PRE-COUNCIL AGENDA: 5:30 p.m.-6:30 p.m.
1. Historic Preservation Commission Report:No Report.
2. Ada County Sheriff's Office Monthly Report: Chief Borgquist discusses restitution. Next
week we go live with automated report writing system. Your Prosecuting Attorney is also on
board with this and Susie is doing what she has to do at her office so she has access and can get
the reports that she needs. We are going to try and round up some officers to participate in the
Beautify Eagle Project this week-end. Everything with Eagle Fun Days is coming along nicely. I
will be here in a couple of weeks to discuss budget. I am going to ask for a Secretary and the
County will pick half of that cost,this will be around$25,000.00. General discussion.
Discussion on the expansion of area coverage with Spring Valley coming on board and the new
Fred Meyer on Linder. These are within our area. I will send you a power point presentation by
email to share with you things that are going on behind the scenes,this is just informational.
Discussion on ordinances that need to be revised,modified or created. I have one ready to go on
fireworks and I will email that to Susan and Susie. Discussion on how to proceed with revisions,
modifications and creation of ordinances. Chief will bring this before Council before proceeding
on ordinances. The Monthly Report is distributed and discussed. General discussion.
3. Mayor and Council Reports and Concerns:
Mayor: Reports on the MYAC,Mayor's Youth Advisory Committee, is getting ready to go to
the secondary schools to make a pitch to them to join so they can build up membership.
Reports on the Eagle Project and I will be sending my notes out.
Butler: Council asked that I work on an Ordinance amendment to the General Business
Licensing and I told you I would bring that back the end of April. I did rewrite the ordinance and
sent it to Susan. Susan had some good input. I sat down with the Mayor, Sharon,Bill and Tracy
and discussed this. I think that we should wait until we go through the Budget process before we
make a decision on this. General discussion.
Bill and I spent 4 hours going to businesses informing them about the signs. Our next step is to
take pictures of the sandwich board signs and bring these to you. General discussion on signs.
Defayette: The Bike Park is in desperate need of a couple of things. My biggest concerns are the
two crossing in the park that is not safe and not signed. Discussion on the bike paths in the park,
signage and the work that has been completed.
Mike: We have been working on the sprinkler system at the sports complex the last two days and
we are starting to spray the weeds. We will be up there the rest of the week and the next week.
Discussion on the controller. Summer Lawns will be working up there on the sprinkler system,
spraying weeds, fertilizing and etc. Discussion on removal of the old Velodrome signs.
Defayette: We need to discuss as a group the code for the bike and whether or not we are going
to allow dogs. Discussion on the use of the concession stand. Also we need to put on the agenda
a full signage plan for the park. Discussion on the Triathlon Training Center.

5. Zoning Administrator's Report: I have talked with Diane Bevins with ACHD today and their
Director has asked them to change the way they put signage up on new projects. Discussion on
the signage. What they would like to go with is"ACHD in Partnership with the City of Eagle
brings you xyz project starting here and ending here"and they would like to have their logo and
the City's logo. This is a good idea if the City is in support of the project. ACHD is aware that
this signage would not be appropriate if the City is not in support of a certain project. Would
the City be supportive of this change in signage? Council concurs.
6. Public Works Director Report Echeita: We are getting the parks ready for the summer and
evaluating the winter damage. Reports on the new glass recycling. We were expecting to pick
up every other week and we can hardly make it through a week. This is very successful and we
may have to bump up to a 4 yard container. General discussion.
Discussion on when the parking lots will be done. The parking lots should be finished by the end
of May.
7. City Attorney Report: I have been on the ITD Access Management Task Force. There is a
new rule coming out that will address the access on State Highways. The new changes go back
to some old policy. It does appear that the type of changes that we are seeing will eliminate some
of the concerns we have had getting access for St. Als. This might take care of some of our
issues. General discussion on the rules and the changes.

REGULAR COUNCIL AGENDA: 6:30 p.m.
1. CALL TO ORDER: Mayor Reynolds calls the meeting to order at 5:30 p.m.
2. ROLL CALL: SEMANKO, GRASSER,DEFAYETTE, BUTLER. All present. A quorum
is present.
3. PLEDGE OF ALLEGIANCE: Mayor Reynolds leads the Pledge of Allegiance.
4. PUBLIC COMMENT: Foad Rogaine,I couldn't make it to the last meeting and I
appreciate all of the time you took to go through the CID material, especially Mr. Grasser. When
the agreement is signed is it a public document? When I read in the Valley Times last week that
Mr. Grasser was excluded from the CID,I think that is a big mistake as he had the most
knowledge of that document. General discussion.
5. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Mayor, a
Councilmember, member of City Staff, or a citizen requests an item to be removed
from the Consent Agenda for discussion. Items removed from the Consent Agenda
will be placed on the Regular Agenda in a sequence determined by the City Council.
♦ Any item on the Consent Agenda which contains written Conditions of Approval
from the City of Eagle City Staff, Planning & Zoning Commission, or Design
Review Board shall be adopted as part of the City Council's Consent Agenda
approval motion unless specifically stated otherwise.

Preliminary and Final Plat for Deltoid Subdivision No. 2 - Dave Evans
Construction: Dave Evans Construction, represented by Tim Mokwa with

Parametrix, is requesting combined preliminary plat and final plat approvals for
Deltoid Subdivision No. 2 (a re-subdivision of Lot 8, Block 1 of Castlebury
Business Park No. 2). The 0.62-acre subdivision will consist of two (2)
commercial lots. The site is generally located south of West Bavaria Street
approximately 620-feet west of the intersection of West Bavaria Street and North
Meridian Road at 3405 West Bavaria Street. (WEV)
C. DR-02-12 Exterior Remodel to McDonalds Restaurant with Drive Thru
McDonalds USA, LLC: McDonalds USA, LLC, represented by Randy Gayler
with Baumgart Construction, Inc., is requesting design review approval to
remodel the exterior building elevations of the McDonalds restaurant with drive
thru. The 0.95-acre site is located on the northeast corner of South Eagle Road
and East Plaza Drive at 178 South Eagle Road. (WEV)
D. DR-08-12 -Restaurant with Drive Thru for McDonald's-McDonalds USA,
LLC.: McDonald's USA,LLC, represented by Stillman Norton with Keller
Associates,Inc., is requesting design review approval to construct a 3,590-square
foot restaurant with drive thru. The 1.02-acer site is located within the Eagle
Island Marketplace at the northeast corner of Chinden Boulevard and Linder
Road. (WEV)

7. UNFINISHED BUSINESS:
A. Discussion about greenbelt access. (NS) This item was continued from the April 10, 2012
meeting.
Mayor Reynolds introduces the issue.
Semanko: I asked for this to be continued. Just to recap we as a Council took a position on
greenbelt access in and through Garden City from Eagle for people who ride their bikes last year.
We sent a letter to the City of Garden City for a meeting where we could talk about our mutual
interests and concerns. The response we got back was they were not too interested in that. We
have had a change in elected leaders and we haven't discussed this and there has been some
development in the litigation which the City is not a party to. The case that the Citizens Group
brought was dismissed and they are pursuing other options. Discusses the bike path from Eagle
through Garden City on the Green Belt and a connecting bridge. General discussion.
Semanko moves to send a letter reiterating a position similar last year's position with
regard to open access,having a meeting and proposing a tour. Seconded by Defayette.
Discussion. Semanko amends his motion to state "to prepare a letter for review at the next
City Council meeting similar to the last letter that was sent." Second concurs. ALL AYES:

8. PUBLIC HEARINGS:
A. A-02-11/RZ-03-1-Annexation and Rezone From RUT(Rural—Urban Transition—Ada
County designation) to BP-DA(Business Park with a Development Agreement) and R-1-
DA(Residential up to one(1) unit per acre with a development agreement) -Kenneth and
Lynn Patten: Kenneth and Lynn Patten, represented by Becky McKay with Engineering

Solutions, LLP, are requesting approval of an annexation and rezone from RUT(Rural-Urban
Transition-Ada County Designation)to BP-DA(Business Park with a development agreement)
and R-1-DA(Residential up to one(1)unit per acre with a development agreement). The 10-acre
site is located on the west side of North Horseshoe Bend Road approximately 700-feet south of
the intersection of North Horseshoe Bend Road and East Hill Road at 8811 North Horseshoe
Bend Road. (WEV)

Discussion on waiver of fees.
Butler moves to approve A-02-11/RZ-03-1-Annexation and Rezone From RUT(Rural-
Urban Transition-Ada County designation)to BP-DA(Business Park with a Development
Agreement) and R-1-DA(Residential up to one(1) unit per acre with a development
agreement) and PD-03-11 -Parcel Division with the conditions recommended by the
Planning and Zoning Commission for the Development Agreement remaining as proposed
and the conditions as recommended by the Planning and Zoning Commission on the parcel
division be amended as follows: Condition#2. Comply with any requirements of the City
Engineer except as addressed within the April 16th letter from the Applicant's
representative; #3.Pay the Engineering fees remains; #6. Which requires an irrigation and
drainage plan be deleted and replaced with the application fee for the annexation shall be
refunded to the applicant; and#8. Be deleted. Seconded by Defayette. Discussion. Butler
amends his motion to leave#6 deleted and add to the motion that the application fee paid
by the applicant in the amount of$500.00 for annexation be refunded. Seconded by
Defayette. Discussion. Semanko: AYE: Grasser: AYE; Defayette: AYE; Butler:

9. NEW BUSINESS:
A. Discussion of recognitions for years of committee service and current committee
vacancies. (MD)
Mayor Reynolds introduces the issue.
Defayette: I have had a nice chat with Tracy in the Clerk's Office about recognition for public
Service. There are so many people that volunteer. In the past there were plaques given out.
People like to be recognized for the work that they do. Even if it is a letter or certificate since we

have budget restraints. General discussion. Council concurs to do a certificate and a letter at the
end of terms or on retirement.
Discussion on committee vacancies. Council concurs to continue with the policy of doing a
press release and putting openings on the web page. The opening in the Art Commission should
be advertised together with any other vacancies at this time.
10. BUDGET DISCUSSION:
Mayor Reynolds introduces the issue.
City Clerk/Treasurer Bergmann: I am working on revenue projections for the budget and I need
to know what Council would like to do with the Idaho Power Fund. Idaho Power has sent a letter
to the City that the City can transfer this fund to the City's General Fund. Does the Council want
to transfer this money from the Idaho Power Fund to the General Fund for FY 12/13? Council
concurs to add to the revenue budget discussion.
a) BLM Update and financial commitments. Planner Baird-Spencer provides Council an
overview. General discussion.
b) YMCA-Blue Ribbon Task Force—Eagle Sports Complex.
Council Member Defayette provides an update with discussions with the YMCA. This is very
early in the process. There won't be any needs for the Budget next fiscal year.
c) Legacy Park Property
Public Works Director Echeita provides Council an overview of the legacy park property.
Legacy wants to renegotiate the Development Agreement. There will not be an impact to the FY
12/13 budget.
d) Lakemoor Beagle Park
Public Works Director Echeita provides Council an overview of the Lakemoor Park. When
Lakemoor does a plat the City will have 5 years to start development after they put the road in.
This is 27 acres. I don't see any impact to the FY 12/13 budget. General discussion.
e) West Valley Ball Parks—Eagle Sports Complex
f) Fire Department Grant for Eagle Sports Complex
Public Works Director Echeita: The West Valley Ball Park,Eagle Sports Complex,Fire
Department Grant for Eagle Sports Complex is all tied together. The City and the Fire
Department applied for a Mitigation Grant through FEMA for$650,000.00. This grant would be
used for green grass as a mitigation program to protect homes adjacent to the Park. We missed
the first round and we are in for the second round. If we got the funding of$650,000 then the
West Valley would come in and build ball parks. This is just a concept and the decision
wouldn't be made until we get the grant. General discussion.
g) New Ada County Lease—Eagle Sports Complex—BAMBA
City Attorney Buxton: the Lease is with Ada County and I don't know if the Ada County
Commissioners have signed yet. I will check on that. Update on the discussion with BAMBA on
the contract/agreement. See tape. General discussion.
h) Hill Road Extension
Zoning Administrator Vaughan: We have a Cost Share Agreement with ACHD for Hill Road
when it gets extended in 2016. The road is currently expanded from a 69' right-of-way to a 72'

right-of-way to accommodate separated sidewalks and landscape medians within the roadway.
The additional costs associated with that we have agreed to pay for the right-of-way and the
landscaping and everything. Are you still committed to providing those improvements within
Hill Road or is that something you would want to discuss and say are there other more cost
effective measures for designing that roadway which would be appropriate but not as expensive.
General discussion. Zoning Administrator Vaughan will discuss redesign changes with ACHD.
i) 2°d Phase for facilities maintenance
Public Works Director Echeita: We are evaluating all of the properties in the City. Last year I
had a 2-3 year plan and I am sticking with that. We are going to have an issue with the HVAC at
the Library. General discussion.
11. EXECUTIVE SESSION:
A. Pending or Threatened litigation: I.C. )$67-2345(f)—M3 Water Rights Litigation
Idaho Code § 67-2345. Executive sessions -- When authorized. (1) An executive
session at which members of the public are excluded may be held, but only for the
purposes and only in the manner set forth in this section. The motion to go into
executive session shall identify the specific subsections of this section that authorize
the executive session. There shall be a roll call vote on the motion and the vote shall
be recorded in the minutes. An executive session shall be authorized by a two-thirds
(2/3)vote of the governing body.An executive session may be held:
(f) To communicate with legal counsel for the public agency to discuss the
legal ramifications of and legal options for pending litigation, or
controversies not yet being litigated but imminently likely to be litigated.
The mere presence of legal counsel at an executive session does not satisfy
this requirement.
