1. Ada County Sheriffs Office: Topics of discussion include Probation and Parole, Jail
expansion and pre-trial release programs.
Eagle Chief Borgquist: Recognizes the Deputies that are leaving Eagle and introduces new
members of the team and the new Admin Clerk.
Mike Moser provides Council an overview of the business model within the jail,jail expansion,
and probation and parole. General discussion.
Lt. Jon McDaniels distributes a handout and provides Council an overview of the pretrial
decision making.
Sandy Jones, I manage the missing information unit for the Sheriff's Department, provides the
Council an overview.
2. Museum Coordinator Report: Alana Dunn reports on the activities at the Museum and the
displays planned for the City Hall lobby. Reports on the Arcadia book project. The alarm
system, smoke detectors and motion sensors have been installed at the Museum. General

LLC, represented by Eric Anderson with ALC Architecture, is requesting approval
of a rezone from A-R(Agricultural-Residential—up to one(1)unit per five(5)

located on the south side of West Flint Drive approximately 870-feet east of the

Park Subdivision—ETBC,LLC.: ETBC,LLC, represented by Ed Priddy, is
requesting a preliminary plat extension of time for Stillwater Business Park
Subdivision, an 18-lot(12-buildable, 5-common and 1-private drive)commercial
development. The 24.06-acre site is located approximately 1,300 feet west of W.
Ballantyne Road on the south side of West State Street(SH 44)at 2505 West State

H.(9A.) WA-03-12 -Request for waiver of applications fees by Chad Moffat for
ZOA-03-12: Chad Moffat is requesting a waiver and refund of application fees
($1,400.00) for the above referenced zoning amendment that was approved on
October 23, 2012. (WEV)
I(9C.) City to consider and approve letter to the Board of the Spring Valley
CID#1 with the City's approval of the annexation of a 10 acre parcel of
property into the District. I.C. 50-3106(2). The referenced 10 acre parcel was
annexed into the City by Ordinance 681.

election.

Chris Rich, County Clerk, I am here to discuss the November 6th Bond Election. All Counties
are now charged with handling all city elections. There are 15 precincts and 3 are in the City of
Eagle and two precincts are split with Eagle Residents and County Residents. Discusses the
voting routine. It is my supposition that when folks were setting up there were line forming and
they had a lot of pressure; particularly#1402. I think that when they opened up they just grabbed
ballots. I believe in 1402 for the non-Eagle ballot was handed out. I asked stall to tally up(see
tape)27 people in 1402 did not receive the correct ballot. There is no way to tie the ballot in the
can with how they voted. In#1407 the same thing transpired and that was resolved fairly
quickly.
Grasser: I appreciate your explanation and this is a tough job. The thing I came away with is
that there is a lot of doubt that not everyone was represented. Everyone that wanted to vote on
the issue didn't vote. I'm concern that we didn't come away with a full vote. I think the County
should run another election on this particular issue. Like you said we have 16 split precincts.
Chris Rich, I agree,the results are inconclusive and one of the things we like to have is finality.
With regards to go forward,there would be no cost to you if you should decide to have another
election,this is required by statute. You could also ask for a recount and it would cost you $100
per precinct but this probably would not change the outcome. If you would go to Court to
challenge the election,I am not sure what this would get you. The next date would be in May.

Semanko: I appreciate you being here. It has been established that some people who wanted to
vote on this issue did not get to vote. I want to know if the mistake affected the outcome. Can
you tell us with certainty in the entire City of Eagle how many Eagle voters showed up and
signed the book versus how many voters actually cast ballots in Eagle in this election? That does
go to the issue of whether there was an impact to the outcome.
Chris Rich, It could very well be that the wrong ballots were handed out in other precincts. I
don't that until we get through the canvass. We could back and take a look and make a tally.
This is a simple process although time consuming. Discusses the three different voting
procedures.

Jeff Kunz, I have some additional concerns. My concern is that non-Eagle residents may have
received a ballot with the Eagle Bond Election. Jeff displays overheads and discusses the bond
election.

Foad Rogaine, I want to echo what Jeff said. Personally I don't think a recount is necessary.
Let's go ahead and have another election.

Semanko moves to instruct our City Attorney to prepare a Resolution for a Bond Election
at the earliest next available date and I understand that would be May and this prepare for
early action by the Council so that everyone understands that we feel that the election was
not conducted correctly and we feel the only to correct that is to hold another election in

B. Dog Park hours at Eagle City Parks—The City Council is seeking public testimony
regarding implementing"dog park"hours within the municipal park system. Residents are
encouraged to provide comment on the designated hours and parks. (MD) This item was

Defayette: This is the third time that this has been brought up for public comment and I brought
it up thinking that the community was interest and it seems nobody really cares so I'm not going
to create a whole bunch of work for our staff to make changes.
C. Notice Of Public Hearing-Amendment To Fiscal Year 12/13 Budget- City Of Eaglet
Idaho:NOTICE IS HEREBY GIVEN that the City Council of the City of Eagle, Idaho,will hold
a public hearing for consideration of an amendment to the 2012/2013 fiscal year budget by
appropriating additional monies received by the City of Eagle, said hearing to be held at City

Jeff Kunz, I would encourage you to add these funds to the City Hall Reserve fund. Doing so
sends a clear signal to Hawkins—Smith, the lessor,that you are serious trying to get the building
purchased, it increases the amount of your down payment by 50% and it further minimize your

Terry Sayer, 2151 W. Forest Hill Ct., I respectfully request that you consider removing the
Mixed Use Sub Area near Ballantyne and State Street,north of State 44 from the current rezone
for all Mixed Use designations. Discusses the density in the area and the downtown area and the
sub-area. General discussion.
Charlene Ford 208 West Holly Mtn. Drive,I just found this out at our Homeowners meeting.
The intersection has been changed many times to make this safe. This is an important
intersection and it needs to be considered separately from a downtown intersection. Anything
high use there would be risky.

D. Lease Agreement for Maintenance Shop: A lease agreement for a site within Eagle City
Limits to be utilized as a maintenance shop. The lease cost is an approved budgeted item.

Planner Williams discusses the Engineer's letters and I would like to have another condition of
development added in regards to the New Dry Creek Irrigation. I would like another Site
Specific Condition of Development added. I was contacted by Ron Sedlacek with New Dry
Creek Ditch Company and they are proposing to utilize the existing maintenance road which is
located in the New Union easement. I would request that the condition state: "That the
applicant shall provide a license agreement with New Dry Creek Ditch Company for
facilities and access roads located within the New Dry Creek Ditch Company easement.
The License Agreement shall be provided to the City prior to the City Clerk signing the
Final Plat".

8. Library Director's Report: You have a copy of the October statistics. Steve provides an
overview of the circulation and the activities at the Library. We are ready to submit our RFP for
the RFID. We have a 501h year Library Card coming out. We are beginning to weed the
Children's Collection. General discussion.

Grasser: No report
Semanko: The City of Boise has their portion of the Greenbelt on the South Side of the South
Channel finished. They moved the fence further to the South and now there is a pathway all the
way through Garden City into Eagle all the way to the back of Laguna Point. When you get to
Laguna there is a gate that says No Trespassing and clearly there is a path there and it goes in
varying sizes and difficulties of terrain all the way to Eagle Road and I know of at least one
person who walks on that, and possibly there are more, and I would like to know if that is
trespassing or not. If it isn't then that fence/gate should be removed immediately. I would like
our legal counsel to look at that with our Director and if there is a public right-of-way through
there they should be advised to remove that gate immediately. General discussion.

10. City Hall Department Supervisor Reports:
Zoning Administrator: No report
Park&Rec Director Aho: I have been busy. I have been out to the Sports Park,the Lions Club
and Chamber meetings and have done a park tour with Dave and he has shown me the parks and
some of the issues. I'm working on a variety of things. There is a kettle corn vendor requesting
to use Heritage Park a couple times a week this winter,this vendor has been there this summer. I
would like to bring a contract forth to the Council allowing this using this winter. Council
concurs.
Director Aho plays a video for the Council on the Waffle Cross event held at the Sports Complex
last week end. There will be another event on December 15,2012. There were about 150 riders
that participated.
Zoning Administrator Report: December meeting dates are the 11th and the 25th. I'm sure you
don't want to meet on the 25th but do you want a second meeting in December? Council concurs
to cancel December 25th meeting and the Zoning Administrator to advise if a second meeting in
December is needed.
11. City Attorney Report: No report
12. Zoning Administrator Report: I'm sure you don't want to meet on the 25th but do you want
a second meeting in December? General discussion. Council concurs not to have a second
meeting in December and Zoning Administrator will advise the Council if a second meeting is
needed in December.
10. EXECUTIVE SESSION: Personnel §67-2345 (a) &/or (b) §67-2345. Executive sessions --
When authorized. (1) An executive session at which members of the public are excluded may be
held, but only for the purposes and only in the manner set forth in this section. The motion to go
into executive session shall identify the specific subsections of this section that authorize the
executive session. There shall be a roll call vote on the motion and the vote shall be recorded in
the minutes. An executive session shall be authorized by a two-thirds (2/3)vote of the governing
body. An executive session may be held:
(a) To consider hiring a public officer, employee, staff member or individual agent, wherein

Regarding Ordinance 673, Second Reading, I respectfully request that you
consider removing the Mixed Use Sub Area near Ballantyne and State Street,
north of State 44 from the current rezone for all Mixed Use designations. The
increase from 10 to 20 units per acre should not apply to this area. This "Sub
Area" area was included but not addressed when you established the last Comp
Plan and should have comment from the neighbors this would affect.
I understand the higher density for downtown. This "sub -area" is not part of the
downtown area. Single-family homes surround this area, which range from 9x41
acre to 1/3acre to probably not less than %-acre homes. I understand mixed use
means small business, office space and maybe business/residences. Access to
State Hwy 44 as well as State St and Ballantyne could not stand the traffic that
kind of density would bring.
The density of the area you propose is sure to overwhelm our neighborhood
Since there are no parks at this end of town, we will become host to the residents
of the new population explosion intended with that type of density.
Speaking for Countryside Estates, we are already infused with nonresident users
of OUR common area pathways and neighborhood parks.
The reality is that we already unintentionally host multiple neighborhoods
adjacent to us. I don't mean that we object to sharing, but the extra population
comes with a price tag to us, as we alone pay the maintenance and repair bills for
our private mini parks and pathways.

INTRODUCTION
This memorandum summarizes the preliminary improvement phasing analysis and implementation
recommendations for the update to the Northwest Foothills Transportation Study (NWFTS) as
conducted by Kittelson & Associates (KAI). The purpose of this evaluation is to provide guidance on
the implementation of improvements as traffic demand changes and new development occurs in the
study area. Figure 1 shows the preliminary recommended roadway improvements and identifies the
changes from the 2008 study.
IMPLEMENTATION PLAN PROCESS
The two primary elements of the implementation plan for the NWFTS are the identification of when
each improvement is needed and development of a threshold "trigger" that can be monitored to
identify when an improvement should be considered. The timeframe for each improvement was
determined by reviewing a number of considerations. The first consideration was the timing of the
improvement based on the projected growth in traffic. The second consideration is how the
improvement corresponds to other improvements planned in the area or on connecting roadways.
The third consideration is the importance of the improvement to support ongoing growth. The final
consideration is whether the improvement can be funded and constructed within the proposed
timeframe accounting for other improvements that also must he completed.

In order to address these considerations, KAI utilized a three-step process for determining the
improvement phasing. The first step was to determine the projected timeframe for widening of
existing roadways assuming regional traffic growth occurs at a consistent rate between 2012 and
2035. This step identifies the relative timeframe based solely on traffic volume growth.
The second step was to review when key roadways providing access to specific developments were
required as identified in the traffic impact studies (TIS) conducted for the Spring Valley, Avimor, and
Dry Creek Ranch developments. These roadway improvement projects may shift in time based on the
development location and intensity, but have been determined to be needed in order for
development to occur. Therefore these roadways will be required by ACHD and/or ITD through their
respective approval and permit processes.
The final step was to review ACHD and ITD plans for improvements including the ACHD Capital
Improvement Plan (CIP), ITD plans for SH 44 and SH 16, and the State Street TTOP study. This review
is primarily applicable to improvements that are already programmed by ACHD and ITD.
The outcome of this implementation process was an estimated timeframe for each roadway
improvement identified in the plan and one or more triggers to monitor when the improvement may
be required. The timing for each proposed improvement was categorized into four categories:
• Short Term: Improvements that are planned to be constructed by ACHD, ITD or developers
in the next 5 years.
• Medium Term: Improvements that are planned or estimated to be needed within the next 10
years, or are identified as part of the middle phases of developments.
• Long Term: Improvements that are planned or estimated to be needed within the next 10-20
years, or are identified as part of the later phases of the developments.
• Very Long Term: Improvements that are planned or estimated to be needed near the end of
the 2035 study horizon.
In addition to these timeframes, some roadways are in areas that may not develop at all by 2035.
These roadways were left out of the implementation plan because they are solely to access certain
development areas and are not needed for any other reason.
The trigger for most improvements to existing roadways is based on the weekday peak hour
directional traffic volumes. Traffic volumes are monitored by ACHD through traffic studies and the
periodic update of their CIP, and by ITD through permanent traf is counter stations and traffic
studies. In instances where new roadways are solely associated with new development, they were
identified as "development -driven." In instances that improvements to existing roadways are

significantly accelerated (moved up in time) by NWFTS developments, the improvement was
identified as "development -accelerated." For development -driven and development -accelerated
improvements, an estimate of development units is provided based on the traffic analysis conducted
for this study and traffic information provided in the studies for specific developments. The
development unit trigger is only intended to be a guide and the final unit threshold will be
determined as part of the development approval process through the City, ACHD, and ITD.
Table 1 lists the NWFTS development driven improvements and Figure 2 illustrates their location.

As shown in Table 1 and Figure 2, most of the development -driven improvements are new roadways
that will be constructed as part of the developments. The key system improvements that are
required because of the developments are along SH 55 from Floating Feather through Avimor and
constructing grade separations along SH 16. The remainder of the improvements recommended as
part of this plan would be needed with, or without, the additional development proposed in the
foothills as part of the NWFTS update.
Finally, potential funding sources were identified for each improvement. For the purpose of this
study, the financing options were limited to the following:
• ACHD CIP: Applicable for improvements to ACHD arterials that are listed on the CIP. Note
that the CIP does not guarantee funding but provides a funding mechanism.
• ACHD Unfunded: Applicable for improvements to ACHD arterials that are not included in
the CIP but are shown to be needed.
• Extraordinary Impact Fee (EIF): Potentially applicable for construction on the arterial
roadway system if ACHD were to work with developments in a particular area to establish an
EIF.
• Community Infrastructure District (CID): Potentially applicable funding source for
developments and improvements that qualify and enter an agreement with the City and
roadway agency.
• ITD Funded: Improvements on the state highway system that are included in the ITD 5 -Year
Statewide Transportation Improvement Program (STIP)
• ITD Unfunded: Improvements on the state highway system that are not fully funded at this
time.
• Private: Applicable to improvements that are development -driven or development -
accelerated.
SUMMARY OF PRELIMINARY RESULTS
Based on the implementation plan process, each of the improvements were categorized into one of
four timeframes. Figures 3 through 6 show the improvements estimated to be required during each
timeframe. Table 2 describes each of the improvements, references to other studies, the potential
funding sources, and the trigger(s).
Following is a summary of preliminary analysis findings and recommendations that will be presented
at the PMT and SC meetings for discussion:
• Most of the improvements recommended as part of this study will be needed with, or without,
development of the NWFTS developments.
• Most of the short-term improvements on the existing transportation system are funded and
planned for construction in the next five years.

• The two most significant medium-term improvements to existing roadways that remain
unfunded are the widening of Chinden Boulevard (20/26) to four lanes and the widening of
Highway 55 to four lanes north of Beacon Light Road.
• All of the long-term widening needs on ITD roadways are unfunded including:
o SH 16, SH 44 to M3 Spring Valley
o SH 44, Glenwood to SH 55
o Eagle Road, Chinden Boulevard to SH 44
• Significant improvements are needed in the very -long-term, which include the grade
separations on SH 16, and widening SH 55 to 7 lanes between SH 44 and Beacon Light Road.
We look forward to discussing the information provided in this memo and receiving your input on
how we proceed through the next steps of this study update.
