A special meeting of the Eagle City Council was called to
order by Mayor Deckard at 3:30 P. M. on April 11, 1980
at the Bank of Idaho Building.
HALEY, KRASEN, PEARMAN were present.
Mayor Deckard announced that he had called the meeting to
order for the specific purpose of this council to discuss
a restraining order served on the mayor on April 8, 1980
at 6:30 P. M.
Moved by KRASEN and seconded by PEARMAN that the Eagle City
Council go into executive session with its attorney to
discuss pending litigation, Case #71186 Richard Boylan
and Richard Howard, plaintiffs, vs. City of Eagle.
Roll call on the motion resulted as follows: AYE: HALEY,
KRASEN, PEARMAN. Motion carried.
Attorney WELSH reported that he had filed a motion on Monday
to "quash" the restraining order with Judge Schoreder because
the plaintiffs did not comply with the rules (bonding and
notice) and facts of irreputable damage were not given.
A hearing will be held before Judge Schoreder on Monday,
April 14, 1980 at 3:30 P. M. at the County Court House.
Mayor Deckard declared the executive session closed.
During the executive session the restraining order and complaint
were discussed and action that should be taken.
Moved by KRASEN and seconded by HALEY that the attorney appear
on behalf of the city to have the restraining order lifted
and respond to the complaint.
Roll call resulted as follows: AYE: HALEY, KRASEN, PEARMAN.
Motion carried.
There being no further business to come before the oouncil
the meeting was adjourned.
