AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, ADDING A NEW
CHAPTER TO TITLE 4, EAGLE CITY CODE, REGARDING AUTHORITY OF MAYOR
DURING LOCAL DISASTER EMERGENCIES; NOTICE REQUIREMENTS FOR LOCAL
DISASTER EMERGENCY ORDER; PENALTIES FOR VIOLATING LOCAL DISASTER
EMERGENCY ORDER; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating
under the laws of the State of Idaho; and
WHEREAS, the 2019 Novel Coronavirus (COVID-19) pandemic represents an imminent
threat to the life, health and property of the City of Eagle and its citizens; and
WHEREAS, pursuant to Chapter 3, Title 50 of the Idaho Code, the City of Eagle is
authorized to enact ordinances to maintain the peace, good government and welfare of the
corporation and its trade, commerce and industry;
WHEREAS, under Eagle City Code section 1 -5 -4 and Idaho Code section 50-
606, the Mayor is authorized to enforce within Eagle city limits, and in all places within
five (5)miles of Eagle city limits, any health or isolation ordinance and regulation thereof;
WHEREAS, the Mayor and Council have determined that good cause exists for
amending the Eagle City Code to provide for the regulation of public health hazards
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, Ada County, Idaho:
Section 1: That a new chapter, Chapter 11, shall be added to Title 4, Eagle City Code, to
read as follows:
4-11-1: AUTHORITY OF MAYOR DURING DISASTER OR EMERGENCY:
A. Purpose. By this chapter, the City Council of the City of Eagle, authorizes the Mayor
to quickly implement measures necessary to protect the public health, safety and welfare
in the rare event of a disaster and emergency resulting in an imminent, or present public
health hazard. This authority is vested in the Mayor by Idaho Code section 50-606 and
50-607.

4-11-2:DEFINITIONS:
A. Disaster. means occurrence or imminent threat of widespread or severe damage, injury, or
loss of life or property resulting from any natural or man-made cause, including but not limited to
fire, flood, earthquake, windstorm, wave action, volcanic activity, explosion, riot, epidemic,
pandemic, or hostile military or paramilitary action and including acts of terrorism.
B. Emergency. means occurrence or imminent threat of a disaster or condition threatening life
or property that requires state emergency assistance to supplement local efforts to save lives and
protect property or to avert or lessen the threat of a disaster.
4-11-3 LOCAL DISASTER EMERGENCY ORDERS
Upon the Mayor declaring a Local Disaster Emergency under Idaho Code section 46-
1001, the Mayor, being duly authorized by Idaho Code section 50-606 and this chapter, is hereby
empowered to:
(a) Order for the opening or closing of any building or premises owned or controlled by the
City, in the Mayor's discretion as the Mayor may determine to be in the public interest;
(b) Order the closure of commercial, recreational, or expressive gatherings or events.
(c) Order the postponement or cancellation of public meetings and hearings.
(d) Order a curfew during such hours of the day or night and affecting such categories of
persons as may be designated.
(e) Order the limiting of the number of persons who may gather at one location.
(0 Order that an infected person and/or exposed person isolate themselves from other
persons.
(g) Order the control, restriction, allocation and/or regulation of the sale, production,
distribution of food, water, clothing or other commodities, materials, goods, services and
resources.
(h) Order the suspension or modification of any ordinance if strict compliance with said
ordinance would restrict, hinder or unduly delay necessary action in coping with the Local
Disaster Emergency.
(i) Order the evacuation of all or part of the population of the City from any stricken or
threatened areas that is necessary for the preservation of life, property or other public.

Any Local Disaster Emergency Order(s) shall be effective and remain in effect only so long
as the Declaration of Local Disaster Emergency under Idaho Code section 46-1011 remains in
effect.
4-11-4: NOTICE OF LOCAL DISASTER EMERGENCY ORDER
A. Enactment. the Mayor shall prepare a written Local Disaster Emergency Order and
publish it pursuant to this section.
B. Publication of Local Disaster Emergency Order. Mayor shall cause a Local Disaster
Emergency Order to be published:
1. Posting the Order in a prominent place at Eagle City Hall;
2. Posting the Order on the City's website;
3. E-mailing the Order to all persons subscribed to City e-mail notification services;
4. Posting the Order to all City social media accounts;
5. Providing the Order to local television and radio broadcast outlets; and
6. Notifying other government agencies, including West Ada School District, Ada
County Highway District, Ada County, and other municipalities.
The Local Disaster Emergency Order shall be effective upon its posting at Eagle City
Hall.
4-11-5: PENALTY:
A. It shall be unlawful to violate any provision or directive of a duly enacted Local
Disaster Emergency Order. The violation of any provision or directive of a Local Disaster
Emergency Order shall be a misdemeanor.
B. That all ordinances, resolutions, orders, or parts thereof or in conflict with this
ordinance are hereby voided.
C. That this ordinance shall be effective immediately upon its passage and
publication.
