Minutes - 2012 - City Council - 08/14/2012 - Regular EAGLE CITY COUNCIL Minutes August 14,2012 PRE-COUNCIL AGENDA: 5:30 p.m.-6:30 p.m. 1. Boise River Feasibility Study: Ellen Berggren with the U.S. Army Corps of Engineers & Cynthia Bridge Clark with Idaho Department of Water Resources. Ellen Berggren,Army Corps of Engineers,provides Council an overview of the Boise River Feasibility Study and provides an update on other projects. Presents a power point and discusses the same. Cynthia Bridge Clark,Department of Water Resources,most of time is working on programs and projects. Discusses and provides an overview of the statewide water storage initiative. 2. Mayor and Council Reports and Concerns: Mayor reports on the Coffee with the Mayor. I had a lady ask about trapping in the City. MYAC will be doing enrollment at Eagle High School. Thursday is the Mayor's Cup Golf Classic. Butler: Reports on the Library Board meeting. Discusses on the changes the new Director is implementing. Mary and I attended Garden City's Council meeting where they discussed the bride and the grant. There will also be an issue on the ballot of whether or not the pathways should be open to bikes. General discussion. Defayette: Reports on the Senior Citizen Board Meeting. They are pursuing getting a new van and possibly a second van. Discussion on starting a self-funded food bank. Discussion the water features being on longer in the evening, until the sun goes down. Deputy Jacob Mulkey, discusses Eagle's lack of a bike lane ordinance. We have a problem in one subdivision where motorists park in the designated bike lane. We find that we have no way to enforce this. We have talked to residents in the area about not parking cars in the bike lanes. Our main focus is safety of the bicyclists. We support whatever you see fit to address this issue. PUBLIC COMMENT: A. Recognition of the band The Lost Boys: Mayor Reynolds and the City Council will present a certificate of achievement to the members of the Lost Boys who recently won the Boise's Got Talent competition. Mayor introduces the issue and recognizes the Lost Boys with Certificates of Achievements. Mayor presents the Certificates to Andrew Coba, Ethan Jesse, Shad Tuck, Tanner Tuck and Steven Arthur. B. Other: None 5. CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Noise Waiver Request: Eagle Church of the Nazarene is requesting a noise waiver on August 17, 2012, until 11:00 p.m. for their outdoor family movie presentation of"The Ultimate gift". The movie will be held along the west side of the church property located at 1001 West State Street. (SKB) G. Minutes of August 8,2012. Butler: I would like to add Items#9A, B & C under New Business, 2 are extensions of time and one final plat to the Consent Agenda. Staff said the applicants are fine with the conditions. I would be willing to make a motion to add#9A, B & C to the Consent Agenda if the Council found it appropriate. General discussion. Semanko moves to approve the Consent Agenda Items#5A thru G. Defayette: I have a minor change to#5B the Minutes of July 16,2012,where we talked about the Philharmonic I would like the record to show that Council unanimously approved a$5,000 donation to the Philharmonic, Semanko I move to approve Consent Items#A and#C thru#G. VAC-01-12—Request for a vacation to the final plat of The Shores Subdivision No. 1— Jonathon and Patricia Kramer: Jonathon and Patricia Kramer, represented by Thomas Judge with Fox Land Surveys,Inc., are requesting a vacation of a common lot(Lot 8, Block 4), lot line, and easements located within The Shores Subdivision No. 1,Lots 8 and 9,Block 4. The two(2) lots combined consist of 36,324-square feet(0.83-acres)and are located on the north side of West Sherason Drive approximately 320-feet north of the intersection with West Watersford Drive at 736 West Sherason Drive. (WEV)[est. 30 min.] Mayor introduces the issue. Mayor: Does anyone on Council have any exparte contact to declare? Hearing none Mayor: Does anyone on Council have any potential or actual conflict of interest?Hearing none Thomas Judge, representing the applicants, provides Council an overview of the request for a vacation. Zoning Administrator Vaughan: Staff has recommended approval. The PZ recommended approval. Discussion on the request. Mayor opens the Public Hearing David Zanecki, 909 West Two Rivers Lane, my property is Lot 20 which is the northern boundary of this vacation. On Lot 19 there are housed four submergible pumps and it is my understanding that this easement was for access for a boom trunk. The easement is noted on the easement notes on this submittal and it is also noted in the Shores Subdivision CC&Rs. General discussion. Jody Zanecki, 909 W. Two Rivers Lane, discusses the easement in detail. General discussion. Thomas Judge, addresses the question of the easement for the boom truck to Lot 19. General discussion. Semanko: I would like to ask our attorney to assess this. I am a dues paying member of the Two Rivers Homeowners Association which it sounds like they have some interest in this. I don't want to recues myself if I don't have to so help me out here. General discussion. City Attorney: Under the Land Use Rules I don't see a direct conflict of interest that is contemplated by the Act. You would go to the ethical rules of potential pecuniary interest in the outcome of the Act. So it is a little attenuated here. If you want to be on the safe side you could recues yourself. Semanko: I am going to recues myself. I think the potential exists here that there is pecuniary interest on the Association, which I am reluctant to do. Semanko steps down. Continued general discussion. EXT-06-12—Preliminary Plat Extension of Time for Shaunessy Subdivision (PP-11-05) (formerly Park Place Gardens)—BHH Investments,LLC—Matt Shultz: BHH Investments, LLC,represented by Matt Shultz, is requesting a one-year extension of time for the preliminary plat approval for Shaunessy Subdivision(formerly Park Place Gardens), a 126-lot(112- buildable, 14-common)residential subdivision. The 95.32-acre subdivision is located between North Meridian Road and North Park Lane approximately 1,300-feet north of Floating Feather Road at 1680 North Park Lane. (WEV)[est. 10 min.] Mayor introduces the issue. Butler moves to EXT-06-12—Preliminary Plat Extension of Time for Shaunessy Subdivision (PP-11-05) as proposed by staff. Seconded by Semanko. EXT-07-12—Final Plat Extension of Time for Eaglefield Estates Subdivision No.3— The Preserve,LLC—Becky McKay: The Preserve, LLC, represented by Becky McKay, is requesting a one (1)year final plat extension of time for Eaglefield Estates Subdivision No. 3, a 23-lot(19-buildable, 4-common)residential subdivision. The entire Eaglefield Estates Subdivision is located on the north side of State Highway 44 approximately 650-feet west of Linder Road. (WEV)[est. 10 min] Mayor introduces the issue. Butler moves to approve with the conditions the Final Plat Extension of Time for Eaglefield Estates Subdivision No.3 EXT-07-12 with any conditions provided by staff. Seconded by Grasser. FPUD-01-12/FP-01-12—Final Development Plan and Final Plat for Snoqualmie Falls Subdivision No. 1 (Legacy)—Horseshoe Flats,LLC: Horseshoe Flats, LLC, represented by Justin Martin, is requesting a revision of the phasing plan for Mosca Seca Subdivision, a 386-lot residential subdivision(344-residential, 42-common). The applicant is also requesting final development plan and final plat approval for Snoqualmie Falls Subdivision No. 1 (a portion of the approved Mosca Seca Subdivision No. 3)a 21-lot(19-buildable,2 common)residential development. The 228.79 acre site is located south of Floating Feather Road and west of Linder Road. (WEV) Mayor introduces the issue. Justin Martin representing Horseshoe Flats provides Council an overview of the project and discusses the name changes. This is still marketed under Legacy. I will stand for any questions. Ordinance 674: An ordinance of the City of Eagle,Idaho, amending Title 1, Chapter 7, Section 1-7-1A: Depository for City funds of Eagle City Code, and providing an effective date. Ordinance 676: An ordinance of the City of Eagle,Idaho, amending Title 6, Chapter 4, Relating to Cable Television Franchises and providing an effective date. (SEB) Mayor introduces the issue. City Attorney Jill provides Council an overview of the Cable TV Franchise Legislature and the changes to City Code. General discussion. Semanko moves,pursuant to Idaho Code,Section 50-902,that the rule requiring Ordinances to be read on three different days with one reading to be in full be dispensed with,and that Ordinance#676 be considered as being read for the first time after being read once by title only. Semanko reads Ordinance#676 by title only. Seconded by Defayette. ALL AYES: MOTION CARRIES F. Ada County/Eagle Water Company proposed easement. (MJE) Mayor introduces the issue. Public Works Director Echeita displays overhead of the area and provides an overview of the proposed easement. This is in the Eagle Water Company service area. The easement is for Eagle Water Company to put in a booster pump. This is Ada County land that we have a lease on. The building of the pump house will be going through the City of Eagle processes. General discussion. Butler moves that we authorize either the Mayor or the Public Works Director to draft a letter to the County supporting an easement in the location as shown. Seconded by Grasser. ALL AYES: MOTION CARRIES G. Discuss potential letter of support for the Community Transformation Grant for College of Western Idaho. (JR) Mayor introduces the issue. Scott Fenwick, College of Western Idaho,Executive Director of Workforce Development, one of the big things that we are doing is applying for a Community Transformation Grant. Provides Council an overview of the details of the proposed Grant. The Grant is for$4 million. General discussion. Grasser: Mr.Mayor I move that we authorize you to work with CWI on writing a letter of support for the Community Transformation Grant for College of Western Idaho. Semanko discussion: I'm wondering if the maker of the motion would consider including language that the letter include reference to CWI's presence in Eagle and the fact that this grant would be utilized to expand the presence and classrooms. Grasser amends the motion to include what Councilman Semanko has mentioned. Seconded by Semanko. Discussion.
