WHEREAS, Coleman Homes, LLC, requested a vacation to the final plat of Eaglefield Estates Subdivision No. 1 to remove the utility, drainage, and irrigation easements between Lots 6 & 7 and Lots 7 & 8, Block 1 (Eaglefield Estates Subdivision No. 1); and WHEREAS, On April 6, 2011, the Commission recommended approval of the vacation (VAC- 01-11), with conditions,to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Valley Times on April 11, 2011, and April 18, 2011; and WHEREAS, On April 26, 2011,the City Council held a public hearing on the proposed vacation (VAC-O1-11), and voted to approve the vacation with conditions; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats-Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the utility, drainage, and irrigation easements centered on the lot lines between Lots 6 & 7 and Lots 7 &8, Block 1, of the final plat of Eaglefield Estates Subdivision No. 1, as considered, heard and approved by the Council at its April 26, 2011, public hearing for application number VAC-01-11 and as shown on the attachments hereto(Exhibit A). This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho,this 10th day of May, 2011.
