene Church to construct a church and day care center in a R-5 zone classification. ARTICLE XI, Eagle City Ordinance Number 40 was used in evaluating this application. The following standards were considered with the findings as indicated: 1. This application will, in fact, constitute a conditional use as established on the Official Schedule of District Regu- lations for a residential zone; 2. The church and day care center will be harmonious with and in accordance with the general objectives of the Comprehensive Plan and the Zoning Ordinance; May 13, 1980 Page 2 3. The church and day care center will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; 4. The church and day care center will not be hazardous or distrubing to existing or future neighboring uses; 5. The church and day care center will be served adequate- ly by essential public facilities and services such as highways, streets, police and fire protection and refuse disposal and that the Nazarene Church will provide for adequate and approved water and sewer facilities. 6. The church and day care center will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; 7. The church and day care center will not involve uses, activities, processes, materials, equipment and condition of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; 8. The access road is to be built to Ada County Highway District standards and flared where it joins State Street and the front of the property will be designed so that adjacent properties can use this frontage as a roadway to the access road being built by the Nazarene Chruch; 9. The church and day care center will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. Roi1 call on the motion resulted as follows: AYE: DECKER, HALEY, KRANSEN, PEARMAN. Motion carried. Mayor Deckard appointed Wayne Crosby, Jim Gibson, Ron Marshall and Mike Orlando to the Design Review Committee. Moved by KRANSEN and seconded by DECKER to approve the ap- pointments of Crosby, Gibson, Marshall and Orlando. Motion resulted as follows: AYE: DECKER, HALEY, KRANSEN, PEARMAM. Motion carried. May 13, 1980 Page 3 A discussion was held on the Hillside and Lions Park sites. The height of the fence to be installed was discussed and further investigation will be done. After new figures and bids are received, the council will again discuss progression of the Heritage Grant for park improvement. Councilman KRANSEN reported that Eagle's share of dues for APA for 1981 would be $500.00. He was instructed by the council to inform APA that Eagle could not afford to pay that much.. A pending subdivision application for Eagle Village 93 was discussed. Moved by KRANSEN and seconded by PEARMAN that Block Brothers, Inc. be notified of the contents of Eagle Ordinance #1, page 52 concerning timing in filing of final plat, and that the time limit on their subdivision will start May 13, 1980. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRANSEN, PEARMAN. Motion carried. Moved by KRANSEN and seconded by HALEY that the claims against the city for the month of April be paid. Motion resulted as follows: AYE: DECKER, KRANSEN, HALEY, PEARMAN. Motion carried. Mr. and Mrs. property be school site. Kunkler were in attendance and asked that their removed from the future acquisitions map as a Councilman Kransen stated that this was an administrative problem and that the City of Eagle notify the Meridian School District Board that we have received a request from Mr. and Mrs. Kunkler to vacate that portion of the future acquisitions map and notify the school district of Mr. and Mrs. Kunkler's desire. Councilman KRANSEN reported that there is an illegal commercial business of a nursery being conducted in a R-5 zone classi- fication on the corner of Eagle Road and Floating Feather. Councilman KRANSEN reported that a public hearing will be held by the County Commissioners concerning a variance request by Richard G. Smith to conduct a business in a residential area in Eagle's impact area. A letter will be written to the County Commissioners stating Eagle's opposition to this application. May 13, 1980 Page 4 John Liquori, a representative of the Eagle Ranch Townhouse Association, asked the council's help in contacting the builders and asking them to clean up garbage and refuse around building sites, and also asked the council for street lights in their area.
