JOINT POWERS AGREEMENT FOR STREET NAMING AND ADDRESS
NUMBERING AND APPLICATION TRANSMITTAL REVIEW FROM THE CITY OF
EAGLE TO ADA COUNTY ASSESSOR'S OFFICE
THIS AGREEMENT is made and entered into this 51 \day of J C) I Li
2011, by and between ADA COUNTY, a political subdivision of the State of Idaho (hereinafter
"COUNTY"), and CITY OF EAGLE (hereinafter"EAGLE"), a governmental entity of the State
of Idaho.
WHEREAS, each of the parties hereto is a "public agency" as defined by Idaho Code
§67-2327, and is therefore authorized to enter into this Joint Powers Agreement under Idaho
Code § 67-2328; and
WHEREAS, the parties hereto have an interest in implementing a uniform street naming
and address numbering system;and
WHEREAS, the parties hereto desire to uniformly administer street naming and address
numbering throughout unincorporated Ada County and also incorporated Eagle within Ada
County; and
WHEREAS, COUNTY has the authority to approve street names and assign address
numbers within unincorporated Ada County, in accordance with state law and pursuant to Ada
County Code Title 2,Chapter 1; and
WHEREAS, EAGLE, under state law, has the authority to approve street names and
assign address numbers within incorporated Eagle within Ada County; and

WHEREAS, EAGLE seeks assistance in implementing its street naming and address
numbering duties, and in reviewing applications for street naming and address numbering within
the entire jurisdiction of EAGLE; and
WHEREAS, the COUNTY has the expertise and personnel to carry out said street
naming and address numbering duties and in reviewing applications, and the COUNTY is willing
to provide the requested services;
NOW THEREFORE, COUNTY and EAGLE do hereby mutually agree to the following
terms and conditions:
I.
DUTIES OF THE COUNTY
A. STREET AND PRIVATE ROAD NAMING AND ADDRESS NUMBERING.
COUNTY will perform all street and private road naming and address numbering functions, and
shall review all applications regarding street names and address numbering throughout the entire
jurisdiction of EAGLE. COUNTY shall be the sole entity to approve street and private road names
and to assign address numbers, and to review all such applications in EAGLE'S jurisdiction.
COUNTY shall have the authority to grant or deny applications for street and/or private road
naming and address numbering reviewed by COUNTY pursuant to this Agreement.
H.
DUTIES OF EAGLE
A. NON-INTERFERENCE WITH DISCHARGE OF COUNTY'S DUTIES.
EAGLE agrees to allow COUNTY to freely approve applications for street and/or private road

name applications and assign address numbers throughout EAGLE'S jurisdiction without
interference from EAGLE.
B. COOPERA'I'ION BY EAGLE. EAGLE agrees to fully cooperate and assist
COUNTY throughout the application and approval processes, to the extent requested by
COUNTY.
III.
GENERAL PROVISIONS
A. DURATION OF AGREEMENT, This Agreement shall become effective October
1,2010, and shall remain in full force and effect until September 30, 2011. This Agreement may
be renewed for five(5)additional one (1)( )year terms upon mutual written consent of the parties.
B. TERMINATION. This Agreement may be terminated by either party hereto upon
sixty (60) days written notice, or immediately by mutual agreement in writing by both parties
hereto,
C. PURPOSE. The purpose of this Agreement is to provide for a uniform
administration of street and private road naming and address numbering throughout
unincorporated Ada County and incorporated Eagle,
D. ADMINISTRATION. Administration of this Agreement shall be the
responsibility of the Ada County Assessor and EAGLE. This Agreement shall not be construed
as to create a new district or other separate legal entity.
E. FINANCIAL CONSIDERATION. This Agreement shall not create any fiscal
liabilities and/or commitments other than those specifically enumerated within this Agreement.
F. INDEMNIFICATION, COUNTY agrees to indemnify, save and hold harmless
EAGLE, its officials and employees, from any and all claims, damages, fees, costs, or expenses

arising out of, or caused by, the negligence or willful conduct of COUNTY employees or
officials.
EAGLE agrees to indemnify, save and hold harmless COUNTY, its officials and
employees, from any and all claims, damages, fees, costs, or expenses arising out of, or caused
by, the negligence or willful conduct of EAGLE employees or officials.
The indemnification section of this Agreement shall survive the termination of this
Agreement for events occurring during its existence. This Agreement shall not relieve any public
agency of any obligation or responsibility imposed on it by law except that to the extent of actual
and timely performance thereof by a joint board or other legal or administrative entity created by
an agreement made hereunder, said performances may be offered in satisfaction of the obligation
or responsibility.
G. SEVERABILITY. In the event that any provision or section of this Agreement
conflicts with applicable law, or is otherwise held to be unenforceable, the remaining provisions
shall nevertheless be enforceable and shall be carried into effect.
H. MODIFICATIONS. This Agreement may be modified or amended only by a
writing duly executed by both parties.
IN WITNESS WHEREOF, the parties have hereunto executed this Agreement on the date
first written above.
