RESOLUTION NO. 13-16
A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, DECLARING
AN EMERGENCY; AUTHORIZING THE EMERGENCY EXPENDITURE OF
PUBLIC FUNDS UNDER SECTION 67-2808 (1), IDAHO CODE; PROVIDING FOR
RELATED MATTERS; AND, PROVIDING AN EFFECTIVE DATE
WHEREAS, the HVAC system at the Eagle Public Library has completely failed and
needs to be replaced; and
WHEREAS, it is necessary for the City to do emergency work to safeguard life, health or
property;
WHEREAS, the City will meet to declare an emergency and authorize emergency work;
and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, Ada County, Idaho, as follows:
Section 1. That pursuant to Idaho Code §67-2808(1), the City may avoid the bidding
requirements for the expenditure of public funds in the event of an emergency; and
Section 2. That an emergency exists, pursuant to Idaho Code §67-2808(1), in that the
City must declare an emergency and authorize emergency work under Idaho Code §67-
2808(1); and
Section 3. That pursuant to Idaho Code §67-2808(1), the Mayor and Council do
hereby declare an emergency and authorize the emergency expenditure of public funds to
do emergency work within the City.
