WHEREAS, Coleman Homes, LLC, requested a vacation to the final plat of Eaglefield Estates Subdivision No. 1 to remove the utility, drainage, and irrigation easements located between Lots 2-5, Block 2, vacate the shared access/common driveway easements contained within Lots 3-13, Block 1; Lots 2-5, Block 2; Lots 1-4, 6-9, 18-21, and 23-26, Block 6, vacate the section of plat note number 14 that references Lots 3-13, Block 1, and Lots 2-5, Block 2, and vacate plat note number 19; and WHEREAS, On February 7, 2011, the Commission recommended approval of the vacation (VAC-02-10), with conditions, to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Valley Times on February 28, 2011, and March 7, 2011; and WHEREAS, On March 22, 2011,the City Council held a public hearing on the proposed vacation (VAC-02-10), and voted to approve the vacation with conditions; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats-Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the utility, drainage, and irrigation easements centered on the lot lines located between Lots 2-5 Block 2, vacates the shared access/common driveway easements contained within Lots 3-13, Block 1; Lots 2-5, Block 2; Lots 1-4, 6-9, 18-21, and 23-26, Block 6, vacates the section of plat note number 14 that references Lots 3-13, Block 1, and Lots 2-5, Block 2, and vacates plat note number 19 of the final plat of Eaglefield Estates Subdivision No. 1, as considered, heard and approved by the Council at its March 22, 2011, public hearing for application number VAC-02-10 and as shown on the attachments hereto (Exhibit A), as shown on the "Affidavit of Correction" for plat note number 14 (Exhibit B) and the final plat with plat note number 19 removed(Exhibit C). Marks, a Professional Land Surveyor licensed in the State of Idaho, do hereby certify that this modification of Note 14 as recorded on Page 1 of 8 of Eaglefield Estates Subdivision No.1 was made under my supervision as a portion of the procedure required by the City of Eagle Planning Department to vacate some, but not all, of the common driveway easements created by said Note 14.The purpose of this vacation is to remove Lots 3 thru 13, Block 1 and Lots 2 thru 5, Block 2 from the common driveway requirement. Note 14 shall be modified to read: "14) Lots 2-10, Block 3; 1-22, Block 4; 1-5 and 7-11, Block 5 are subject to common driveway easement lines as shown which shall provide perpetual ingress and egress for adjacent lots and said lots shall be prohibited from direct access to dedicated streets. Maintenance for said driveways are provided for in the covenants, conditions, and restrictions (CC&R's) provided for this subdivision.
