Minutes - 2011 - City Council - 05/24/2011 - Regular EAGLE CITY COUNCIL Minutes May 24, 2011 PRE-COUNCIL AGENDA: 5:30 p.m. -6:30 p.m. 1. Library Director's Report: Ron Baker, Library Director, distributes the Library Strategic Plan Extension FY 2010/11 to FY 2012/13 and the Library Newsletter and discusses the same. The Board has adopted this plan and I am giving you a copy of the plan as a courtesy copy. This is an extension to the Library's first 5 year plan. General discussion. 2. Prosecution Services Report: Mimura&Associates, Susan Mimura, I am presenting the 2nd Quarterly Report. Susan provides an overview of the staffing of her office that manages the Eagle Contract. We have been tracking the receipts that indicate the amount of fines and fees. We should realize a 20% increase over last year's revenues. Discusses caseload data, Crimes by Statute, and Citations by Statute. The major bulk of my caseload is DUI Arrest and Driving without Privileges. Discusses the different kind of cases reported on the spreadsheets. General discussion. Ada County Sheriffs Office monthly report. Chief Hippie distributes the monthly report and the City of Eagle Police 2010 Annual Report. Chief Hippie provides some follow up to Susan Mimura's report. Our Detectives only work on felony cases. ROLL CALL: HUFFAKER, SHOUSHTARIAN, SEMANKO, GRASSER. Shoushtarian is absent. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Reynolds leads the Pledge of Allegiance. 4. PUBLIC COMMENT: Cole Pitman, I am requesting a fee waiver request for a flood development permit. I am working on my Eagle Scout project. My project is to build an amphitheater at the Eagle Nazarene Church. Provides an overview of the amphitheater. This is approximate 5' from the Dry Creek Canal. The land is currently unused. I am requesting the fee of$200.00 to be waived. General discussion. Huffaker moves to add after Public Comments the request for waiver of the$200.00 flood plain development fee for Cole Pitman's Eagle Scout Project. Seconded by Grasser. ALL AYES: MOTION CARRIES Planner Williams discusses the pre-application meeting he had with Cole and his father. They are going through the permit process because this is actually in the floodway. My wife and I are close to a young person who got into the wrong crowd and he has now turned his life around. I would like to thank Chief Hippie and his officers for their help. Gretchen Gilbert, Chamber of Commerce, distributes Eagle Fun Days flyer. Discussion on the sign project. Huffaker moves to waive the associated flood plain development permit fee of$200.00 for the Eagle Scout Project of Cole Pitman. Seconded by Semanko. Appointment to the Design Review Board: Mayor Reynolds is requesting Council confirmation of the appointment of Phil Hull to the Board. Mr.Hull's term will expire in 2014. (JR) E. Noise Waiver Request: Eagle Volunteer Firefighter Association is requesting a noise waiver as allowed by Eagle City Code 4-9-6(D) to accommodate the Rocky Mountain Oyster Feed events taking place on June 11, 2011 at Merrill Park. The applicant is requesting that the waiver be extended to midnight. (SKB) F. Noise Waiver Request: McCarrel Enterprises LLC. dba: The Gathering Place is requesting a noise waiver as allowed by Eagle City Code 4-9-6(D) to accommodate a beer garden to be located in the parking lot adjacent to their property located at 50 E. State Street on June 10th & 11th in celebration of Eagle Fun Days. The applicant is requesting the noise waiver be extended to 2:30 a.m. (SKB) G. Approval of lease agreement between Aaron Mayovsky and City of Eagle for vendor space at Guerber Park. (ME) H. DR-20-11 —Building Wall Sign—My Bullfrog.com: MyBullFrog.com, represented by Virginia Cunningham with Lytle Signs, is requesting design review approval to construct two building wall signs for Verizon Wireless/MyBullFrog.com. Item 1 —the summary of Bob McQuade's report: add after much better than last year, "with total values down by only a few percentages this year.". Under Call To Order: note the absent of the Mayor. Page 3, 4t1i line should say Mr. Vaughan not Shoushtarian. Under Executive Session on Page 5 it should be added that I stated the good faith reason was that the status had just been brought to my attention. (ME) Huffaker: I pulled this item as I didn't know if this was a sno cone shack? Huffaker moves to approve Agenda Item #5G with the modification that their business be identified in the contract as a sno cone shack. Seconded by Grasser. Resolution 11-16: A resolution of the City Council of the City of Eagle, Ada County, Idaho, amending Resolution No. 09-20 establishing a fee to recover the actual labor costs associated with locating and copying documents; and providing for an effective date. The public is encouraged to comment on the proposed resolution. This item was continued from the May 10, 2011 meeting. (SKB) Mayor Reynolds introduces the issue. General discussion. City Attorney Buxton: I did review this Resolution and it does comport with the new changes made by the Idaho Legislature to the new public records laws. General discussion. No Public Comment. Better Hearing Month Proclamation: (JR) Mayor Reynolds introduces the issue. General discussion on the type of Proclamations to be accepted by the City. Council will leave it up to the Mayor's discretion on which proclamations to put on the Agenda. Semanko moves to approve the Better Hearing Month Proclamation for the month of May. Seconded by Grasser. ALL AYES: MOTION CARRIES 7. UNFINISHED BUSINESS: A. Joint Powers Agreement for III-A: Discussion on the III-A Idaho intergovernmental Insurance Authority. This item was continued from the March 22, 2011 meeting. (SKB) Mayor Reynolds introduces the issue. Stephanie Bonney, Attorney for the III-A, provides Council a follow up on her previous presentation to the Council. I'm here to answer any questions you might have. The Board has determined that in August they will need to shut down membership from August through January as that will be the time that they will be obtaining insurance, getting cards, and getting its approval. Cities will be able to join after January and there may be some type of buy-in at that time. General discussion. Doug Hetherington, City's Insurance Broker, we are trending right on track. What that means is that they project how much they are going to pay out on claims over the next year and we are sitting right at 9% with that small group pool. We are approaching another quarter and this is when we start to see changes in trend and it seems to be moving up. Pacific Sources feels comfortable in telling us that we will probably not see more than a 12% increase. General discussion. Review of Joint Parking Agreement between Customedica and U.S. Bank(DR-32-10)— Customedica: Customedica, represented by Walter Lindgren with Johnson Architects, is requesting modification to standard language of the joint collective parking agreement for shared parking between 149 W. State Street and 150 W. State Street. This item was continued from the May 10, 2011 meeting. (WEV) Mayor Reynolds introduces the issue. General discussion Zoning Administrator Vaughan discusses the trip generations for pharmacy. A pharmacy is more intensive in terms of trips than retail. Had the Trip Generation Manual showed a significant decrease in the amount of trips for a pharmacy than for general retail, I think that is what we were looking for to see if that existed to justify a decrease in parking and that didn't show up. Frank Thomason, I am the Chair of the Eagle Historic Preservation Committee, we believe that by adding two more members would benefit us on getting a quorum and also we are a very active Committee and two more members would spread the work around. Huffaker moves, pursuant to Idaho Code, Section 50-902, that the rule requiring Ordinances to be read on three different days with one reading to be in full be dispensed with, and that Ordinance #656 be considered after being read once by title only. Valley Regional Transit-Kelli Fairless,Executive Director: Ms. Fairless will present the annual progress report for Valley Regional Transit. Mayor Reynolds introduces the issue. Kelli Fairless, Executive Director Valley Regional Transit, discusses changes to their government structure, the Board and the Executive Board. Discussion on the government structure and the plan update. The Board will be reviewing this plan at their June meeting and this will be our guide. We will bring this plan back to you later in the summer. Mary distributes the Draft Plan for Treasure Valley Transit and displays the plan as an overhead and discusses the same. General discussion. C. FP-02-11 - Final Plat for The Shores Subdivision Phase 2—Magellan Development,LLC,: Magellan Development LLC, represented by Steve Holt P.E. with Toothman-Orton Engineering Company, is requesting final plat approval for a revision of The Shores Subdivision Phase 2, a 16-lot(11-buildable, 5- common) residential development. The entire 99.7-acre Shores Subdivision site is located on the west side of Eagle Road, south of Two Rivers Subdivision No. 3 and Two Rivers Subdivision No.8. The Shores Subdivision revised Phase 2 is accessed of Bellemonte Way and consists of 13.5-acres. (WEV) Mayor Reynolds introduces the issue. Steve Holt, Toothman-Orton Engineering Company, representing the applicant,the basis of this request is to reduce the scope and extent of the existing approved plat from 30 buildable to 11 buildable lots. The Executive Department has budgeted funds for the Mayor to attend. Council did not budget funds for Council Members registration. Discussion on budget meetings. Zoning Administrators Report: Discussion on the entertainment facility changes. This will go to PZ at their second meeting in June or their first meeting in July. General discussion. City Attorney Report: I was asked to be on Statewide Committee on access management for 1TD which is access on all level of highways. We are dealing with St. Als, Eagle Road, the By-Pass and Highway 16. We are looking at new rule making on how you get access to highways. General discussion.
