RESOLUTION No. 13-07
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE PLAT NOTE NUMBER 3 ON
GOLDFORK RIDGE SUBDIVISION AS SHOWN ON THE ATTACHMENTS HERETO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, James P. Shirley requested a vacation to the final plat of Goldfork Ridge Subdivision
to remove plat note number 3 that references that no buildings are permitted outside of the designated
building envelope indicated on the final plat and
WHEREAS, On March 4, 2013, the Planning and Zoning Commission recommended approval of
the vacation (VAC-01-13), with conditions,to the Council and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Valley
Times on March 11, 2013, and March 18, 2013; and
WHEREAS, On March 26, 2013, the City Council held a public hearing on the proposed vacation
(VAC-01-13), and voted to approve the vacation with conditions and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats- Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications."
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates plat note number 3 of the final plat of Goldfork Ridge
Subdivision, as considered, heard, and approved by the Council at its March 26, 2013, public hearing for
application number VAC-01-13, and as shown on the attachment hereto(Exhibit A).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this26th day of March, 2013.
