PRE-COUNCIL AGENDA: 5:30 p.m.-6:30 p.m.
a) Mayor and Council Reports and Concerns:
Butler reports on the Urban Renewal committee meeting with owners of the 4 corners property
wherein they discussed the types of uses and the access. General discussion.
Mayor reports on the Treasurer Valley Partnership meeting held yesterday.
b) City Clerk/Treasurer Report: None
c) Zoning Administrator's Report: None
d) Public Works Director Report: Reports on the downtown trees from the Liquor Store to the
West. A lot of water lines have broken by the trees so there will be crews out taking care of
those problems. We have had a crew at the Sports Complex doing a lot of mowing and we will
have a crew down at the river pathways today or tomorrow.
Defayette: After our joint meeting with ACHD where we talked about Hill Road. I met with
Director Wong and Paul Bagel,head of maintenance. They walked the road with me and agreed
to do some interim improvements. Starting now they will be adding a paved shoulder from
Edgewood all the way to Guerber Park.
Discussion on new crosswalk lights.
e) City Attorney Report: None
1) Butler: I would like to see us reorganize our pre-council agenda as of the first of October.
We will have the new departments set up. To be efficient as possible and not keep staff here that
really don't need to be here,I was thinking that on the reports that we have building official
report, water superintendent report,park&rec report, facilities report. We could have the
building official do a monthly report. The Clerk and the Zoning Administrator always have to be
here. I would still like to have monthly reports from the Library, Museum and Sheriff. General

Butler moves to amend the agenda to clarify that Items#A and B under 3 are public
comment and not portions of the Pledge of Allegiance,to add Item#6C.1 as requested by
the Clerk which is amendments to the Budget for Amended Appropriation Ordinance No.
677 and Item #8E.a request from Mickey Ray for a noise waiver for the September 8th Pig
Roast to allow the sound to 11:00 p.m. Seconded by Grasser. ALL AYES: MOTION

Development Plan and Final Plat for Snoqualmie Falls Subdivision No. 1
(Legacy)—Horseshoe Flats,LLC: Horseshoe Flats, LLC, represented by Justin
Martin, is requesting a revision of the phasing plan for Mosca Seca Subdivision,
a 386-lot residential subdivision(344-residential, 42-common). The applicant is
also requesting final development plan and final plat approval for Snoqualmie
Falls Subdivision No. 1 (a portion of the approved Mosca Seca Subdivision No.
3)a 21-lot(19-buildable, 2 common)residential development. T he 228.79 acre
site is located south of Floating Feather Road and west of Linder Road. (WEV)
D. EXT-04-12—Final Plat Extension of Time for Springhaven Subdivision
(FP-06-08)—Matthew Smith: Matthew Smith is requesting a one(1)year
extension of time for the final plat approval for Springhaven Subdivision, an 8-
lot(6-buildable,2-common)residential subdivision. The 14.36-acre site is
located on the south side of East Beacon Light Road approximately 1,984 feet
east of the intersection of North Eagle Road and East Beacon Light Road at 671 •

Mayor introduces the issue.
Defayette shows the Council pictures on her camera that she took today on Edgewood. Discusses
the problem with cars parking in the bike lanes.
Chief Borgquist discusses the problems on parking in bike lanes. I would recommend putting
signage on Edgewood. The signage would be done by ACHD and I have requested this. This is
much easier for us to enforce than an Ordinance. General discussion.
Council concurs to have Chief Borgquist proceed with signage.
C. Fiscal Year 2012-2013 Budget: City Prosecutor Contract. (SM & SKB)
Mayor introduces the issue.
Susie Mimura discusses the budget request for FY 2012/2013 which is based on the increased
workload and the increase of the revenues. We ask you to make motion to authorize the Mayor
to execute a new Letter of Engagement or Contract for Legal Services to provide for the
prosecutorial services for the City of Eagle in the amount of$53,400.00 per year. General
discussion.
Butler moves to put the amount of$53,400 in the Budget and we authorize the Mayor to

C.1. Amended Ordinance No. 677: An Amended Ordinance Entitled The Annual
Appropriation Ordinance For The City Of Eagle, Idaho, For The Fiscal Year 2013 commencing
October 1, 2012, And Ending September 30,2013.
City Clerk/Treasurer Bergmann, discusses the L2 Form and the property taxes that was prepared
in accordance with Council's previous motion. After the meeting on August 21st I received from
Ada County the update taxable property value. The market value was reduced and this affected
the amount I used on the L2 Form. The current L2 Form I have provided you will be the
property taxes for FY 2012/2013. I also made all of the changes that were adopted on the 21st
and that reduced the City Hall Reserve Fund by$30,758 in order to balance the Budget.
Yesterday we received the final distribution from the State Liquor Distribution in the amount of
$92,481.00,this is in addition to the quarterly payments we have received. I have recommended
that the Carry Over be increased by$100,000 on the Revenue side and I have added this on the
expenditure side to the City Hall Reserve Fund which brings that up to$603,278.00. General
discussion.

Butler moves, pursuant to Idaho Code, Section 50-902,that the rule requiring Ordinances
to be read on three different days with one reading to be in full be dispensed with,and that
Amended Ordinance#677 including the Budget numbers that were just adopted be
considered after being read once by title only. Butler reads Amended Ordinance#677 by

Butler: After the meeting last time I spoke with the applicant's representative with Fox Land
Surveying and mentioned that it would be worthwhile to contact the two developers of the
Shores and Two Rivers and I then emailed the City when 1 got home that evening to put in the
file.

A. VAC-01-12—Request for a vacation to the final plat of The Shores Subdivision No. 1 —
Jonathon and Patricia Kramer: Jonathon and Patricia Kramer, represented by Thomas Judge
with Fox Land Surveys, Inc., are requesting a vacation of a common lot(Lot 8, Block 4), lot line,
and easements located within The Shores Subdivision No. 1,Lots 8 and 9, Block 4. The two (2)
lots combined consist of 36,324-square feet(0.83-acres)and are located on the north side of
West Sherason Drive approximately 320-feet north of the intersection with West Watersford
Drive at 736 West Sherason Drive. (WEV) This item was continued from the August 14, 2012
meeting.

9.96-acre site is located on the east side of State Highway 16 at the northeast corner of State

Basically this adds the Department Heads that we created and the Museum Curator. General

Mayor opens the Public Hearing
Kay Kieppen, 8600 W. Equest Lane, my husband and I own and reside on the property directly to
the East of this property. Our CC & R's only provide for one unit per ten acres. To date M3 has
not approached us to change our CC & R's. My other concern is a safety issue on access on and
off of Highway 16. The speed limit is 65 miles per hour. General discussion.
Patricia Minkiewicz, 3047 Deerfield Court, I'm confused on if this is only an annexation. I'm
really confused about the CC&R's, do those not allow for rezone?
Zoning Administrator Vaughan, provide an overview of how property is annexed and rezoned in
accordance with the comp plan and City Code.
Gerry Robbins, representing M3, at this time all we are asking is annexation and rezone. At the
appropriate time that we are requesting other changes we will come back to the Council.

Foad Roghani, I want to say thank you for listening to the public last week and doing what you
did. A bond issue is the correct approach. A few of us have talked about how we can help the
City. We have discussed various options. The General Obligation Bond is probably the best
way to go.

After the budget meeting of last week and after hearing your vote, some of us started to talk about ways
of helping the city.
Paul Beckman and I wanted to look for a solution for the city hall where we could assist you.
I contacted Jim Wrigley whom I have known for years
We met with Jim to discuss options and bond issue.
We looked over Jim's General Obligation Bond information (GOB). He said he had sent the same thing to
Susan, Eagle's City Attorney
We discussed multiple ways to make this happen, including a municipal lease to own option
It appeared to us that the best option was the GOB
We believe we can sell this to the public, simply;
Approve the bond and reduce your taxes
Annual lease rate soon goes back to $240,000 plus approximately $20,000 taxes
Bond yearly payment would be around $120,000 for 15 years re>4\3560_, bov
Savings to citizens; about $140,000 a year
Council could possibly vote on and approve a reduction to the city O&M levy rate to take place as soon
as the bond is approved and the smaller bond levy rate takes place so that the public knows the council
is serious about saving the taxpayers money. This could possibly be done and implemented before the
citizens receive their tax bill, this year. Merry X -Mas from Eagle mayor and City Council.
Jim is going to send me an email of what those levy rates are estimated to be by tomorrow and I will be
glad to forward them to the council

to the event, the applicant is request this item be added to the agenda tonight for action.
Mickey Ray BBQ is requesting a noise waiver for September 8`h until 11:00 p.m., for their 2"
annual Pig Roast. They have applied for both their catering & open container permits and
approval is pending from ACSO.
