Minutes - 1999 - City Council - 08/28/1999 - SpecialORIGINAL NOTE: EAGLE CITY COUNCIL SPECIAL COMPREHENSIVE PLAN MEETING MINUTES Held at the Eagle City Library Auditorium 100 N. Stiermen Way Saturday August 28, 1999 9:00 A.M. THE MEETING WILL START AT 9:00 A.M. AND WILL END NO LATER THAN 5:00 P.M. WITH THE FOLLOWING SCHEDULED BREAKS: Morning Break - Approximately 10:30 to 10:50 Lunch Break - Approximately 12:30 to 1:30 Afternoon Break - Approximately 3:00 to 3:20 ALSO, IF NEEDED, PUBLIC HEAR1NGS AND DELIBERATION WILL CONTINUE TO 6:30 P.M. ON TUESDAY AUGUST 31, 1999, AND FURTHER TO 6:30 P.M. ON THURSDAY SEPTEMBER 2, 1999. IF ADDITIONAL MEETINGS ARE STILL NEEDED THE COUNCIL WILL SCHEDULE THEM AS THE HEARINGS PROCEED. CALL TO ORDER Mayor Yzaguirre calls the meeting to order at 9:00 a.m. ROLL CALL: MERRILL, BASTIAN, SEDLACEK, GUERBER. All members are present, we have a quorum. PUBLIC HEARINGS: Mayor Yzaguirre explains the procedure for the meeting. HEARING FORMAT FOR ITEM "A" a. The applicant will present their proposal. b. The City staff will provide a report. c. Public testimony, limited to comments regarding the application being reviewed, will be taken. d. Council will not take action on any applications until all the public heating have been closed. Mayor Yzaguirre introduces the issue. CPA-l-98 & RZ-2-98 - Eagle River Development (Grossman Properties) - Eagle River, LLC: Eagle River, LLC, represented by Bill Clark, is requesting approval of a comprehensive plan amendment from Public/Semi-Public to Commercial and from Medium Density Residential to Commercial, Mixed Use, Public/Semi-Public; and a rezone from A (Agriculture) and M-lA (Industrial Park District) to PS- DA (Public/Semi-Public), R-4-DA (Residential), C-3-DA (Highway Business District), and MU-DA (Mixed Use) with a development agreement. A portion of the proposed change from the residential land use designation to the Public/Semi Public land use designation and M-lA zoning designation to PS-DA zoning designation is City initiated for a City park. The 93-acre site is located on the southeast comer of State Highway 44 and S. Eagle Road. NOTE: CPA-l-98 must be acted on prior to RZ-2-98. NOTE: The proposed Comprehensive Plan amendment portion of this item was scheduled to be Page 1 of 6 held on August 21, 1999, City Council meeting with the lvublic hearing being left open for additional public testimony at this meeting. HEARING FORMAT FOR ITEMS "B" & "C" a. Public testimony, limited to comments regarding the application being reviewed, will be taken. b. Council will not take action on any applications until all the public hearings have been closed. Mayor Yzaguirre introduces the issue. Bill Clark, 479 Main Street, Representing Eagle River. Clark explains the proposal in detail. Clark goes into detail concerning the plans for businesses to be located within the development, and landscaping. Using an overhead, Clark uses visual aid to demonstrate the specifics of the area. The definition of the zoning terminology mixed-use and limited-commercial are defined. The effect on the downtown business center is explained. The change in the zoning ordinance, suggestions for changes in the comprehensive plan are distributed, development agreement items are discussed. The verbiage used in the zoning ordinance is shown on an overhead and items of conflict are brought to the attention of the Mayor and City Council. Clark feels a PUD zone is primarily designed for residential use. The issues ofcommemial use versus residential use are pointed out by Clark. Clark does not feel that after all the many hours and effort of all individuals involved that they should be required to start this project all over as a PUD project. Clark itemizes the specific changes he would like to see made to the comprehensive plan. General discussion with Council and Clark. Mark Butler, Planning and Zoning Administrator, responds to a few of Clark's comments. Butler uses an overhead map of the area to demonstrate issues of the area at issue. Staff report is reviewed. Butler shows a visual of the staff report, reviews each page, and mentions that anyone may obtain a copy of this report. Council and Butler have discussion about the items in the report. Per Butler's request, Clark addresses the issue of"flex space". Most of the time flex space is showroom with storage space in back. Roads and options are discussed. Butler reminds Council that the current design is only a concept and can be revised. General Discussion. Mayor asks Butler to list the different commercial buildings and their size to help them determine the concept of "big box". Mayor Yzaguirre calls for the first break at 10:30 a.m. Mayor calls the meeting to adjournment. Laura Kabinski, representing Albertsons, would like to see no changes to the comp plan to accommodate the proposed development. Discusses the "big box" concept. Tom Nagel, 402 E. Trailside Drive. Presents his feelings on the "small town" genre that he would like to see continue. Colleen Maile, 885 Rush Lane, speaks on the general comprehensive plan and the effects on Eagle and its growth. Keep sight the long time vision of Eagle. Bill Clark responds to the comments made by the public testimony. GUERBER MOVES TO CONTINUE TItIS ITEM TO THE TUESDAY, AUGUST 31, 1999, MEETING. Page 2 of 6 Mayor makes changes to the agenda to move to item "D" on the agenda to allow for Lynn Milton to speak on the focus group meetings, and allow for her to leave prior to 12:30. B. CPA-6-97 - City Initiated Comprehensive Plan Amendments - City of Eagle- Nancy Taylor: The City of Eagle is proposing to amend its Comprehensive Plan and Land Use Map. The Plan and Map are official policy documents for the City and its Area of Impact and are intended to provide the vision, goals, policies and implementation actions that will guide the community's development. The Plan addresses the following components: Property Rights, Population and Growth, Economic Development, Public Services, School Facilities, Land Uses, Natural Resources and Hazardous Areas, Transportation, Parks, Recreation and Open Space, Housing, Community Design and Cultural Resources. The Plan also includes a Land Use Map that, in part, illustrates types of land uses and residential densities for Eagle and its Area of Impact. Butler introduces the process that has been taken to reconstruct the comprehensive plan. Nancy Taylor addresses the comprehensive plan, the process, the time it takes to create, and recognizes the individuals involved and compliments their effort. Comprehensive plan is a vision. The comprehensive plan is a long term plan. Need to come to terms with the reality that growth is inevitable. Comprehensive plan is not a law, it is an Eagle information for the public. It should be easy to read with maps included. It is unrealistic to think there will not be amendments. Economic, social and other factors change and the comprehensive plan will need to reflect those changes. Focus groups were explained. The process that followed after the initiation of the focus groups and the results of those processes was described. Lyrm Milton, 3939 Riverside Lane, worked on the focus group and is here to explain some of the highlights of their recommendations. Would suggest taking a look at the draft dated September 25, this is where all recommendations were taken from to be forwarded. Lynn reviews the process involved as a focus group and reviews some of the figures arrived at and the impact that had on the recommendations made by the focus group. Tax base and the relationship to services rendered is discussed. General discussion. Kathy Penissi, 3675 N. Island Place, a member of the focus group presents the data that based the recommendations. Using overhead visual aids Kathy demonstrates numeric data analysis. The Planning and Zoning recommendation booklet and the focus group recommendation booklet are taking the city in two separate directions. (Questions were brought up about the relationship between density and the effect on the sewer and water, Central District Health, private wells and septic tanks, and this item will be discussed on Tuesday, August 31, 1999.) The issue of schools is brought forward. Kathy has overheads to demonstrate the analysis of the growth and the status of the schools. ALL AYE. MOTION CARRIES... C. CPA-2-98 & RZ-7-98- Comprehensive Plan dmendment and Rezone_for BramHall Subdivision - Roger C. Crandlemire: Roger C Crandlemire, represented by Roylance & Associates, is requesting approval ora comprehensive plan amendment from Very Low Density Residential (one dwelling unit per two acres maximum) to Medium Density Residential (four dwelling units per one acre maximum), and a rezone from A-R (Agricultural-Residential - one dwelling unit per five acres maximum) to R-3 (Residential - three dwelling units per one acre maximum). The 95.2-acre site is located on the north side of Floating Feather Road approximately ~-mile west of Eagle Road at 1400 W.. Floating Feather Road. NOTE: CPA-2-98 & RZ-7-98 should be heard together since they are significantly interrelated. However, CPA-2-98 must be acted on prior RZ-7-98. NOTE: This item was scheduled to be held on August 21, 1999, City Council meeting with the public hearing being left open for additional public testimony at this meeting. D. CPA-3-98 - Comprehensive Plan Amendment for Patterson Property - Sharon Patterson: Sharon Patterson, represented by The Land Group, is requesting approval of a comprehensive plan amendment from Medium Density Residential (four dwelling units per acre maximum) and Industrial to Mixed Use and Commercial. The 9.6-acre and 1-acre sites are located on the southwest and southeast corners of State Highway 55 and Hill Road at 2805 and 2809 Hill Road. NOTE: This item was scheduled to be held on August 21, 1999, City Council meeting with the public hearing being left open for additional public testimony at this meeting. HEARING FORMAT FOR ITEM "D" a. On behalf of the City, for CPA-6-97, the Council appointed focus groups will present the plan that was presented to the City of Eagle Planning and Zoning Commission and the Commission will present the plan that they are proposing for Council review. b. Public testimony, limited to comments regarding the application being reviewed, will be taken. c. Council will not take action on any applications until all the public hearing have been closed. Don Brinton, 3355 Homer Road, Planning & Zoning Commission President, gives a review of the duties and schedule of the P&Z Commission. Clarifies that P&Z have no ulterior motive when reviewing the comprehensive plan. They wanted the comprehensive plan to be a guide, not law. Brinton discusses items that P&Z felt were of concern and would be important to the city and its growth. Brinton uses the comprehensive plan map and the land use map to demonstrate the items the Commission had changed. Again, density is explained and defined. Farrin Famworth, long time resident, responds to the comments that have been made at the public hearing meetings. Famworth reiterates the fact that the P&Z Commission made the very best decisions with all community members in mind. Famworth explains what Eagle's ethics and values used to be and what he would like Eagle's values are today. Guerber speaks on the existing comprehensive plan compared to the plan submitted by the P&Z Commission. The latter is much smaller than the existing plan. Most of the documentation that was removed was the history of Eagle, which does not need to be in the comp plan. Guerber suggests that any individual that feels the job of the Commission is an easy one should ask to replace the seat the will be vacated this fall. Page 4 of 6 Nancy Taylor explains that Gary Blalock, economic focus group member, will be at the Tuesday night meeting. Taylor speaks on schools, utilities and etc. Jim Carberry, of the school district, had addressed the individuals working on the comp plan and approved the plan. Taylor speaks in a politically correct manner. General discussion concerning the schools, their location and any influence that Eagle could have on the school planning process. Pat Miller, 959 Preakness, one of the focus members of the schools speaks on the schools placement, and the purchasing of land. Nancy Amell, long time resident of Eagle, was Principle of Eagle Elementary for many years and was on the schools focus group. Angela Deckers, 2249 Dicky Circle, representing the parks, recreation and open space focus group. Feels P&Z has a lack of vision. Feels the public has reiterated many times that they have put parks, recreation and open space their number one priority. Deckers recommends the City Council to just toss the section created by P&Z and start from the version that the focus group created. Merrill opens the meeting up to public comment: Morgan Masner, 3168 S. Whitepost, wants to speak on where they are going with this. Who do you represent? Density is really number 11 on a priority list. Cindy Paine, 701 Steepleview, Downing Downs, reads a statement that she has written at a previous date. Opposes the changing of her subdivision to zone R4. Pat Miller, 959 Preakness, feels P&Z and the focus group have two separate plans for the comp plan. Pro lower density. Betty Miller, 959 Preakness, Downing Downs should not have the zone changed. Have a petition signed by most residents to leave the zoning designation alone. Nancy Amell, P.O. Box 461, Eagle, has two concerns. Core of the city has many different definitions. Concerned about the expansion and development of the core of the city. Many established businesses were informed that they could only invest in property that was expensive and now the business district has been expanded to include less expensive property. Amell has an overhead and shows the area of first street describing the land and ownership of the area. If the zone is changed to commercial the individuals loose their homes. Much of the land is owned by two separate individuals. Found good looks, presentation, visionaries, and deep pockets the criteria for a developer. What does the City Council want for the city? Chris Cordy, 499 Main Street, represents Camille Beckman. Camille Beckman needs to relocate to Eagle. The property has several requirements, all of which are met by the location in Eagle. Property is located at Park Lane and Hwy 44. Susan Rogerty, 2278 Riveria, owner of Camille Beckman, would like to build a factory, warehouse, many gardens, and an art gallery. Would like to see this area zoned mixed use. This item will be continued on Tuesday. Page 5 of 6 Greg Johnson, 1848 N. Clarion Way, came here because of the existing comp plan. Same story, different person, for today, has been here before, said before .... Lloyd Gerber, 3420 Shadowville Stripe. P&Z plan comes out of general opinion not statistical data. The community has spoken many times. The people of today are speaking for the generations of tomorrow. In the focus group of one for the floodplain. Asking for trouble when we put residential in the floodplain. Ross Rupert, 25 S. Riverview, worked on the focus group for parks, recreation and open space. Volunteered for the P&Z Conmaission. Kathy Pennisi, 3675 N. Island Place, general comments on comp plan. Floyd Calhoun, 415 E. Carlton, owns property on Floating Feather. Heard last week that it all boils down to money for the developer. If he does not developer doesn't make money he won't develop and then who will build your homes. You can't do anything without money. Speaking up for Farhn Famworth, has been a good citizen for many years. Elenore Chase, 70 W. Floating Feather Road, wants to speak up for Farrin Famworth.
