Patrick Calley provides an overview of the report. Discussion on placement of the no engine brakes signs. General discussion. 1. Tal Trautman will give an update on the Maxi-Corn system and discuss Merrill Park. Tal provides Council with an update on the parks and areas where the maxi-com has been installed. Provides an overview of how maxi-com operates. Tal would like the Mayor and City Council to review the weather station and the computer system at his facility at Ustick and Star Road. 2. Jensen-Belts & Associates: Don Belts will give a presentation on the proposed Merrill Park drawings. Don Belts discusses maxi-com and the installation. We will keep Tal informed and keep him in the process to have this installed. Don distributes information on estimates of costs for the park and a copy of a master plan for the park and discusses the same. Discussion on a storage building for maintenance equipment and the group picnic shelter. Discussion on the easement area. City Attorney Buxton: Discusses the easement area. General discussion. Findings and Conclusions for PPUD-8-00/CU-21-00 - Camille Beckman Susan & Foad Roghani: Camille Beckman, represented by Chris Korte with Land Dynamics, is requesting preliminary development plan and conditional use approval for a mixed use planned unit development. Findings and Conclusions for CU-22-00 - Key Bank.: Key Bank, represented by Roger Foster with BRS Architects, is requesting conditional use approval to construct a 5,300-square foot bank facility with drive-up service (for ATM machine only) within the C-I-DA (Neighborhood Business District with Development Agreement). DR-70-00 - Phase I Common Area Landscaping within Eal~le River Subdivision - Eagle River LLC: Per City Council request, all design review applications are to be appealed by the Zoning Administrator to the City Council for their review prior to the action taken by the Design Review Board on an application being final. Eagle River LLC, represented by Phil Hull with the Land Group, is requesting design review approval for subdivision signage and for a portion of common area landscaping within Eagle River Subdivision. This Phase I landscaping plan is limited to the landscaping along the interior streets and within the common areas along and adjacent to Eagle Road and State Highway 44. The site is located on the southeast comer of Eagle Road and Highway 44. (This item was continued from the March 20, 2001 City Council Meeting). (WEV) Mayor introduces the issue. Phil Hull, The Land Group, representing Eagle River LLC. Instead of going through the Design Review action I will stand for questions from the City Council. General discussion. Most of the ponds are complete at this time. Discussion on the slope of the ponds in regards to someone being able to get out of the pond if they fall in. Eagle River is going to make changes on the grade line of the ponds. Discussion of stagnate water and misquotes at the ponds. Bill Clark, Eagle River, the ponds are 18-20 feet deep, all of the ponds are drained to another pond. None are self contained. The ponds operate as irrigation water holding areas. The idea is to keep circulation moving through the ponds. Veto Brewer, Holladay Engineering, discussion on the re-grading of the ponds. I don't see this as presenting any particular problem. I don't see that there should be any further review by the engineer. General discussion on the ponds. Veto Brewer, Holladay Engineering: We have reviewed several items. Bill is correct. A design with infrastructure has been submitted. In the case of a flood the water is getting to the ponds through culverts. One portion along Riverside Drive still remains open. We have had correspondence on this but no resolution. This is addressed in the Preliminary Plat Findings of Fact. General discussion. Bill Clark: This issue has not been resolved at this point because you added a condition that we would construct a dam and a construction road along Riverside Drive. We had not anticipated at that time that we were going to be building that until a future phase. Since the approval of the Preliminary Plat we had to begin the design of Riverside Drive and that dam is part of that and we need to design the drainage that would allow for the flood inlets. We have just completed that design which is being submitted to your Engineer. We are meeting this requirement. General discussion. Merrill moves to approve DR-70-00 Phase 1 Common are Landscaping within Eagle River Subdivision - Eagle River LLC, with the Design Review Board's site specific Conditions of Approval including these changes: 1. This Phase #1 for landscaping is limited to the landscaping along the interior streets and within the common area along and adjacent to Eagle Road and State Highway #44. The applicant shall be required to submit new design review applications for all landscaping around the ponds including the pond grading sheet #6 as presented here tonight, and indemnify the City from any liability occurring from the ponds. 2. Number 2 through 8 of the Design Review Site Specific Conditions shall remain as approved. 3. Add ~9, Design Review Site Specific Conditions: The total number of perimeter sign locations as presented with the application are not approved tonight, but will be established as each business comes through the Design Review process. Signage will not be allowed anywhere on the berm along Eagle Road and the By-Pass but can be placed on the South side of the pathway along the By-Pass and On the East side of the pathway along Eagle Road. 4. Add #10, Design Review Site Specific Conditions: The Design Review Board shall review the placement and style of the lights along the pathway and all the interior streets, they are to complement and coordinate with the historic lights and no shoe box style lights shall be used, all light fixtures shall be approved by Design Review. 5. Add #11, Design Review Site Specific Conditions: A non-obstructed emergency access shall be provided 295 feet from the pavement on the N.E. side of the North Channel of the Boise River adjacent to the Bridge, (at the location now being used for emergency access to the river). As required by the letter from Flood District #10, Eagle Fire Department, and the Ada County Sheriff's Department or at a similar location if approved by the same group. 6. Add #12, Design Review Site Specific Conditions: City Council accepts the parks and pathways recommendations of their Site Specific Conditions of Approval from the January 10, 2001, meeting with the following change: That the developer provide a 10 foot paved pathway along the southern border of the property above the 6500 cfs level and that that pathway shall be connected to the Reid W. Mark Butler, representing Stacia Patterson, Arbor Ridge, I understand everyone is busy. ! finally had a meeting a month later and I busted my butt to provide all the information necessary. Discussed the meeting with the Patterson family. They have provided two stub streets. Displays an overhead of the preliminary plat. Discussion on boundary issues. Discussion of sidewalk and bike path. It is our intent not to build a sidewalk on Dickey. Discussion on the traffic study. Discussion on Phase I. Distribute photos to City Council and discusses the same. Dan Gado, Strata, 8653 W. Tachamore Drive, Boise, our firm has been retained by Prime Earth to reclaim their gravel pit. Discuss the reclaiming of the gravel pit. Discussion of the Fill Management Plan for Prime Earth. We are providing quality control and making site visits from time to time. Steve Deckers, 2249 Dickey Circle, for the record I did recuse myself from the Planning and Zoning Hearings. rm representing Evans Homeowner's Association tonight. Also for the record our Homeowner's Association submitted a letter to you and since then I have meet with Mr. Mark Butler and we have arrived at some compromises. Mr. Mark Butler requested that I come to the meeting tonight to discuss some of the compromises. On behalf of the subdivision we still feel that there is a very strong case for not making a connection to Sadie. The applicant did agree to a sidewalk on Sadie. The reason our subdivision did not ask for a sidewalk on Dickey is because of the extensive amount of landscaping. We have requested a 5' striped pedestrian pathway. We asked that 100% of the mining operations be removed from the pit. It would be acceptable to leave the crusher on site for the purpose of the fill materials. Mr. Butler submitted that one crusher would be left on site just for the fill purposes and we agreed to that. The site needs to come into compliance with the current CLIP before any building permits for any phase be issued. This basically relates to the 3 to 1 slopes on the perimeter. We asked for the full restoration of Prime Earth's gravel pit West of Highway 55 to be completed within one year of signing the Final Plat. After meeting with Mr. Butler we recognize that is probably to aggressive to do that. We would ask that the entire pit be filled prior to any homes south of Phase I and Phase II. We ask that the berm be roughed in prior to occupancy permits being issued for Phase I and it would be completed along Highway 55 at the completion of Phase II or a Letter of Credit provided to the City for the landscaping of the berm. We also ask that the applicant work with lTD to continue the berming along the full length of Arbor Ridge Way to its connection with Hill Road. This is a difficult one because this is actually ITD's property, it is not the developers property. We are excited that someone will actually undo the gravel pit. I do have one more thing and I know this out of place, but I must say that last night everyone of you really represented the City of Eagle phenomenally well. The citizens of Eagle were proud of everyone of you. Mayor: I believe this matter needs to be continued. Seconded by Sedlacek. Discussion: Bastian: 1 would like Mr. Decker's comments reduced to Site Specific Conditions, a list of what you have agreed to and what you are proposing. Merrill: I would like to see ITD's reponse on Mr. Decker's proposal and I would like to hear from the Idaho State Land Department, Department of Lands, who have been monitoring this pit and where they are in this review process. I would like to see their comments. I would like the City Engineer to address the legal description issues as far as approval process and legal stance of the City. V-l-00 - Variance to allow existing historical building to be located in the front yard setback of primary residence - Clay Hagewood: Clay Hagewood is requesting City approval of a variance to construct a second single-family dwelling unit (to be used as the primary residence) and to allow the existing building (currently used as a residence) to remain in place and used as an accessory structure only. Vaughan: It is challenging to classify this type of a development. Whether it is a school or a child care facility. There is a gray area of what this is called. General discussion. We fully intend to be good neighbors. We have an extensive landscaping plan. We would not be blocking any views. We feel this is a positive influence for the City. I had some calls from a property owners that were annexed into the City and now they can not get gopher control from Ada County and they want to know what the City is providing. Mike missed an error on the set backs and called the builder today and told them they would have to remove the foundation and the stem wall. Council would like the builder to know that the City will share in some of the costs because of the City error. City will negotiate a settlement. The Board would like to discuss the following issues as we renegotiate the provisions of our area of city impact agreement: • Provisions Requiring Sewer: The County is concerned that the City has more lenient requirements for new development to connect to sewer. The County requires all new development within a city's urban service planning area to connect to sewer, yet the City of Eagle does not require its R1 zone to connect- The County staff has estimated, using the 2000 Eagle Comprehensive Plan, that approximately 3,600 more homes could be built in the area of city impact, but that under the City's sewer connection policy, over 1,000 of those units could be allowed to develop on septic systems. • • Residential Density: The County is concerned that the City of Eagle lags far behind other Ada County cities in its overall density. The 2000 Census population data, combined with the city size in 2000, reveals that Eagle has a density of 1.9 people/acre, compared to Kuna's density of 4A and Star's density of 3.3. A continuing trend of this low density pattern will continue to make it difficult, if not impossible, to effectively provide the range of urban services to the city's population. There are many opportunities to add density to the city's area of impact while promoting the "rural" design desired by Eagle's residents. Eagle ID 83616 Re: Boundary Survey for P&O Ventures within Section 10, T4N, R1 E, B.M. Dear Floyd: We have recently completed a Topographic and Boundary Survey of lands associated with the Arbor Ridge project. We have found some boundary conflicts. We are also aware of a conflicting issue with a landowner/Surveyor along a line within your projects limits. We submit our observations and recommendations to these issues in the following paragraphs. Some of these issues overlap each other. 1) Property line near the top of the bluff above the gravel Quarry: There is a conflict between the documents describing this line. The Quit Claim Deed (98001534 — Jan 8,1998) — Haugebak to Patterson establishes the position in a unique location. The deeds to Olsen {Corporate Warranty Deed (961006001 — Dec. 6, 1996) and Quit Claim Deed (96100602 - Dec. 6, 1996)} establish the line in a different location. The Patterson deed does try to hold the position called for in Olsens' documents. The positional difference between the Olsen and the Patterson documents is from 10 to 20 feet. We have established the lime between Olsen and Patterson holding the relationship described in the Olsen documents. We recommend Patterson and Olsen Quit Claim to each other a clear definition of this line. 2) Center of Section Corner: Mr. George Loucks is a Professional Land Surveyor licensed in the State of Idaho. He maintains the Center of Section Corner is the fence post at the intersection of the old barbwire fences running north, east and west. Many surveyors, for at least 25 years, have recognized a. position for the Center of Section as some sort of metal monument. Not the fence corner. A fence corner can be a monument. Mr. Loucks says it is the monument. The found pipes' positionis very close to this fence corner. Nevertheless, it is not the fence post. We are holding the found pipe for the Center of Section. It falls in the fence line. Its' position has been used by many to perpetuate the breakdown of the Section. To not accept it at this time would disrupt many deeds and surveys that have relied upon it for at least 25 years. 21 Properties of the Loucks Family Trust: Mr. Loucks is part of the Loucks Family Trust. Mr. Loucks maintains the property lines described in his deed and in the adjoiner's deeds are referencing the existing old fence line. He maintains that his property with relation to his neighbors has senior property rights. Original Patents in 1889 and 1900 had a common corner at the Center of Section Corner. Theoretically, the Center of Section Corner would have been set within a few years after the sale of the Patent. Fences should then have been built to the surveyed positions. We have no recordinformation that would confirm they were built to surveyed positions. The south line of the Echohawk Estates Subdivision appears to agree with the premise of holding the fence lines. However, the west line of the Echohawk .Estates Subdivision is located in a new wood fence. The wood fence is not coincident with the old barbwire fence. There is a gap between them. The south line of the Loucks property is the Center of Section line within $ection 10. It is a common line for Loucks.and Olsen, and Loucks and Patterson. Again, Mr. Loucks maintains the fence line establishes the Center of Section line. Mr. Loucks position for the points along the Center of Section line is based upon holding the fence corners at the Center of Section and at the Center -East 1/16 Corner. _(The Center -East 1/16 corner is 1/4 mile east of the Center of Section corner.) This analysis puts a substantial bend in the Center of Section Line at the 1/16 _corner.. The bend is to.the -north, about 6 feet. It creates a gap in the deeds metes (mathematical) calls for Olsen/Loucks and Patterson/Loucks. The bend in the line is not -incorrect if •it can be shown that the position for the 1116th corner was a surveyed position and one that has been accepted for many years. Recently, the Idaho Transportation Department (ITD) and Mr. George Loucks had discussions about the Center of Section Line. ITD had employed three Professional Land Surveyors while reviewing the work establishing the Center of Section Line. ITD places the Center of Section line on a line between the following: the found pipe near the fence corner at the southwest corner of the Loucks property, and the found monument at the East ' corner of the Section. ITDs' position of the Center of Section line does not agree with Mr. Loucks. They partially agreed with the east/west position of the East 1/16th line. lTD used monuments and fences to establish it. However, the south terminus of the East 1/16th line was -placed (at the Center - East 1/16th corner) on a. southerly extension of the East 1 /16th line defined by monuments and fences intersected with the Center of Section Line ITD established. This is where the 6 -foot gap I described' previously occurs. Mr. Loucks contends this issue is not resolved. lTD has recorded a Record of Survey depicting where they believe the Center of Section Line ought to fall. Other documents, Deeds, Plats and Records Surveys would agree with the ITD stand. However, physical occupation of land over long periods of time can establish positions for the Aliquot (Aliquot=method of describing small portions of a section, e.g.; the Southwest 1/4 of Section 10) partitions of Sections. ITD followed the Aliquot method. to some degree on the East 1/16 th line. Echohawk Estates concurred with this analysis for ownership along its south line. think this problem with Mr. Loucks' property boundary issues can beresolved between the landowners. Mr. Loucks position is valid. If you are in agreement with Mr. Loucks's position, documents can be filed establishing the position of the C.ente.r of Section line on and along the fence line. This issue could also go to court. A judge would then decide. would be happy to meet with you to discuss these issues. Please refer to the Topographic - Boundary Survey for this project. In the traffic impact analysis (DEI 7/00) it was assumed that the Arbor Ridge street system would connect to Windrose Street in the Echohawk Subdivision. It was further assumed that: 1) the Glubay property would gain access to Dicky Drive in the Evans Subdivision; and 2) the Pardew property would access the stub streets that were extended from the Echohawk and Eagle Point Subdivisions. These assumptions were consistent with previous transportation planning studies prepared for these subdivisions and previous action by ACHD and the City of Eagle. On September 13, 2000, ACHD approved the Arbor Ridge development subject to a condition that stub streets be extended to both the Glubay and Pardew properties. The changed traffic conditions are evaluated in this supplemental analysis. Figure 3 illustrates the projected traffic volumes in the original traffic impact study. Figure 3A depicts the projected traffic volumes with the new stub streets. With these interconnections traffic volumes on the internal streets will increase approximately 800 vpd. This volume will exceed ACHD's policy for residential street traffic. As a result, a limited access residential collector street will be required through the Arbor Ridge development. The redesign of the subdivision provides that facility. The Arbor Ridge/Hill Road intersection will continue to operate at a level of service "A" rating. The increased traffic volume will most likely cause the need for a right -turn deceleration lane on Hill Road. Please call me if you have any questions or need additional information. This Phase 1 landscaping is limited to the landscaping along the interior streets and within the common area along and adjacent to Eagle Road and State highway 44. The applicant shall be required to submit new design review applications for all landscaping around the ponds including the pond grading sheet #6 as presented here tonight, and indemnify the City from any liability occurring from the ponds. 2. Number 2 through 8 of the DRs site specific conditions shall remain as approved. Add 9.The total number of perimeter sign locations as presented with the application are not approved tonight, but will be established as each business comes through the Design review process. Signage will not be allowed anywhere on the berm along Eagle Road and the ByPass but can be placed on the South side of the Pathway along the Bypass and On the East side of the Pathway along Eagle road. 10. The Dr Board shall review the placement and style of the Lights along the Pathway and all the interior streets, they are to complement and coordinate with the historic lights and no shoe box style lights shall be used, all light fixtures shall be approved approved by DR. 11. A Clear non- obstructed emergency access shall be provided 295 feet from the pavement on the N.E. side of the North Channel of the Boise River adjacent to the Bridge, (at the location now being used for emergency access to the river). As required by the letter from Flood district 10, Eagle Fire Dept, and the Ada Co Sheriffs Dept or at a similar location if approved by the Same group. 12. Winegar Reference: Engine brakes sign placement Date: April 4, 2001 A few weeks ago in the city council meeting, Nancy Merrill asked for some input on where I thought the no engine brakes sign should be posted. In my experience with traffic control, most truck drivers look for those signs as they enter the city limits. So to start with I would post signs as you enter town somewhere near the sign that says entering the city of Eagle. These areas are: State Street neap Park Lane eastbound State Street near Highway 55 westbound Highway 55 near Beacon Light southbound Eagle Road north of Chinden northbound These would cover your major roadways in and out of Eagle and are the truck routes for the area. I would then post a sign in the areas where they would be most likely to use the engine brake. These areas are: Highway 55 southbound just south of Floating Feather Highway 44 just east of Ballantyne Eagle Road near Island Woods for northbound traffic Highway 44 westbound prior to Eagle Road I would also check with ITD and ACSO and see if they have any suggestions on where they would like to see them.
