To receive a `Certificate of Completion', you must finalize this project prior to the expiration date above: IBC & IRC sections 105.5 are amended to read as follows: 105.5 Expiration. Every permit issued by the building official under the provisions of this chapter shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced within 180 calendar days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 180 calendar days. The timeframe by which a project shall be deemed to be suspended or abandoned shall be measured from the date of the last major inspection that resulted in an approval to move to the next stage of construction by the city of Eagle or if no inspection has been required then a project shall be deemed to be suspended 180 calendar days from the date the permit was issued. Eagle City Code Sec 105.5 also States: If more than one year has passed since the permit has expired or the city has adopted a new version of the building code, then the applicant shall apply for a new permit and the plans will be subject to a new plan review process and related permit fees. The City of Eagle regrets this project was never finalized. If you have any questions regarding this action or to inquire about your extension options, please contact my assistant Charlene Elg in the Building Department at 489-8760. Respectfully, Michael Echeita Building Official CC: Current Resident Mayor & City Council Members File Mayor James D Reynolds April 26, 2012 Natural Hot Springs Pool & Spa 2430 Sand Hollow Eagle, ID 83616 City of Eagle 660 E Civic Lane PO Box 1520 Eagle, Idaho 83616 Building Dept 208-489-8760 Re: Extension of Building Permit 11-04-009 at 1850 W Golf Ct Dear Natural Hot Springs Pool & Spa, Council Members Mark Butler Mary Defayette John Grasser Norm Semanko On April 25", 2012 the City of Eagle received your letter requesting an extension of time for the building permit that was issued for an In -ground Spa located on Lot 51 Block 43 in the Banbury Meadows #7 Subdivision. To accommodate your request, your permit is extended to November 18, 2012 under Eagle City Code Section 7-1A-3 & 7-1A-4. This section, as adopted by the Eagle City Council, limits a permit holder and applicants to only one extension. Eagle City Code Section 7-1A-3 & 7-1A-4 has amended the 2003 International Building & International Residential Code Sections R105.5 which allowed a 90 day extension, to be increased to a period of 180 Days to grant more flexibility to the building community when unforeseen conditions are presented. IBC & IRC sections 105.5 are amended to read as follows: 105.5 Expiration. The timeframe by which a project shall be deemed to be suspended or abandoned shall be measured from the date of the last major inspection that resulted in an approval to move to the next stage of construction by the city of Eagle or if no inspection has been required then a project shall be deemed to be suspended 180 calendar days from the date the permit was issued. b. Permit Extensions. Any permittee holding an unexpired permit may apply for an extension of the time within which work may commence under that permit, when the permittee is unable to commence work within the time required by this section. The building official may extend the time for action by the permittee for a period not exceeding 180 calendar days on written request by the permittee with written evidence provided demonstrating that a good faith effort to complete the project has been made and that reasons beyond the control of the permittee have resulted in a delay. Under no condition shall a permit be extended more than once. We will be available to review any changes which may develop during this time frame and are ready to answer any questions regarding this extension.
