PRE-COUNCIL AGENDA: 6:30 p.m. - 7:30 p.m.
1. Ada County Sheriff's Department, monthly report. Deputy Borgquist distributes the monthly
report and discusses the same. General discussion. Discussion on lowering the speed limit.
Sherifl's Department talked to Channel 6 today. Discussion on violations at the skateboard park.
Discussion on the flow charts in the monthly report.
2. Dan Thompson, with Earth Tech, will discuss the proposed alternate route signalization and
the draft letter to ITD. Dan Thompson, Earth Tech, discussion on the April 9, 2001, letter from
iTD. General discussion between Mayor, Council, Dan Thompson and Barry Marcus.
3. Mayor and Council's Report:
Guerber: Air Quality Board meeting is tomorrow. Reports on Sun Valley Conference.
Merrill: Reports on the new fence on the pathway. Would like to go out to bid to have it bladed.
Park and Pathway Committee will meet next Wednesday. Don Belts is working on a budget for
the phases of Merrill Park. Goal is to have the park completed in three years. Playground
equipment will be here the first part of June.
Bastian: Library Board meets next week. Library is ordering some new furniture. There is very
heavy use of the existing computers. Considering new computers. This Saturday the Board is
meeting on their budget. Library is pursuing filtering for the computers. Library has installed a
motion camera at the back entrance. Ann is working on rewriting their policy manual. General
Discussion on location of new City Hall.

final plat approval for Mixed Use Subdivision No. 1 (a.k.a. Eagle River). The 95-acre, -lot (5-
commercial, 1-residential, 1-city park) subdivision is located on the southeast corner of State
Highway 44 and Eagle Road. (WEV)

Guerber moves to approve FP-13-01 Final Plat for Mixed Use Subdivision No. 1 (aka Eagle
River) Eagle River LLC, beginning with the Site Specific Recommendations and the
Standard Recommendations of Approval in addition a specific stipulation for the
construction of a 10'paved pathway within a 15' wide easement, to be placed along the
South Eastern edge of the project from Eagle Road to the Merrill Park location which
would include locations along the Southern edge of Block 4 Lot 2 and the South West
corner of Block 4 Lot 3 and through the city owned Block 4 Lot 1 with the provision that
upon the acquisition of Government Lot 3 also known as the Well's property by the City,
extinguish would be allowed on that portion South of Lot 4 Block per the stipulation set
forth in the Final Plat note that refers to this particular item. Seconded by Bastian.
Discussion. Guerber amends the motion to include this specific language: Current access
would be the access for the public and emergency vehicles until such time as permanent
access points are agreed upon and developed by the developer. Second concurs. ALL

Entitled Historical Preservation Commission And Providing An Effective Date. This item was
continued from the April 24, 2001 meeting. (SKM)
B. Ordinance 386: An Ordinance Establishing The Maximum Speed Limit On City Streets
Within The City Of Eagle, Idaho; Establishing Maximum Speed Limits For Idaho Highway 44
(Alternate Route) And A Portion Of Eagle Road Within The City Of Eagle; Providing For The
Posting Of Speed Limits In Accordance With Law; Providing For Penalty; And Providing An
Effective Date. (SEB & RY) This item was continued from the February 13, 2001 meeting.

7. PUBLIC HEARINGS:
A. RZ-18-00 -Rezone from R-4 to MU -DA - Brenden Clements: Brenden Clements,
represented by James Gipson, is requesting a rezone from R-4 (Residential up to four dwelling
units per acre) to MU-DA (Mixed Use with Development Agreement). The 1.60-acre site is on
the southwest corner of North Eagle Road and Floating Feather Road at 1177 North Eagle Road.

James Gipson: The lighthouse design has not been finalized and it will go to Design Review.
The height is 20' and will be designed to compliment the building.

Bastian moves to approve RZ-18-00 Rezone from R-4 to MU-DA with the Development
Agreement and Site Specific and Standard Conditions of Approval as presented in this
document. Seconded by Merrill. Discussion. Bastian amends the motion to include: Item
No. 2.3: That the footprint of the proposed building would be a maximum of 3700 square

8. NEW BUSINESS:
A. 01-04-ZC/01-05-S - Rezone from RUT (Rural Urban Transition) to R2 (Low Density
Residential - 2-units per acre)~ and Preliminary Plat for Sedona Creek Subdivision - ~lohn
Evans: John Evans is requesting a rezone from RUT (Rural Urban Transition) to R2 (Low
Density Residential) and preliminary plat approval for Sedona Creek Subdivision, a 35.1 l-acre,
56-1ot (52-buildable) residential subdivision located on the east side of Linder Road
approximately 400-feet north of State Highway 44. This site is located in the Eagle Area of
Impact. (WEV)

John Evans, applicant, displays an overhead of the site and provides Council with an overview of
the project.
Vaughan: Displays an overhead of a vicinity map and provides an overview of the project. This
is an Ada County Transmittal. Council can make a recommendation to the Ada County Board of
County Commissioners. Planning and Zoning Commission recommended deniaI because of the
density. General discussion.

Bastian moves to deny 01-04-ZC/01-05-S Rezone from RUT (Rural Urban Transition) to
R2 (Low Density Residential - 2- units per acre); and Preliminary Plat for Sedoua Creek
Subdivision-John Evans and makes the statement that the 2000 Comprehensive Plan does
not have standing with the Ada County and has not yet been approved by the County but
this subdivision is incompatible with the surrounding rural community and it is also
incompatible with the citizens of that area and I think we should protect the citizens of that
area by denying this particular subdivision. It would be more compatible if it was more in
the nature of the surrounding developments and surrounding property. Seconded by

B. AA-2-01 - Appeal of Zoning Administrator and Building Official's decision to require
the lowering of a portion of a residential building roof section which exceeds the 35-foot
maximum height limitation - Windsor Homes: Windsor Homes, represented by Mark L.
Butler with Land Consultants Inc., is requesting City Council approval of an appeal of the
Zoning Administrator and Building Official's decision to require the lowering of a portion of a
residential building roof section which exceeds the 35-foot high lnaximum height limitation. The
site is located 2915 Colony Court within Colony II Subdivision. (WEV)

Mark Butler, representing the applicant, provides an overview what has occurred on this
property. Displays a colored rendering of the house.
Craig Van Englen, 4720 Emerald, Boise. Discussion on the height maximum in the CC&R's of
The Colony Subdivision. We are excited about the style of this house.
Mike Mongelli, City Building Official, provides Council with an overview of when the plan was
submitted and reviewed. We measured the building to be 38'3". We met with the builders to let
them know that they need to stop construction. Average heights are running 32'-33'. Reads a
section out of the Uniform Building Form. General discussion.
Guerber moves to table this matter indefinitely and ask the building inspector to monitor the
continuing construction of this project allowing it to proceed and report back to Council if there
are any additional problems. Seconded by Merrill. Discussion. TWO AYES: TWO NAY:

Bastian moves to grant the appeal for AA-2-01 and we grant this appeal on the basis that
the City Building Inspector did not catch the error and the building of the house went
forward and to rectify the problem now would be an enormous burden on the builder and
as a Council we need to recognize the fact that event though there was a violation, the
violation was partly due to the initial approval and the City will not be making that
mistake again. ALL AYE: MOTION CARRIES ...............

C. Discussion of HyettPalma report: (RY)
Mayor introduces the issue.
Guerber: I have talked to a couple of people in Boise who have indicated a willingness to take a
look at this and with permission from the Council I would like to table this for two weeks and let
me ask them for their review. General discussion.
Guerber moves to table this matter to the May 22, 2001, City Council meeting. Seconded
by Merrill. Discussion. ALL AYE: MOTION CARRIES .................
D. Senior Center kitchen vinyl replacement: (SKM)
Mayor introduces the issue.
City Clerk: Geneva Trent brought me the proposal for the vinyl replacement in the kitchen and
asked for this to be on the agenda. The new stove is in and ready to be installed and they would
like to have the flooring replaced prior to installing the stove. The existing vinyl is well worn
and is torn under the stove area. This proposal is from the same company that redid the
bathrooms. The lease with the Senior Citizens does state that this cost should be the sole
responsibility of the Seniors.
General Council discussion. Council would like to make sure that the replacement vinyl is a
commercial grade.
Guerber moves to approve the replacement of the vinyl floor but that we ask for at least
three bids and that we authorize Council Member Sedlacek, liaison w/Senior Center, to
review at least 3 bids and select the best qualified bid for the project and the City of Eagle
authorize up to $1,250.00 towards the project. Seconded by Bastian. ALL AYE: MOTION

E. Review and discussion of the Swim Program: (SKM)
Mayor introduces the issue.
City Clerk: I have talked to Laraine Merrill and she is excited about continuing the swim
program and would like to start the program June Ist. The City issued 76 passes last year.
Laraine is also interested in coordinating with the City a basketball and/or volleyball league
under the same type of program with the City for the fall and winter. General discussion.
Guerber moves to continue the subsidized swim program with Rocky Mountain Fitness
Center. Seconded by Merrill. Discussion. ALL AYE: MOTION

Guerber moves to seek a proposal from Rocky Mountain Fitness for the creation of a
subsidized program whereby the City pays a portion of a fall basketball and/or volley ball
recreation program similar to the swim program the City is subsidizing. Seconded by

General Council discussion.
Craig Van Englen, Developer within the City of Eagle, addresses the Council about the speed
limits. I am in favor of the City Council to adopt this ordinance. I have witnessed three serious
accidents and I believe the speed limits need to be reduced.

Guerber propose the following changes: Section 1: Line 1 and line 2 strike the wording "on
State Highway 55 from State Highway 44 to Beacon Light Road, on line 5 strike the wording
"State Highway 55" and insert "Horseshoe Bend Road".

C. Discussion of the irrigation at the Idaho Power Substation: (SKM)
Mayor introduces the issue.
City Clerk: Tal Trautman brought this to my attention and Council has discussed this before. I
have checked into this further and Eagle Water does not know where the meter crone from. The
City has a meter and beyond this meter on the same waterline is another meter and the line goes
to the Substation. Only the City meter is being read. When Idaho Power withdrew from the
Maintenance Agreement in March of 2000, 1 asked if the water meter had been installed
according to the agreement and was told that it had been installed. Idaho Power has never been
charged for the water that they have used for their landscaping. Eagle Water estimates that $120
for an irrigation season would be reasonable. Eagle Water will not be able to install a new water
line for Idaho Power until late fall. Eagle Water did not install the meter. General discussion.
Council would like to bill Idaho Power for their water usage for the period of time from entering
into the Maintenance Agreement to the beginning of the 2001 irrigation season and enter into an
agreement to charge Idaho Power for the water they use each irrigation season and the agreement
to remain open ended until such time that other arrangements can be made by Idaho Power.

Sedlacek: Reports on the rock chuck problem at Shari Sharp's property. General discussion.
Council would like to send a letter to the Ada County Commissioners asking them if they would
consider working with the City of Eagle on a case by case basis just for the rock chuck problems.
Andy, Hope Luthern Church, doing a public service work project on May 19th within the City.
Willing to do light, medium and heavy work. Suggestions: pick up trash along the roadways and
clear the pathways.
Payette Scenic By-Way: Bid opening is May 23rd.
Discussion on some grants for floodway studies.
Discussion on Mercy Housing funding. Jim Birdsall, Mercy Housing, called the Mayor and the
funding was not approved. They will try again in a year.
Merrill: City Council of Boise is interested in meeting with us on the Monroc Property. General
discussion.
Zoning Administrator Report: I would like you to review the April 26th letter from Meridian
School District in regards to portable class rooms before the next City Council meeting.
City Clerk/Treasurer Report: I have distributed the financial report for April, 2001. I need to
have your registration forms for the AIC Annual Conference in Nampa. The trees that have been
stored through the winter behind City Hall need to be planted before it gets hotter. General
discussion. I have had Shred It install recycling bins in the trailer for P&Z and in the Council
Chambers. They come out every 4-5 weeks and shred on site. After the meetings if you would
like to have any items from your packet shredded please leave them on the diaz or place them in
the bin. Design Review and Planning and Zoning are also going to be asked to leave items to be
shredded.

April 30 — After another accident at 2nd and State, complaints were received about parking too close to

April 11 Information was received that churcheswere being.vandalized.and.burglarized. A church at
Eagle and Fairview had been burglarized and vandalized overnight so churches in the Eagle area
were warned. _ They were given burglary. prevention tips,, such as lighting, alarm system, locking
up valuables or removing them from the church at night.

April 1, Stopped by and spoke with some kids skateboarding and roller blading. at the Eagle Skateboard
park. The kids thought it was great that an officer would stop by just to see how they were
doing.
April.2 - Spoke with a mother who was having -problems with her 9 -year-old daughter taking small
items from stores without paying for them. A lasting impression was made on her; she shouldn't
be stealing anymore.
