Minutes - 2012 - City Council - 03/27/2012 - Regular EAGLE CITY COUNCIL Minutes March 27,2012 PRE-COUNCIL AGENDA: 5:30 p.m.-6:30 p.m. 1. Ada County Sheriff's Office Monthly Report: Chief Borgquist provides Council an overview of the classes and training that he received while he attended the FBI National Academy. Presents the Monthly report and discusses the same. General discussion. 2. Historic Preservation Commission Report: Frank Thomason, Chairman of the Historic Preservation Commission,we are a very active Commission. I'm very proud to report that the City's Historic Preservation Commission is very active. We have received a grant from the Idaho State Historic Society to showcase our most historic property. We have sent letters to 6 property owners and we have received the last approval from those property owners. The six properties are DaVinci's, Eagle Hotel,Fischer House, Ruby Lou, Orville Jacksons, Sharp/Jackson residence. We also have our Municipal Registry which is unique to Eagle. The Commission has adopted their first By-Laws. Provides an overview of their Quarterly Speakers Programs. General discussion. 3. Susan Lynn Mimura&Associates,PLLC: Susan Mimura will provide a report regarding Prosecuting Attorney Services for 2012. Susan Mimura distributes the annual report and discusses the same. General discussion 4. Mayor and Council Reports and Concerns: Butler: Discusses the format of the Agenda. General discussion. Mayor: Reports on the Idaho Cutting Horse event at the Idaho Center this last week-end. There is another one in the fall which is much larger. We shared a booth with the Chamber of Commerce. Tom Shaffer came in and spoke to me and he is with a program called Score(Service Core of Retired Executives). They work with budding business or existing businesses and they work under the Small Business Administration. He is looking for a place to meet on an Ad Hoc basis and would like to use one of our small rooms on occasion and wants to know if we could waive the fees. General discussion. Council concurs to have the Mayor waive the room reservation fees. 5. City Clerk/Treasurer Report:No Report 6. Zoning Administrator's Report: No Report 7. Public Works Director Report: I sent you pictures of the spray paint in the bathrooms at Guerber Park. We are getting those cleaned up. General discussion. 8. PUBLIC COMMENT: Susan Christenson, MYAC director, and Noah Ham,member, provide Council an overview of the projects this year. April 71h we are doing a fitness marathon with the Boise YMCA. The kids are out getting sponsorships. Proceeds will be split with YMCA. I am asking that when you are in the community I would ask you to promote the MYAC. You have posted in your break room a challenge to all of you for a challenge for you join in or sponsor me. Susan hands out sponsorship forms to the Council. Ringo Ridge Estates Common Area Improvement Agreement Modification (Second Amendment): Robert Norton,a resident within Ringo Ridge Estates Subdivision and owner of Lot 1 Block 6 (common lot)within Ringo Ridge Estates Subdivision No. 2, is requesting City Council approval of a second modification to the agreement to release the remaining subdivision surety to be used for the purchase and installation of a pressurized irrigation system and acquisition of necessary water rights and easements to be used for the irrigation of the Ringo Ridge Estates Subdivision No. 2 common area. The site is located near the northwest corner of State Highway 55 and Hill Road. Appointment to the Parks and Pathways Development Commission: Mayor Reynolds is requesting the appointment of Charlie Baun to the Commission to fill a vacated term. Mr. Baun's term will expire in 2014. (JM) Defayette: I would like to talk about this appointment, I have heard great things about this appointee and he would add a lot to the Commission. My concern is that this a new opening on the Parks and Pathway and was not advertised. I would like to find out if we can add another member to the Parks and Pathways Commission. My motives are to have more cohesiveness and collaboration between the Parks Commission and the BAMBA group. I have one person in mind that shown an interest in being involved. Is it possible to add another person to that committee? City Attorney: We would need to amend the Resolution to the number of members and I could have that to you at the next meeting. Spring Valley Idaho (formerly known as M3 Eagle),represented by Gerry Robbins, filed a petition with the City of Eagle requesting the formation of a Community Infrastructure District(CID): On July 11,2011,the applicant, Spring Valley Idaho (formerly known as M3 Eagle), represented by Gerry Robbins, filed a petition with the City of Eagle requesting the formation of a Community Infrastructure District. The 5,600 acre site is located within the incorporated City limits of the City of Eagle generally north of Homer Road between State Highway 16 and Willow Creek Road. The petition was made pursuant to Idaho Code Chapter 50, Section 31. The City Council will consider the formation of the district,the suitability of the district plan and the membership of the District Board. B 1. Resolution 11-28: Resolution Of The Mayor And Council Of The City Of Eagle, Idaho To Form A Community Infrastructure District,Authorize The Levy Of Taxes,Appoint The District Board And Provide An Effective Date. When do the actually amenities go in, are they going to be built first? Are they exempt from City Code? As far as I know the City won't be responsible for anything. Are there horse trails and can anyone use those trails? General discussion. Bill Brownley addresses the questions proposed. The amenities are sized to the phase that is going to be built. You have to have enough amenities to be attractive so typically you build amenities in the firs phase. Harris Ranch,which is a CID, is the fastest growing subdivision in the Treasurer Valley. We have to have a disclosure agreement for the fees. General discussion. Copper Point Drive Suite 106 Meridian, Idaho 83642 208.286.3140 Introduction In our Annual report, SUSAN LYNN MIMURA & ASSOCIATES, PLLC. is pleased to present a brief but comprehensive review of the prosecutorial services provided to the City of Eagle, Idaho, for both misdemeanors and infractions that occur within Eagle's municipal limits. Susan Lynn Mimura is the sole owner and managing member of the Firm, whose 29+ years of legal and administrative experience, has made the transition of the service provider both smooth and efficient. Tahja L. Jensen, a full-time Associate Attorney, is a University of Idaho College of Law graduate. Although she is a recent Idaho State Bar admittee, she worked for the Twin Falls County Prosecutor's office as an intern where she completed a semester of practice. Ms. Jensen also has had years of experience as an investigator for the Idaho Human Rights Commission. Tahja has worked closely with Susan, in and out of the courtroom to assure that the Eagle cases are handled in a professional, ethical and consistently fair manner. Michelle Luna is the part-time legal secretary dedicated to the Eagle prosecution cases and provides all the staff support necessary to assure that the cases are processed in an efficient manner. She is bi-lingual (Spanish) and has worked closely with the Sheriff's records division and the Eagle officers in obtaining needed reports, audio and video recordings and officer notes. She prepares all subpoenas and summons which we have served by an independent contractor. Ky Papke was assigned as a University of Idaho, College of Law, extern and has been retained as a part-time employee while he finishes his Juris Doctorate this semester. He has assisted us by preparing court memos, discovery responses, and performing legal research. His limited license granted by the Idaho Supreme Court allows him to attend and participate in court hearings under the supervision and mentorship program. Rhe orting We have provided the City of Eagle with monthly invoices describing the dates and time spent on Eagle City cases. Our Firm is committed to providing superior service to the City of Eagle in the performance on our contract. Although we do not have a private investigator on staff or a Victim's Witness Coordinator, we feel our service level is better than that of the larger county office. We deal directly with witnesses and victims, lending them both support and advising them of the criminal justice process and of their rights afforded under both the Idaho Constitution and the Victim Rights Act. Our commitment has resulted in greater witness satisfaction and substantial savings to your citizenry. Additionally, the City has benefitted from the increased revenues this year generated by the fines and costs distribution pursuant to Idaho Code § 19-4705. Despite reported lower crime rates and a faltering economy, Eagle has realized an increase of fine and cost revenues. FY 2011 revenues were 28.9% higher than FY 2010. We are here to provide as much information as you require and if you have any concerns or additional information you wish to obtain, please feel free to call me. The Kev: Data and Access! Last year, the Court Administration reported that Eagle had 1786 misdemeanor and infraction cases that were filed in calendar year 2009, of which 387 of those cases were dismissed. The total fines and costs revenues collected and received by Eagle City in FY 2010 were 28% lower (-$22,902.34) than the previous fiscal year. This may be explained by the drop in crime reported by local and national law enforcement agencies. FBI statistics which were reported today showed that in 2010, Boise had a drop in violent crimes of nearly 10% from the year before. Property crimes in the region also dropped about 3.5% according to the FBI. Only forcible rape (88 reported v. 74 in 2009) and larceny -theft showed a slight increase (4,627 v. 4,623 in 2009). Ada County Sheriff has provided the Firm with law enforcement data as follows: A report of Eagle Crimes by Statute from October 2009 -April 2011. (RMS) A report of Eagle Citations by Statute from October 2009 -April 2011. (ISTARS) 2011. Copies of these reports were provided in our Q2 report. Our Firm opened 703 cases in FY 2011: from October 1, 2010 through September 30, Ada County Prosecutor reported in FY 2009: Eagle had a total of 659 cases. Ada County Prosecutor reported in FY 2008: Eagle had a total of 481 cases. Our Firm had 172 active cases as of May 23, 2011 (Q2) and currently has 180 open cases (EOY). While we cannot identify the average number of days to close a file because the opening dates are skewed as the open files transferred from Ada County last October 2010, totaled 91 and all reflect October 1st as the open date in our database. Additionally, we received last month a box of warrants from the Ada County Prosecutor's office which we do not count as "opened." In FY 2011, we have sent and received approximately 415 email contacts from Eagle City officers and numerous phone calls requesting assistance or seeking advice about charging or routing reports. We have worked with your Clerk, Planning and Zoning, and witnesses as part of our legal services contract. We were granted limited access to the Ada County database last fiscal year; however, our access does not provide us with any more information than what we can obtain through public portals. Our contract included an additional $600 for computer access, but until we receive NCIC access through the Idaho State Police, we will not be using the County VPN. Instead, we are paying Eagle costs for subpoena service, telephone records charges on criminal cases and certified judgments. Collaborative Efforts During our first FY under contract, the Ada County Sheriff appointed a new Eagle City Police Chief, Dana Borgquist. Chief Borgquist has been extremely responsive and has invited the Eagle prosecutors to attend the monthly Eagle Unit meetings where matters of mutual concern between the Eagle Officers, Prosecutors, Detectives, Probation and Parole and School Resource Officers are discussed. Information about pending and closed matters are shared to insure open communication and we use this opportunity to provide information/education of changes in the criminal rules, protocols, courtroom assignments and to work together to make improvements to prosecutorial procedures. We have met with the City Attorney and various officers regarding ordinances that would be of value to law enforcement efforts. We hope to jointly present those in the near future. Arrest Reports Thanks to Sheriff Raney, Chief Borgquist, and Kelsey Proctor, our office now receives daily reports to save us time each day in searching all the arrest reports for Eagle misdemeanors. This process improvement eliminates the time spent each day looking at the arrest logs to manually filter the cases by jurisdiction. We've linked the reports to our phones to review the reports before we arrive at work each morning. Summary Our Firm has enjoyed serving the citizens of Eagle.
