DEVELOPMENT AGREEMENT MODIFICATION
This Development Agreement Modification, made and entered into on the date as
indicated herein, by and between the City of Eagle, a municipal corporation in the State of Idaho
("Eagle"), by and through its Mayor, and Beacon Light Homestead, LLC ("Owner").
WHEREAS, the Owner is the owner of record of certain real estate consisting of
approximately 14.07 acres generally located at 671 E. Beacon Light Road, Eagle, Idaho,
("Property"), as specifically defined in Development Agreement recorded under Instrument No.
109109347; and
WHEREAS, the proposed development agreement modification includes properties
within an area currently zoned R-E-DA; and
WHEREAS, all provisions with the Development Agreement recorded under Instrument
No. 109109347 are in, and shall remain in full force and effect, except that, condition of
development 3.2 is amended and condition of development 3.5 is added as stated herein.
WHEREFORE, the Owner and the City of Eagle desire to resolve the issues and concerns
that have arisen and for and in consideration of the mutual covenants contained in the
Development Agreement recorded under Instrument No. 109109347, the modification is agreed
to as follows:
ARTICLE I
MODIFIED CONDITION OF DEVELOPMENT
3.2 The Concept Plan (Exhibit B) represents the Owner's concept for completion of an eight
(8) lot residential subdivision and the Concept Plan (Exhibit B1) represents the Owner's
current concept for completion of a two (2) lot residential subdivision. Upon completion
and recordation of the two (2) lot residential subdivision any resubdivision of the property
shall be in conformance with the provisions within the Development Agreement recorded

under Instrument No. 109109347 and the Springhaven Subdivision Final Plat Conditions
of Approval (FP-06-08). As the Concept Plan evolves, the City understands and agrees
that certain changes in that concept may occur. If the City determines that any such
changes require additional public comment due to potential impacts on surrounding
property or the community, a public hearing shall be held on any proposed changes in the
Concept Plan, notice shall be provided as may be required by the City.
3.5 The construction of the required pressurized irrigation system, landscape/buffer berm, and
sidewalk adjacent to East Beacon Light Road is hereby waived until such time that the
property is resubdivided into the eight (8) lot Springhaven Subdivision (FP-06-08) or
resubdivided into a different configuration in the future.
ARTICLE II
GENERAL MATTERS
Enforceable Provisions. The original Development agreement, instrument number 109109347,
remains in full force and effect except as modified in Article I herein."
Effective Date. This Development Agreement Modification shall be effective after delivery to
each of the parties hereto of a fully executed original of this Development Agreement
Modification.
