PRE-COUNCIL AGENDA: 5:30 P.M.-6:30 p.m.
1. Museum Coordinator Report: Alana Dunn provides Council a quick update. Discusses the
exhibits in the City Hall lobby. Discussion on security for the exhibit cases. We ordered 130
Arcadia Eagle History Picture books and we have sold 71. There are several retailers in the area
that are selling the books and we will get a rebate on these books that are sold. Naomi with Wild
West has invited me to participate in First Friday and she has offered to provide me coffee and
cookies. So I will be opening the Museum each month for First Friday. General discussion.
2. Ada County Sheriff's Office: Chief Borgquist monthly report. Provides Council an overview
of the Code Enforcement cases.
Shaun Thomas, City Code Enforcement Officer, provides Council an overview of his code
enforcement efforts. Discussion on sign code enforcement and building a relationship with the
business owners. General discussion.
Chief Borgquist distributes the Annual Report and discusses the same.
3. Mayor and Council Reports:
Defayette: Discussion on glass recycling enclosure. Discussion on the building that Eagle Water
has installed at the bike park.
Semanko: No report
Mayor: Discusses the tour of Avimor and the possibility of an industrial park.
Park and Rec Director Aho: We have re-keyed our park facilities due to one of Summer Lawns
workers being terminated. We are working on the splash pad at Guerber Park and I have a
concept idea for the baseball field. We are going to be working on the turf at Heritage Park. I
have applied for a grant through the Transportation Alternative Program for the Dry Creek Trail,
which is a two year grant in the amount of$221,000. At 4:00 today we made the first pass so we
are in the running. It does require a match I have put in for an 8% match because that was the
estimate on the engineering costs that will be $17,680. Next Council meeting I will need a
Resolution saying the Council does fund this. This would come out of the$100,000 we have
budgeted for trail maintenance. General discussion.

12/PP-04-12 Mace River Ranch Planned Unit Development-Mace River
Ranch,LLC: Mace River Ranch,LLC, is requesting a rezone from A
(Agricultural up to one (1)unit per twenty(20)acres)to R-2-DA-P(Residential
up to two(2)units per acre with a development agreement—PUD), conditional
use,preliminary development plan, and preliminary plat approvals for Mace
River Ranch Subdivision, a 283-lot(255 buildable and 28 common)residential
subdivision. The 192.76-acre planned unit development is generally located on
the north side of West Mace Road and west of Eagle Road at 800 West Mace
Road. (WEV)
Zoning Administrator Vaughan removes Item#5.D from the Consent Agenda.
Grasser moves to approve the Amended Consent Agenda,5A,B and C. Seconded by

5.D Findings of Fact and Conclusions of Law for RZ-05-12/CU-04-12/PPUD-02-12/PP-04-
12 Mace River Ranch Planned Unit Development-Mace River Ranch,LLC
Zoning Administrator Vaughan: On Page 40 of the Findings for the Plat there is a condition
which is Item 26D in regards to setbacks. The applicant had a concern with the area west of the
private road area that the lots size would be identified taking into account the floodway area.
The language that they would like to see included which is consistent with the prior approval is
"D. Minimum Lot Area: The lot area size calculation for the determination of setbacks for those
residential lots located east of the Chevron pipeline and adjacent to the floodway line shall be
based on the developable lot area located outside the floodway setback area." They were

requesting that item be added to the preliminary plat findings and the development agreement
rezone findings.
Jeffrey Wardel, representing Mace River Ranch, we are in approval of this. Discusses the set
backs and the language that they are requesting be changed. General discussion.
Defayette moves to approve Findings of Fact and Conclusions of Law for RZ-05-12/CU-04-
12/PPUD-02-12/PP-04-12 Mace River Ranch Planned Unit Development - Mace River
Ranch, LLC with the changes stated tonight. Discussion. Seconded Semanko. TWO

A. Discussion of mailer for City Hall bond election:
Mayor introduces the issue.
City Attorney Buxton provides Council an overview of the City Hall Bond Election Information
fact sheet. General discussion.
Semanko moves to approve the mailer for City Hall Bond Election informational flyer that
has been discussed tonight with additional language being provided by Council about the
mailing being for registered voters in the City of Eagle and that be sent to the people in the
83616 zip code. Seconded by Defayette. Semanko: AYE: Grasser: AYE; Defayette: AYE;
ALL AYES: MOTION CARRIES
B. Discussion on City Hall Bond Election Town Hall Meeting date:
Mayor introduces the issue.
General discussion.
Council concurs to have the Town Hall meeting at 6:00 p.m. on April 10, 2013 at the Senior
Citizens Center if it is available. The City Clerk will check on the availability of the Senior
Citizens Center.
C. AA-03-12—Appeal of Zoning Administrator's decision to require a preliminary plat
modification application to remove site specific condition of approval No.25 to eliminate
open style fencing requirement—Henry's Fork,LLC, represented Matt Schultz with
Schultz Development Company.(WEV) This item was continued from the February 12, 2013
meeting.
Mayor introduces the issue.
Zoning Administrator Vaughn: Staff and the applicant need additional time and we are
requesting that this be continued to your March 12, 2013 meeting.
Semanko moves to continue this item to the March 12,2013 meeting. Seconded by Grasser.

D.82 E. State Street Lease Payments: Eagle Entrepreneurial Zone and Idaho Council of
Governments is requesting$7,200.00 for the City's share of the security deposit and monthly
lease payments for the office space at 82 E. State Street. (JDR)
Mayor introduces the issue.
Grasser moves in support of the ICOG initiative that we approve the expenditure of
$4,550.00 which is the security deposit of$350.00 and a monthly rent of$350.00 and up for
later review if the Grant is approved we can discuss bring that amount up to the$7,200.00

and this contingent on review and approval by our legal counsel of the Lease for the space.

7. PUBLIC HEARINGS:
A. RZ-5-02 MOD2 -Development Agreement Modification—Instrument No. 107155763—
Lakemoor Development DMB Investments,LLC.DMB Investments, LLC, represented by
Dan Torfin is requesting modifications to the development agreement(Instrument#107155763)
associated with the MU-DA(Mixed Use with development agreement)zoning of the property.
The 178.5-acre, 240-lot(142-residential, 53-commercial, 45-common) development is located on
the east side of S. Eagle Road approximately one-half mile north of Chinden Boulevard. (WEV)
B. PP-03-05 MOD-Lakemoor Subdivision-BW Eagle,LLC: DMB Investments, LLC,
represented by Dan Torfin, is requesting preliminary plat modification approval for Lakemoor
Subdivision a 330-lot(231 buildable [82 attached, 149 detached], 39 mixed use, 59 common [5
private road], and 1 well lot)residential subdivision. The 178.52-acre site is generally located on
the east side of Eagle Road approximately 1000-feet north of Chinden Boulevard. (WEV) [Will
be heard concurrent with item 7A]

Items#7A and#7B will be heard concurrently with separate motions.
Mayor: Does anyone on Council have any exparte contact to declare? None
Mayor: Does anyone on Council have any potential or actual conflict of interest?
Semanko: I do represent a party in the matter with the principal on the other side and it is not
related. I have discussed this with our legal counsel and I have no pecuniary interest and I do
not have a conflict on Items#7A and#7B.
City Attorney Buxton: In talking with Mr. Bradbury as well as talking with Mr. Semanko I do
not see a conflict of interest with regard to a pecuniary interest at all. Because of your
representation would you have any bias in favor or against the applicant because of your other
work and dealings as legal counsel to other parties?
Semanko: Not at all, and the fact that I live in a development that the principal in this
particular developed does not bias me the other way either so I don't have a bias one way or
the other. For the record I participated in questions regarding Lakemoor as recently as
October 25, 2011 when we had an extension request and there was no issue at that time either.
City Attorney Buxton: Mayor and Council I do not find any bias or conflict of interest
reasons that Mr. Semanko cannot fully participate in this matter.
Mayor opens the Public Hearing
Dan Torfin, representing the applicant, provides Council an overview of the request for
modifications to the Development Agreement and preliminary plat modification. General
discussion.
Zoning Administrator Vaughan: Both staff and the Planning Zoning Commission have
approve this application. Provides Council an overview of the application and the changes
requested by staff General discussion.
City Attorney Buxton: Discusses the changes in 8.6 Financial Assurance in the Development
Agreement. General discussion.

Mathew Rydson, 759 E. Lake Briar Lane, my concern is doubling the development with just
one pool which is already being used by the current residents. General discussion.
Bret Bennit, 726 E. Eagle Woods Lane, I have the same concerns about the pool. There are
constraints already on certain days and you are doubling the number of people. If they are
advertising this as an amenity for the subdivision then they need to support it with another
pool.
Judy Fossgreen, 361 Lake Briar Lane,we came from a planned community of 700 homes in
San Diego with one pool and there were not problems. I live adjacent to the pool and the pool
has not been used that much. I have not found that there is a problem. I would prefer to see a
tennis court/sport court instead of a second pool. I do not want to see an increase in our HOA
dues. The HOA doesn't meet regularly. General discussion.
Ted Fineberg, 324 E. Lake Briar, one issue that has come up in relation to the pool is that
there is no parking. Many people drive to the pool and park on the street and this has raised
questions of safety and liability. I don't think there is a level of parking built into this plan
that will address parking at the pool. General discussion.
Dan Torfin displays an overhead of the pool and discusses the pool issue and the parking. We
are in agreement of the change in the language in 8.6. General discussion.
Semanko moves to approve RZ-5-02 MOD2 -Development Agreement Modification
with the changes to 8.6 that have been discussed tonight. Seconded by Defayette.

A. Ordinance 692: An ordinance amending ordinance 689, regarding 2013 City Hall Bond
Election An Ordinance Of The City Of Eagle, Ada County, Idaho, Ordering A Special Bond
Election To Be Held On The Question Of The Issuance Of General Obligation Bonds Of The
City In An Amount Not To Exceed $1,200,000 For The Purpose Of Acquiring The City Hall And
Related Improvements And Costs; Establishing The Date, Time, And Places Of The Special
Bond Election; Approving A Form Of Ballot; Providing For Registration Of Voters; Providing
For Related Matters; And Providing An Effective Date. (SEB)
Mayor introduces the issue.
City Attorney Buxton discuses the language of the Ordinance 692 and the State Statues.
Provides an overview of the proposed changes in the proposed Ordinance to amend Ordinance
689. This Ordinance if you approve it will be sent to Ada County and it also will need to be
published. Discussion on the Revenue Bond for the Water Tank, it is not required to be in this
Ordinance. General discussion.
Semanko moves, pursuant to Idaho Code, Section 50-902,that the rule requiring
Ordinances to be read on three different days with one reading to be in full be dispensed
with,and that Ordinance#692 be considered after being read once by title only. Semanko

Mayor discusses unmanned aircraft and drones. I understand that there are companies in the
valley that will be manufacturing these aircraft.
Gary Smith, Star, Idaho, discusses privacy and Bill#1067 presently in the State Legislature.

14 VIOLATION OF THE PROVISIONS OF THIS ACT MAY BE ADMISSIBLE AS EVIDENCE IN
15 CERTAIN PROCEEDINGS.
16 Be It Enacted by the Legislature of the State of Idaho:
17 SECTION 1. SHORT TITLE. This act may be cited as the "Preserving Freedom
18 from Unwarranted Surveillance Act."
19 SECTION 2. That Chapter 2, Title 21, Idaho Code, be, and the same is
20 hereby amended by the addition thereto of a NEW SECTION, to be known and des -
21 ignated as Section 21-213, Idaho Code, and to read as follows:
22 21-213. FREEDOM FROM UNWARRANTED SURVEILLANCE -- DEFINITIONS. For the
23 purposes of sections 21-214, 21-215 and 21-216, Idaho Code, the following
24 terms have the following meanings:
25 (1) "Drone" means any powered aerial vehicle that does not carry a hu -
26 man operator, uses aerodynamic forces to provide vehicle lift, can fly au -
27 tonomously or be piloted remotely, can be expendable or recoverable and can
28 carry a lethal or nonlethal payload.
29 (2) "Law enforcement agency" shall have the same meaning as provided
30 for in section 18-4508, Idaho Code.
31 (3) "Unmanned aircraft" means an aircraft that is operated without the
32 possibility of direct human intervention from within or on the aircraft.
33 SECTION 3. That Chapter 2, Title 21, Idaho Code, be, and the same is
34 hereby amended by the addition thereto of a NEW SECTION, to be known and des -
35 ignated as Section 21-214, Idaho Code, and to read as follows:
36 21-214. RESTRICTIONS ON GATHERING OF EVIDENCE. (1) No person, entity
37 or state agency shall use a drone or other unmanned aircraft to gather evi-
38 dence or other information pertaining to criminal conduct or conduct in vio-
39 lation of a statute, ordinance, regulation or rule, except to the extent au -
40 thorized in a warrant.

(2) No person, entity or state agency shall use a drone or other un -
2 manned aircraft to conduct surveillance of any individual, property owned by
3 an individual, farm or agricultural industry without the consent of that in -
4 dividual, property owner, farm or agricultural industry. An owner of facil-
5 ities located on lands owned by another under a valid easement, permit, li-
6 cense or other right of occupancy is not prohibited by this section from us -
7 ing drones or other unmanned aircraft to aerially inspect such facilities.
8 SECTION 4. That Chapter 2, Title 21, Idaho Code, be, and the same is
9 hereby amended by the addition thereto of a NEW SECTION, to be known and des -
10 ignated as Section 21-215, Idaho Code, and to read as follows:
11 21-215. USE OF UNMANNED AIRCRAFT -- EXIGENT CIRCUMSTANCES. The pro -
12 visions of this act do not prohibit the use of a drone by a law enforcement
13 agency when exigent circumstances exist. For the purposes of this section,
14 exigent circumstances exist if a law enforcement agency possesses reason -
15 able suspicion that, under particular circumstances, swift action to pre -
16 vent imminent danger to life is necessary.
17 SECTION 5. That Chapter 2, Title 21, Idaho Code, be, and the same is
18 hereby amended by the addition thereto of a NEW SECTION, to be known and des -
19 ignated as Section 21-216, Idaho Code, and to read as follows:
20 21-216. REMEDIES FOR VIOLATION OF THE PROVISIONS OF THIS ACT -- USE OF
21 INFORMATION OBTAINED. (1) In a civil action any aggrieved party may obtain
22 all appropriate relief to prevent or remedy a violation of the provisions of
23 this act.
24 (2) No information obtained or collected in violation of the provisions
25 of this act may be admissible as evidence in a criminal proceeding in any
26 court of law in the state or in an administrative hearing.

2012 HIGHLIGHTS
• Eagle Police welcomed Shaun Thomas, our
new code enforcement officer, to the team
in October. He quickly began educating
members of the community about city
code. You will see improvements around
Eagle as he continues to work with citizens
to correct code violations.
• We worked closely with City of Eagle, Eagle
Fire, Ada County Sheriff's Office and Ada
City County Emergency Management to
ensure people were safe and informed
during the spring flooding event.
• We assigned officers to sections of the
city so they can better understand crime
and safety issues specific to their area.
Deputies are encouraged to develop close
relationships with the citizens, business
owners and schools in their"beat"and work
to make those neighborhoods safer.
• Come see us in our new location! The new
Eagle Public Safety Building, 1119 E State
St, is now home to Eagle Police, Ada County
Sheriff's Office North County patrol teams
and Eagle Fire. Having one location for all
of Eagle's public safety agencies allows us
to share resources and cut expenses.
MESSAGE FROM CHIEF BORGQUIST
Eagle Police had a productive year in 2012, with some of our biggest
accomplishments highlighted in this report. For 2013, we are going to focus our
efforts on ensuring our officers are positive in interactions with people and that
we are productive at all times. We know that every contact with you matters.
We rely on you as a neighbor, business owner or community leader to help us
keep Eagle safe. We want to earn your trust and support each day. Eagle Police
officers are proud of the work we do and are committed to keeping you better
informed. Watch for us to share more information through social media, on the
news, at community meetings and in your neighborhoods.

It marked the end of an era when Ford
announced they would no longer
produce the Crown Victoria. After
evaluating many vehicle options, we
chose to transition our fleet to the
Chevrolet Tahoe. It has an excellent
safety rating, great mileage, low
maintenance costs, long vehicle
life and a spacious interior that can
accommodate police equipment. It
will take a few years to fully transition
our fleet, but we like the Tahoe so far!
