A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE COMMON LOT (LOT 8,
BLOCK 4) AND THE LOT LINE AND UTILITY, DRAINAGE, AND IRRIGATION EASEMENTS
LOCATED BETWEEN LOTS 8 & 9, BLOCK 4 (THE SHORES SUBDIVISION NO. 1) AS SHOWN
ON THE ATTACHMENTS HERETO;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Jonathan and Patricia Kramer requested a vacation to the final plat of The Shores
Subdivision No. 1 to remove the common lot (Lot 8, Block 4) and the lot line and utility, drainage, and
irrigation easements located between Lots 8 & 9, Block 4(The Shores Subdivision No. 1); and
WHEREAS, On July 16, 2012, the Commission recommended approval of the vacation (VAC-
01-12), with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Valley
Times on July 30, 2012, and August 6, 2012; and
WHEREAS, On August 14, 2012,the City Council held a public hearing on the proposed vacation
(VAC-01-12) at which time, the City Council requested additional information and continued the public
hearing to August 28, 2012. The information was provided at the August 28, 2012, hearing and the City
Council upon review of the provided information voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats-Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications."
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates the common lot(Lot 8, Block 4) as shown on the final plat
of The Shores Subdivision No. 1, as considered, heard, and approved by the Council at its August 28,
2012, public hearing for application number VAC-01-12, and as shown on the attachment hereto (Exhibit
A).
The Eagle City Council hereby vacates the lot line and utility, drainage, and irrigation easements
centered on the lot lines between Lots 8 & 9, Block 4, of the final plat of The Shores Subdivision No. 1, as
considered, heard, and approved by the Council at its August 28, 2012, public hearing for application
number VAC-01-12, and as shown on the attachments hereto(Exhibit B).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
