EAGLE CITY COUNCIL MEETING
April 9, 1996
Pre Council:
Ada County Sheriff: Lt. Woodcook spoke to the Council about the
Eagle Fun Days. They will provide a supervisor, patrol officers
and motorcycle officers for the parade.
Engineers Report: The lights are up in Friendship Park. He will
check on them and make sure they work.
The Eagle City Council met in regular session on April 9, 1996.
Mayor BOWER presiding.
The following members were present: RICK YZAGUIRRE, STAN BASTIAN,
MORGAN MASNER, NANCY MERRILL.
Moved by YZAGUIRRE and seconded by MASNER to approve the minutes of
the March 26, 1996, meeting as presented. ALL AYE: MOTION
CARRIED.
CLAIMS AGAINST THE CITY:
Moved by BASTIAN and seconded by MASNER to approve the
presented. ALL AYE: MOTION CARRIED.

FINDINGS OF FACT AND CONCLUSIONS OF LAW/EAGLE FIRE STATION #2-CUP:
Moved by MASNER and seconded by BASTIAN to approve the findings as
presented. ALL AYE: MOTION CARRIED.
PARK MAINTENANCE BIDS (continued):
Moved by BASTIAN and seconded by YZAGUIRRE to approve the park
maintenance bids for Friendship Park, OK Park, the Downtown Plaza,
City grounds and Arboretum, a total $20,782.05, as presented. ALL
AYE: MOTION CARRIED.
CHANNEL CENTER SUBDIVISION/FLOODPLAIN DEVELOPMENT (continued):
The memorandum written by the Mayor was introduced by Mary Berent
asking for continuance of this matter until the City Attorney has
an opportunity to review the matter.
Moved by MASNER and seconded by MERRILL to continue the matter
until the next regularly scheduled meeting. ALL AYE: MOTION
CARRIED.

ORDINANCE 269 - AMENDING TITLE 8 PLANNED UNIT
DEVELOPMENTS(continued):
Moved by MASNER and seconded by MERRILL to continue until the next
regularly scheduled meeting to give the City Attorney adequate time
to review the matter. ALL AYE: MOTION CARRIED.
KESTREL COVE - SETTLEMENT & RELEASE/DRAINAGE AGREEMENT (continued):
The agreement was addressed by the City Attorney. The document was
originated by Michael Creamer, Bill Narver's attorney. This
document only pertains to those lots bordering Ms. Sharp's
property. The lots are called out in the settlement and release.
JUB Engineering has not seen the settlement and release but they
have reviewed the drainage agreement, but been advised not to
comment on it.
Moved by MASNER and seconded by YZAGUIRRE to approve the Settlement
and Release Agreement as presented. The motion was amended by
MASNER and seconded by YZAGUIRRE that the approval is subject to
the Eagle City Engineer's written approval of the drainage swale
design. ALL AYE: MOTION CARRIED. AMENDMENT: ALL AYE: MOTION
CARRIED.
Note: The written approval is to be forwarded to the Mayor and
Council. Upon receipt the $386.00 is to be paid to Sheri Sharp for
reimbursement to JUB as a claim.
OLD BUSINESS:
TRANSIT - EAGLE VAN POOL TRANSPORTATION PROGRAM:
Moved by MASNER and seconded by MERRILL to discontinue the program
as of May 1st and pay the April charges. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/MERIDIAN SCHOOL DISTRICT CUP (continued):
Mayor BOWER announced that this was the time and the place set for
a public hearing on the application for a Conditional Use Permit
from the Meridian School District for an advanced academy in Eagle.
Councilwoman Merrill excused herself as she has a conflict of
interest.
The City Attorney spoke to the Council about the Memorandum written
by her office regarding the sewer problem the Sewer District has at
this time in relationship to this application.
Moved by YZAGUIRRE and seconded by BASTIAN to continue this issue
to the next regularly scheduled meeting for the express purpose to
deliver from the Sewer District a statement on their ability to
serve this site, and to ask that they have a board representative

to speak to Council regarding the sewer issue. AYE: BASTIAN,
YZAGUIRRE, MASNER. ABSTAIN: MERRILL.
NEW BUSINESS:
EAGLE FARMER'S MARKET - WAIVER OF FEES: Jill Kohler spoke to the
Council regarding the request for waiver of fees. This is the
second year for the Farmers Market in the City of Eagle. They are
changing the location of the property to the Realty World parking
lot. The organization is a non-profit organization.
Moved by MERRILL and seconded by BASTIAN to require them to go
before Design Review, and the City will require a Peddlers Permit.
The Council will waive all but a $10.00 fee. ALL AYE: MOTION
CARRIED.
ST MATTHEWS CHURCH ENTRANCE SIGN - MIKE VANCE: Request for an
interior lit sign in a residential district.
Moved by BASTIAN and seconded by MASNER to continue this matter to
staff report, on conditions in which signs are permitted,
get a in place at different churches and a comparison of this sign
signs
with signs in the CBD, how many nonconforming signs are in the area
and a recommendation by staff by the next regularly scheduled
Council session. ALL AYE: MOTION CARRIED.
VETERINARY CLINIC:
The City Clerk asked that this be withdrawn.
BOSANKA VILLAGE COMMERCIAL COMPLEX - SIGN:
After considerable discussion a motion was
made by BASTIAN and
seconded by YZAGUIRRE approve the pylon as presented to Council
with the illumination only 430 milliampere. AYE: BASTIAN,
YZAGUIRRE, MASNER. NAY: MERRILL.
Moved by BASTIAN and seconded by YZAGUIRRE that the established
sign criteria for Bosanka village must meet Eagle City Code as
printed and presented to tenant, with a footnote that it cannot say
in the established sign criteria one thing and then say the City
Code won't allow it. It must conform to City Code. AYE: BASTIAN,
YZAGUIRRE, MASNER. NAY: MERRILL. MOTION CARRIED.
ADA COUNTY TRANSMITTAL 96-22-CU -EAGLE SEWER DISTRICT:
Moved by BASTIAN and seconded by YZAGUIRRE to authorize the Mayor
to write a letter, to be signed by the Council, addressing the
Commissioners and asking them to make every effort to accomplish a
5 year sewer plan and speak to the conditions of a CUP for said
plan. ALL AYE: MOTION CARRIED.

PRIVATE STREET FEE SCHEDULE:
The Council agreed to continue the matter until the next regularly
scheduled meeting to give the City Engineer an opportunity to
review a fee structure as far as linear feet of the street and come
back with a recommendation for a set fee.
REPORTS:
Playground equipment: MERRILL will get back with Trevor Roberts for
parks equipment inspection.
MASNER: Bypass tunnels that would be pedestrian and bike friendly
is being discussed at this time. There are 2 possible sources of
funds in connection with a supplemental fund for a bike path or
sidewalk in Meridian. If they do not use the revenue it would
return to ITD and may be a portion of it of the funds needed.
