RESOLUTION NO. 12-15
A RESOLUTION DECLARING A LOCAL DISASTER EMERGENCY;
AUTHORIZING THE CONTINUANCE OF THE LOCAL DISASTER
EMERGENCY DECLARATION AND ITS TERMS FOR A PERIOD OF THIRTY
(30) DAYS; AUTHORIZING THE IMMEDIATE EXPENDITURE OF PUBLIC
MONEY TO SAFEGUARD LIFE,HEALTH AND PROPERTY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS,precipitation and snow melt have caused the Boise River running through
the City of Eagle, Idaho to reach dangerous water levels threatening the life health and
property of Eagle and its citizens; and
WHEREAS, a local disaster emergency, as defined in Section 46-1002, Idaho Code, is in
existence in the City of Eagle due to the imminent threat to life and property; and
WHEREAS, pursuant to the authority granted the Mayor of the City of Eagle in Section
46-1011, Idaho Code,the Mayor of the City of Eagle, on May 8th , 2012 and ratified by
the City Council herein, declared a local disaster emergency and authorized the
furnishing of aid and assistance thereunder; and
WHEREAS, Section 46-1011, Idaho Code, requires the consent of the Eagle City
Council for such local disaster emergency declaration to continue for a period in excess
of seven(7) days; and
WHEREAS, it is deemed necessary by the Council of the City of Eagle to extend such
local disaster emergency declaration for a period of thirty (30) days to provide for the
ongoing threat to public life and property of flooding and river hazards; and
WHEREAS, Section 67-2808, Idaho Code, authorizes the Council of the City of Eagle to
declare an emergency authorizing the immediate expenditure of public money to
safeguard life, health or property; and
WHEREAS,the Council of the City of Eagle deems it necessary for the health and
safety of the citizens of the City of Eagle to continue the authorization for the immediate
expenditure of public money to safeguard life, health and property.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF EAGLE,IDAHO:
Section 1. That the Declaration of Local Disaster Emergency, issued by the Mayor of the
City of Eagle and ratified by the City Council herein on May 8th, 2012 and will be
recorded with the Ada County Recorder as and that such Declaration shall remain in
effect for a period of thirty (30) days from the date of this resolution; and
Section 2. That an emergency exists, pursuant to Idaho Code Section 67-2808(1), in that
the City must immediately declare an emergency and authorize emergency work; and

Section 3. That pursuant to Idaho Code Section 67-2808(1), the Mayor and City Council
authorize the immediate expenditure of public money to safeguard the life, health and
property of the City of Eagle; and
Section 4. That pursuant to Idaho Code Section 67-2808(1), the City may avoid the
bidding requirements for the expenditure of public funds in the event of an emergency;
and
Section 5. That a copy of this resolution shall be promptly filed with the Ada County
Recorder.
Section 6. That this Resolution shall be in full force and effect immediately upon its
adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 6 day of May, 2012.
