EAGLE CITY COUNCIL
SPECIAL MEETING MINUTES
November 7, 2001Minutes
1. CALL TO ORDER: Mayor calls the meeting to order at 5:30 p.m.
2. ROLL CALL: BASTIAN, MERRILL, SEDLACEK, GUERBER. Bastian is absent. A
quorum is present.
3. CANVAS VOTES: In accordance with Idaho Code, Section 50-467, the City Clerk is
requesting the Mayor and Council to canvass the results of the General Election. (SKM)
Mayor introduces the issue.
City Clerk presents the results of the election to the City Council.
Rick Yzaguirre, Mayor, 841 votes
Matthew Glavach, City Council, 349 votes
Steve Guerber, City Council, 583 votes
E.G. (Lynne) Sedlacek, City Council, 752 votes
Council Members Sedlacek and Guerber are elected for another four year term in office.
General discussion.
Merrill moves according to Idaho Code, Section 50-467 that we accept the votes from the
November 6, 2001, general election. Seconded by Guerber. ALL AYE: MOTION
CARRIES ...................
4. UNFINISHED BUSINESS:
A. Findings of Fact and Conclusions of Law for PP/FP-10-01 - Mixed Use Subdivision
No.2- Eagle River LLC: Eagle River, LLC, represented by Bill Clark with Clark Development,
is requesting combined preliminary plat and final plat approval for Mixed Use Subdivision No. 2
(formally know as Eagle River Subdivision). The 46.4-acre, 10-lot (9 commercial, I residential)
subdivision is located on the southeast comer of Eagle Road and State Highway 44. (WEV)
Mayor introduces the issue.
City Attorney Buxton: Discussion on the easements and the Findings of Fact and Conclusions of
Law. General discussion.
Merrill moves to approve the Findings of Fact and Conclusions of Law for PP/FP-10-01
Mixed Use Subdivision No.2-Eagle River LLC with Site Specific Condition of Approval No.
5 to read as follows: "....approved by the City Attorney prior to the City Clerk signing the
final plat." Second by Guerber. ALL AYE: MOTION CARRIES ..................
5. NEW BUSINESS:
A. Appointment to the Design Review Board: (RY)
Mayor presents his recommendation of Dr. Daniel Howard to the Design Review Board. General
discussion.
Merrill moves to appoint Dr. Daniel Howard to the Design Review Board. Seconded by
Guerber. ALL AYE: MOTION CARRIES ..................
Zoning Administrator Vaughan: Discussion on Spring Creek common area improvements.
General discussion.
Discussion on Brookwood No. 5. What is the status of the well agreement? Discussion on a
meeting to be scheduled in regards to the well agreement.
Discussion on the Trolley Square project. There is a stop work order that was issued by the Corp
of Engineers on the project because the drain ditch is being covered. General discussion.
6. AD,]IOURNMENT:
Merrill moves to adjourn. Seconded by Sedlacek. ALL AYE: MOTION CARRIES...
Hearing no further business, the Council meeting adjourned at 6:l0 p.m.
