Jeff Kunz provides an overview of the Bond Election, discusses the article in today's Idaho Statesman and the article in the Valley Times. Discussion of Engineering fees associated with VAC-01-12—Jonathon and Patricia Kramer: (JDR) Mayor introduces the issue. Zoning Administrator Vaughan: Today Mike and I resolved this issue Jonathon and Patricia Kramer. B. Discussion on Opening the Budget and Draft Amended Appropriation Ordinance. (SKB) Mayor introduces the issue. City Clerk Bergmann: the procedure is to amend the Annual Appropriation Ordinance with a public hearing. If you would like to see this on your November 13th meeting you need to instruct me to proceed. The Public Hearing Notice needs to be published 2 times. I leave the previous fiscal year open until the middle of October in order to receive all of the outstanding invoices that need to be paid for the last fiscal year. Since my previous report I have deducted those expenditures from the previous total. The new figure is $222,674.00. In order to do the Ordinance I will need to know the expenditures of those funds which will need to be set out in the Ordinance. General discussion on adding these funds to the City Hall Purchase Reserve Fund. Lease agreement for Maintenance Shop: The City Attorney is requesting Council authorize the Mayor to sign the lease agreement contingent upon the modifications she deems necessary to the agreement, and subsequent acceptance by the Lessor. The lease cost is an approved budgeted item. (SKB & WEV) Mayor introduces the issue. City Attorney Buxton: I was provided with a Draft Lease that would benefit City Maintenance and the Water Department. This Lease is going to need to be revamped and the appropriation clause needs to be included. I need to negotiate with this Landlord. We would like to get this in place as soon as possible. My request would to authorize the Mayor to sign the Lease as soon as we get this Lease negotiated. General discussion on the offer from the State to use a shop facility at Eagle Island State Park. Agreement for Financial Advisory Services: An agreement between the City of Eagle and Zions Bank Public Finance for Bond Advisory Services associated with the November Bond Election. (SKB) Mayor introduces the issue. City Attorney Buxton provides an overview of the Agreement for Financial Advisory Services. Cameron Arial, Zions Bank Public Finance, discusses the Agreement for Financial Advisory Services. General discussion. Semanko moves that we authorize the Mayor to Execute this Financial Advisory Services Agreement contingent on final review by our Bond Counsel and said agreement be posted on the website with all of the other Bond Election information. Discussion of the City of Eagle paying for the postal mailing of a factual article to all registered voters in Eagle prior to the November 6th bond election. (NS) Mayor introduces the issue. City Clerk Bergmann discusses the cost of mailing to 9,000 registered voters. The cost for Autosort to do the application of addresses, postage and presorting for the Post Office would be $2,235.00. Ada County charges $20.00 to get the list of registered votes on a CD. City Attorney Buxton discusses her memorandum to Council in regards to Bond Election Expenditures for a factual information flyer paid for by the City. Buxton DATE: October 23, 2012 RE: Bond Election Expenditures We have been asked to address the question of whether the city may be involved in providing information about the upcoming city hall bond election. In short, public agencies, including cities, may not spend public funds to influence the outcome of elections, although they may make such expenditures to encourage voter participation or to represent fairly both sides of an issue. The leading Idaho case addressing this issue is Ameritel Inns, Inc. v. Greater Boise Auditorium District, 141 Idaho 849, 119 P.3d 624 (2005). In that case, the Idaho Supreme Court held that an auditorium district could not use public funds to support or oppose any measure to be voted upon in an auditorium district election, including the bond election at issue in the case. As Idaho courts had not previously addressed this issue, the Court quoted with approval from two California Supreme Court cases. Each of those cases discussed the general notion that it would be fundamentally unfair to the democratic process to allow government to "take sides," which could have the effect of the government improperly disadvantaging other viewpoints. Id. at 854, 119 P.3d at 659. The Idaho Attorney General's Office has also issued several legal guidelines over the years addressing this issue. For example, Attorney General Opinion 6-75 addressed the issue of expenditure of public funds on a bond election for an auditorium district. The opinion concluded that a taxing district may utilize public funds to advertise a bond election provided the funds used equally present the pro and con positions of the ballot question, and so long as funds are not used to encourage voters to pass the bond. The opinion further concluded that expenditures for informational advertising are permissible so long as that information is limited to information about the election, such as the location of the polling places, the hours that polling places are open, the bond authorization being sought, and information regarding the cost of the bond to property owners. Although the use of mailers to provide factual information about an election has never specifically been addressed in Idaho, the guidelines discussed above would apply to this type of Mayor Jim Reynolds Eagle City Council October 23, 2012 Page 2 advertising or communication. Thus, as long as any information included on the mailer is factual and does not advocate for or against the passage of the bond, the mailer should not violate the principles described above. Setback reductions (to be measured from the foundation to the property line): 1. No portion of the structure may extend more than 2 feet into the side yard setback; 2. Open structures such as porches, canopies, balconies, platforms, carports, covered patios and similar architectural projections shall be considered part of the building to which they are attached and shall not project more than 15 feet into the required rear yard setback; 3. Open porches for residential dwelling units shall not project more than 5 feet into the required front yard setback; 4. A single-family dwelling unit that utilizes a side entry garage shall be permitted to have a 5 foot reduction in the minimum required front yard setback provided that the distance is no less than 20 feet, and no less than 15 feet within the MU zoning district, measured from the foundation of the garage to the property line. 5. Upon the establishment of the following criteria, accessory structures shall be permitted to be located within a minimum of 15 feet of the rear property line: a. Be compatible with the scale and design of the structures and overall existing development pattern of the surrounding area; b. Not impair reasonable or appropriate use of adjoining properties; c. Not result in greater impacts on natural resources; d. If authorized, the waiver may only be granted for the minimum amount necessary to achieve the stated nuraose of the waiver sought. Section 2: If any provision in this Ordinance shall be declared by any court of competent jurisdiction to be contrary to law, then such provision shall be null and void and shall be deemed severable from the remaining provisions in this Ordinance and shall in no way affect the validity of the other provisions of this Ordinance or Eagle City Code. Section 3: All prior ordinances or parts thereof, to the extent inconsistent herewith, are hereby repealed and shall, to the extent of such inconsistency, have no further force or effect. Section 4: This Ordinance, or a summary thereof in compliance with Section 50-901A, Idaho Code, shall be published once in the official newspaper of the City, and shall take effect immediately upon its passage, approval, and publication.
