Zoning Administrator Vaughan: I placed on the dais a Memo along with staff level final review

Change of Use DR-51-01 MOD. We were trying to get this on the July 21st Agenda and the
applicant is requesting a sooner approval. The Applicant is here tonight is you are inclined to
add this to the Agenda.

commercial subdivision(a re-subdivision of Lot 6, Block 1, of Castlebury Business Park No. 2).
The 0.74-acre site is generally located south of West Bavaria Street approximately 460-feet west

Amending Eagle City Code Title 8 "Zoning", Chapter 4 "Off Street Parking And Loading",
Section 5, "Parking Requirements"; Providing A Severability Clause; And Providing An
Effective Date. (WEV)
The proposed ordinance amendment changes the off-street parking requirement for Retail uses in
the Downtown Development Area(DDA)and the Transitional Development Area(TDA).

Linda Crouch, 347 S. Edgewood Lane, I am the owner of Fusion Glass Studio, I have been
involved with the Eagle Merchants Association and I wanted to say that we support the Zoning
Ordinance Amendment being proposed. As an Association we did borrow money for an attorney
and we would like to have consideration of having a refund of this $1,300.00. We are not a for
profit group and our fees are very low.
Don Knickrehm, 1403 Mace Road, I am here to testify in favor of passing this proposed
Ordinances. I have been very involved in downtown development especially in Boise and I was
on the Board of the Downtown Boise Association when it was first founded. Discusses boutique
retail.
Rening Ryley, 1676 N. Clarion Way,I am in support:of this. One reason is the development
downtown on the existing building can have some real constraints on working parking. This
would be a benefit to developing the older buildings in the City.
Linda Butler, I own a business downtown at 222 E. State Street and I am also on the Eagle
Merchants Association. I have been a retail store for 8 years and I have watched parking. I have
never had any customers talk about not having a parking place. People park in a central location
and walk around downtown to shop. So having every business have a certain amount of parking
spaces is not needed.
Mathew Murray, 930 E. Snow Court, and I am the second full time pharmacist for Custoinedica,
I do support this ordinance.

Norm My wife works in boutique retail in Eagle, Mimi Maries. They would not be affect by this.
We do not have any ownership interest in the Boutique. I don't believe 1 have any pecuniary
interest or any of my family members in the outcome of the matter. I just want to make sure that
I am clear under the conflict of interest statue. I have contributed financially to the Eagle
Merchants Association in producing their First Friday brochure and I don't think that has any
bearing on this outcome.
City Attorney Buxton questions Council Semanko. I don't believe that you will be required to
recues yourself and I don't believe a conflict exists.

Roy Coneen: I am under time constraints with this, I have the alarm company tomorrow morning
to install an alarm and they require a two year contract. I have a lot of money invested in this
today. I also have internet coming in tomorrow. I can cancel these if need be. I also have a safe
coming tomorrow and I don't want to pay for it if I don't have a space.
Roy discusses the nature of his business of buying and selling coins/gold and silver.

Shoushtarian: Reports on the Senior Citizens Center meeting today. There are trees blocking the
stop signs at Idaho and Eagle Road. Could staff relay this problem to ACHD. General
discussion.
Discussion stripping the parking lot at the Senior Citizens Center and other parking lots within
the City.
Discussion on the City Clerk helping the Senior Citizens Center prepare a budget.
Semanko reports on the Sewer District meeting.
Semanko reports on the Library Board meeting. The report is in your mailboxes. Discussion on
the Friends book sale.
Reports on the ACHD Cost Share meeting,Nichole also attended.
I appreciate Compass and the staff getting the information out on the Compass Transportation
Budget.
b. City Clerk/Treasurer Report: I just want to let you know that RFP on Policing Services was
published on July 11th. Have you decided about having a meeting on July 28th. Council concurs
not to have a meeting on the 28th of July.

d. Public Works Director Report: Discussion on the graffiti that has hit the City.
e. City Attorney Report: Discussion on the City of Mountain Home has been hit with a lawsuit
under the Religious Freedom Act.

A. PROJECT SUMMARY:
Roy Coneen is requesting design review approval to convert an 1,104 -square foot office building into a
retail building. The 0.41 -acre site is located on the west side of South Eagle Road approximately 730 -feet
north of State Highway 44 at 209 South Eagle Road.
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on June 24, 2011.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On March 6, 2001, the Eagle City Council approved a rezone application to rezone the site from R-4
(residential) to CBD -DA (central business district with development agreement) for this site (RZ-16-00).
On November 13, 2001, the Eagle City Council approved a design review application to convert a
residential home into an office (DR -51-01).
On November 13, 2001, the Eagle City Council approved a design review sign application to construct a
monument sign (DR -52-01).
STAFF ANALYSIS:
A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL: (None)
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL:
• Eagle City Code Section 8-2A-1: GENERAL APPLICABILITY:
This article applies to all proposed development located within the design review overlay district
which shall include the entire city limits, and any land annexed into the city after the date of adoption
hereof. Such development includes, but is not limited to, new commercial, industrial, institutional,
office, multi -family residential projects, signs, common areas, subdivision signage, proposed
conversions, proposed changes in land use and/or building use, exterior remodeling or repainting with
a color different than what is existing, exterior restoration, and enlargement or expansion of existing

buildings, signs or sites, and requires the submittal of a design review application pursuant to this
article and fee as prescribed from time to time by the city council.
• Eagle City Code Section 8-2A-6(D)(3)(b)
Side building setbacks may be zero feet (0') so as to tie into adjoining structures or ten feet (10')
maximum where ties to adjoining structures are not desirable.
• Eagle City Code Section 8-2A-6(D)(3)(f)
Lot coverage by the footprint of the structure shall be a minimum of twenty percent (20%) and a
maximum of eighty five percent (85%) in which case off site parking shall be provided for. The
minimum lot coverage requirement may be reduced by the council for the purpose of providing
adequate on site parking in accordance with provisions of this title for structures that include
residential uses on floors other than the ground floor.
• Eagle City Code Section 8-4-5 SCHEDULE OF PARKING REQUIREMENTS:
Offices, business and professional 1 per 250 square feet of gross floor area
Retail sales not listed under another use 1 per 250 square feet of gross floor area

C. DISCUSSION:
• On November 13, 2001, the Eagle City Council approved a design review application to convert a
residential dwelling into an office on this site. The Council recognized that the building did not meet the
twenty percent (20%) minimum lot coverage or the ten foot (10') maximum side setback to the north.
The Council approved the twelve percent (12%) lot coverage based on the site complying with the twenty
percent (20%) minimum lot coverage when a future phase of this project is completed. A design review
application is required to be reviewed and approved by the City prior to any new buildings or building
additions being constructed on this site.
The City Council determined the application (DR -51-01) and on similar applications, that the required
setbacks were to apply to new structures and additions, and that it was not the intent of the City to require
existing structures to be rebuilt to meet the setback requirements. In addition, the fifty feet (50') that is
located between the building and the north property line was approved based on a future east/west
connection being provided from the future north/south cross access, located in the western portion of the
site, to Eagle Road (see Exhibit A attached hereto). Cross access agreements have been completed for
this property and the properties to the north and south of this site granting access across all three of the
parcels once the north/south driveway is constructed. Providing an east/west driveway connection
through this site would allow the properties to the north and south of this site to remove their substandard
sized driveways and to utilize the north/south cross access driveway located on the western portion of this
site to gain access to Eagle Road through this site or the driveway located further south in alignment with
Plaza Drive. The elimination of multiple access points to Eagle Road has the potential to reduce the
number of vehicular conflicts on Eagle Road.
• The applicant is proposing to change the use of the building from office to retail. Pursuant to Eagle City
Code, retail sales not listed under another use classification requires one parking space for every 250 -
square feet of gross floor area. The 1,104 -square foot building and 496 -square foot shed required a total
of 5 -parking spaces. This is the same number of parking spaces that was required when the building was
converted into an office. The site plan date stamped by the City on July 10, 2001, shows the 5 -parking
spaces provided on this site. The applicant should be required to restripe the parking lot to delineate the
5 -parking space required on this site prior to the issuance of a zoning certificate.

SITE SPECIFIC CONDITIONS OF APPROVAL:
1. Restripe the parking lot to delineate the 5 -parking space required on this site prior to the issuance of a
zoning certificate.
2. A design review application is required to be reviewed and approved by the City prior to any new
buildings or building additions being constructed on this site.
3. No signs are proposed with this application and none are approved.
STANDARD CONDITIONS OF APPROVAL:
1. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the City
Council.
2. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect
to take those plans to the Design Review Board and/or City Council for review and approval.
3. Any changes to the plans and specifications upon which this approval is based, other than those required
by the above conditions, will require submittal of an application for modification and approval of that
application prior to commencing any change.
4. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and
legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of
its intent to change the planned use of the subject property unless a waiver/variance of said requirements
or other legal relief is granted pursuant to the law in effect at the time the change in use is sought.
5. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed
by the applicant or the applicant's authorized representative and an authorized representative of the City
of Eagle. The burden shall be upon the applicant to obtain written confirmation of any change from the
City of Eagle.
6. Approval of any Design Review shall expire without notice to the applicant on the date of expiration of
the Design Review, as stipulated in Eagle City Code (one year from the approval date).
7. Any modification of the approved design review plans must be approved prior to construction/installation
of such changes. Failure to do so may result in the requirement to modify the project to comply with the
approved design review and/or result in the inability to issue a certificate of completion for this project.

Landscape and Streetscape Plan shall be prepared by a person knowledgeable in the
field and shall include the following:

b. Type and location of all plant materials and other ground covers. Plant lists to
include botanical and common name, quantity, spacing and sizes of all
proposed landscape materials at the time of planting, and at maturity.

Building elevation drawings shall include the following:

b. Screening/treatment of mechanical equipment. A cross section of the building
showing any roof top mechanical units in relation to the parapet or mansard
roof shall be provided.

Eagle City Code Section 1-7-4 (A) -states, "Fee Schedule Established - The City Clerk, at the time of the filing of an

the application. bv architects. engineers or other professionals necessary to enable the City to approve or
