Mayor and Council Reports and Concerns: Semanko: Reports on the Transportation Committee today. The Committee made a request that we fund the Valley Regional Transit Route 44 Express Bus. Shoushtarian: The Urban Renewal Agency wants to expand their District area to the West. This is a discussion that is going on and 1 want to let the public know that this is going on. Grasser: No report 2. City Clerk/Treasurer Report: No report 3. Zoning Administrator's Report: Provides an update on the Arbor Ridge weed abatement. Discusses the proposals. General discussion. Council will add this to the Agenda. 4. Public Works Director Report: Provides an update on LID lighting. We had eight responses from our bid proposal. PLEDGE OF ALLEGIANCE: Chief Brian Hippie leads the Pledge of Allegiance. 4. PUBLIC COMMENT: A. Ea!!le River Pavilion Summer Concert Series: The public is encouraged to provide comment on the concert series. Acting Mayor Huffaker introduces the issue. Creston Thornton, concert organizer, we have had 2-3 noise complaints that the Council has forwarded to us. The restrictions by Ada County have been adhered here. Discussion on the noise level. The Concerts will finish up on October 8th. Discussion on annexation into the City. General discussion. B. All other comments. Acting Mayor Huffaker introduces the issue. Diane Scott, I am a member of Preservation Commission and I am here to ask that you maintain our budget for this year and do not change. PUBLIC HEARINGS: A. BUDGET PUBLIC HEARING: Notice is hereby given that the City Council of the City of Eagle, Idaho, will hold a public hearing for consideration of the proposed budget including general revenue sharing for the fiscal period October 1, 2010, to September 30, 2011 pursuant to Page 2 K:\CQUNCIL\MINUTES\Temporary Minutes Work Area\CC-08-24-10min.doc the provisions of Section 50-1002, Idaho Code. Said hearing to be held at Eagle City Hall, 660 E. Civic Lane, Eagle, Idaho, at 6:30 p.m. on August 24,2010. At said hearing, all interested persons may appear and show cause, if any they have why said proposed budget should not be adopted. Acting Mayor Huffaker introduces the issue and provides a little background on where we are and where we have been in discussing the budget. Huffaker: I would announce that we have come to an agreement with the current lessor of this City Hall building. We will be here not only for this year but the option of remaining here another two years under new lease payment arrangements. The previous lease we were paying approximately $240,000 a year and our lessor has agn~ed to lower that too approximately $142,000. I want to thank the entire Council as they participated in the negotiations with Hawkins-Smith and thank Robert Phillips who was negotiating for Hawkins-Smith. There has been discussion about the City buying this building. At our Town Hall Meeting it was suggested that we conduct a public survey that we could put online on the website and see what people would say and also hold a public hearing on the issue. Discussion on purchasing the building. Acting Mayor Huffaker discusses the procedure on testifying at the public hearing. Acting Mayor Huffaker opens the Public Hearing Ron Marshall, 740 Palmetto, congratulates the Council on the lease deal. Reads his written comments into the record. I have lived in Eagle all of my life, continuously since 1975. Discussion on prior city leaders and citizens. It isn't like Eagle is the only area in trouble. Discussion on when the fire department was started. Discussion on the design review ordinance and sign ordinance. Discussion on the purchase ofthe Heritage Park property. Discusses the positions he has held in the City and other committees that he has been on through the years. I'm concerned that we have a person in our community who owes the city quite a sum of money and seems bound and determined to destroy our fair city piece by piece, using a lot of questionable numbers and comparisons that he regularly gets published. Should we be compared to Rexburg? I'm waiting for this party to suggest next that we un-incorporate and let Ada County take over. Discusses the median income in the City. I think we can afford what we have here in Eagle. Discussion the City Hall Task Force. Discussion on the Bond Elections for the City Hall building. Discussion on the Museum, I hope you have had a chance to look at the Museum. All that we hear is doom and gloom and how bad everything is and a Council that can't seem to agree on much of anything. We need to have a full service Library to offer our citizens. You need to ask why you moved to Eagle. Chelsea Chamberlin, 490 Mango Drive, I want to thank you for the funds you have allocated to the Library. Over all I am happy with the budget you have published. I am concerned that after tonight there are going to be big cuts made. It is a priority for some people to cut taxes and to me the most important thing is to provide services to the citizens. The published budget shows that you can fund the Library. Discusses the programs at the Library. I would encourage you not to cut the Library in preparation of your final budget. Nancy Merrill, 1002 N. 1002 N. Faldo, discusses the city hall. I support the 3% increase. It is critical that we increase our services. Discussion on the graffiti in town. Discussion on law enforcement services. I am deeply concerned about the cuts proposed in the Planning and Zoning Department. All of the growth and development in the City was done through the planners, not the Mayor or City Council. Discussion on the years of growth, and the work done by the planners. You have people who have long term loyalty to this community, which is important to the citizens to this community. The reason is that Eagle developed early on through the leadership of a number of people with very high standards and enforced those standards. I know this first hand because in addition to being an attorney I am a partner in a development company that has developed property in Eagle and I am a small business owner. A substantial part ofthe success in Eagle has been a vigorous planning and zoning department. I have come to respect that staff and I have had experience with planning and zoning departments across the state and in a number of western states, and Eagle has a good department. You have an excellent staff, they work hard and understand the process and they listen. I also understand budgeting and zero based budgeting. I have heard some numbers thrown around 40%-50% cut in planning and zoning it would be a terrible mistake. I urge you not to throw the baby out with the bath water. Lynne Sedlacek, 1200 Hereford Drive, I am going to echo what some of the other people have already said. I am very concerned that the existing Council is still kind of a rookie council and I don't think you have experience and expertise in handling land use matters. The thought of you contracting out the planning services is a huge mistah. Discusses the Planning and Zoning work plan document. If this is contracted out who is going to represent the City in all of the meetings that the planning staff has to attend. This planning staff is one of the reasons that the City of Eagle looks so good. Contracting the services is a bad idea and cutting the staff is a bad idea. Long term this would cost us more if you start cutting staff right now. Ann Ritter, 1270 Beacon Light Road, I stand before you with two hats on; one is the Trustee for this area for Joint School District #2 and I stand in real support of the Library. Discusses the programs established at the Library. I would encourage you to fund the Library. As a volunteer of the Friends ofthe Library there is an active group of people who are active in the Library. I would ask you to help us support the Library. Pam Koelch, 1086 E. River Song, I am here tonight as a concerned citizen of the City of Eagle; I have lived here two years and I volunteer at the Eagle Historical Museum. I am concerned about the possibility of eliminating the curator's position and/or the museum itself. The City is fortunate to have a curator who has the knowledge and expertise to archive, display and preserve the museum artifacts so that they will be here for years. It is important for the citizens of Eagle and future generations to have this history oftheir City. Scott Nordstrom 2590 W. Timber Drive, I want to congratulate the Council because what you have done in taking the economic situation that has impacted this community in the last couple of years and turned it around to the point that exists right now is a commendable job. We now have a reserve back and we have taken critical steps to do what is necessary to put the budget in line. I am also moved tonight by the number of patrons' who have come forward tonight. These are the people who are and have been the core of this City for many, many years. Discusses his terms on the Council. The good thing about Eagle is that it still maintains the lowest tax rate in the Valley. Discusses the issue ofthe 3%. You have a 7M budget and it is only about 1% of it. This is just a political conversation; I encourage you to really look at this. The 3% might give us something of benefit instead of making a political statement. Please don't take apart this budget for what you have already done. Services are necessary Jeff Kuntz, 2213 Smoky Drive, as a member of the City Hall Task Force 1 want to commend the Council for your efforts on reducing the cost on the City Hall. I would like to acknowledge the 25 members of the Task Force. 1 would like the Council to move forward to purchasing the City Hall building. Discussion on the expertise of the Task Force members. Discussion on the purchase of the City Hall building and a bond election. I would roughly have a $60.00 difference if your roll back the taxes to 2008. I hope you are listening carefully to the citizens you have heard tonight. Do not gut the Planning & Zoning. Keep the Library funded, we need it. Nora Oldercamp, I come from a county with hard economy times all of the time. I am here to support the Library and the Museum. Please do the most you can do for the Museum. Jerry Robins, M3 Companies, I want to take except to one of the previous speakers that ifthe planning staff was not in place that M3 would roll over the City. We have a very cooperative relationship with staff. We have paid $350,000 to the City for stafftime, consulting time and attorney time. Outside consultants aren't the same as a person that has worked for the City and has the history; they are the ones that can make value judgments. I think staff does a good job and I would encourage you to keep the staff in tact. Brent Jennings 2575 Mariposa Drive, I have lived in Eagle for four years. The City should have effective planning. The sun is going to rise tomorrow. 1 think the pendulum in the planning department is swinging just one way. As taxpayers Wt: look for efficiency. The sun is going to come and when it comes up the City needs to be able to react to that. Jason Pierce, 1980 W. Floating Road, I want to congratulate you on having a reserve. Eagle does have a low tax rate and people don't see that because their home values are so high. I was on Planning and Zoning Commission when the development hit and we were reacting because it came so fast. The Library and the Museum are very important to the City. Lynne Sedlacek, Mr. Semanko and I were talking about employee and Council Member benefits. Discussion on benefits. As far as the Council getting benefits, are you full time? Acting Mayor Huffaker closes the Public Hearing. General budget discussion. Huffaker moves that we put in $237,000 as the personnel salary for the P&Z Department and figure out the benefits that go with that; leave the other benefits the same; put the certification for the planners back in, $1,350.00; and lets figure out the levy rate that we need which would be between 08/09 and 09/10, taxes would be lower. General discussion. Motion dies for a lack of a second. Further general budget discussion. Acting Mayor Huffaker calls a recess at 11 :05 p.m. Acting Mayor Huffaker reconvenes at 11: 1 0 p.m. Further discussion on the budget and a motion. Huffaker moves to remake his previous motion with the amendment to the P&Z that if the base salaries exceeds $221,000 that the Council will first be consulted before that final number is picked; P&Z supplies will be $800; vehicles will be evaluated on which ones to be sold and which ones will be retained; all of the other line items as currently listed on the budget worksheet that we have now; and we are not going to give you a levy rate but it will be between the 08/09 and 09/10; $540 telecommunications line item for P&Z; Seconded by Grasser. Semanko: My budget goal set at the beginning was that we take no 3% and we didn't; that we take no foregone and we didn't; another goal was to reduce the tax levy rate and I would have Page 5 K:\COUNCIL\MINUTES\Temporary Minu(es Work Area\CC-08-24-IOmin doc liked to gotten down to last year's levy rate but bottom line is we reduced the levy rate from what it is this year and I don't think you are going to find any other jurisdictions in the state let alone in this valley that can claim that they reduced the tax levy rate under any definition of a tax cut; this is a tax cut and this is on the right side of the ledgl~r; the goal to get the Library up to at least 40 hours and we did that and this budget keeps them at 51 hours; the City Hall that we had to reduce; we reduced that by almost $100,000 on the rent; we addressed the 4 day 5 day work week several weeks ago; zero based budgeting, we still have more work to do on that; 1 think we need to assign a Council Member to work with each dc~partment head, the Mayor and Clerk for each budget area for developing and implementing the budget as Meridian claims to do; Sheriffs Office and Law Enforcement making sure we held the line there and we added a detective and we did decrease the lease obligation and 1 am confident that we are going to move them into here which will be a long term savings to the City; we did increase transparency and John is to be commended for the tool that he created and for us to post that on line by the Clerk's; we increased public participation; I feel we made progress on health insurance and there is more that we can do, we did reduce the premiums to the City and we made good strides on the Council benefits and we will have eliminated those benefits in 2012; and we addressed the Mayor's salary issue very well and I feel pretty good that we have made substantial steps in the right direction. I apologize if I have offended anyone; I try to do the best I can. Grasser: My list and goals have not all been achieved but in the spirit oftrying to compromise and keeping things moving forward I found it necessary to make some concessions. 1 still feel that we should stick to the P&Z as we had outlined at the $221,000 level. I'm happy that we were able to include things like the bus transit and adding the detective in was needed. I think there is still a lot of room to driving our operations to more efficiency and 1 think this gets us on the road and next year it gives us an opportunity to take a temperature read and check this out throughout the year and be prepared to make whatever changes and adjustments we might have to make next year. I don't think the economy is going to go up and may take a down turn. We have to anticipate a down turn in property values. I am very happy with city hall situation. This gives us the ability to stay in a very beautiful facility and gives us the option to begin a longer term negotiation with the landlord to work out some kiind of a thoughtful purchase arrangement that we can look at in 2-3 years and possibly take this to a bond election. I think this is a healthy step. I am happy with the resolution to the Mayor's salary. Shoushtarian: I want to thank the Council and the public. It was a very good budget session. I wanted to get close to 08/09 for two main reasons. I wanted to give relief to our community as far as to their taxes in this tough economy. I really wanted to lower the taxes to attract all ofthe business. I wanted to stay above all ofthe other communities. For those two reasons I wanted to bring the taxes to 08/09. However, we couldn't and my proposal was that if we don't get it tonight that we go to the Mercer Group see if there is somewhere that we can look at the papers they gave us two years ago and we can make cuts to those that are above their range and if that is not enough then we cut the salaries of all ofthe employees including the Council to make the balance to 08/09. Lots of progress made; the biggest was the City Hall and we can save $100,000 and also the contracts that we saved money on. Overall it was very positive and I had my goal. I want to apologize to staff ifI offended any ofthem; it is nothing personal to anyone; I have to do what is right for the community. Huffaker: 1 want to thank the people who showed up tonight and thank those who have given so much to our community through the years. The peopk who have served the City in the past were doing their best to make the right decisions for their times. We got caught in the economic down turn and we have a different reality to deal with and we are trying to do what is best as well. We are talking about many, many years of service. I want to thank Phil Bandy, our previous Mayor, who was put into a position last year to make some cuts that got the City to the point that we were stabilized, he had to make the decision as to who to let go; what kind of expenditures had to be cut. He made some tough decisions and he was never recognized for that and I think he should be. 1 want to thank John for model he created which helped us to speed up the process; 1 want to thank the Council Members for the efforts they make and I am happy that we can move forward in this City Hall and that we can move forward with a lesser lease price and get in a position to start talking about buying this building. No one here tonight got what they wanted. I would have preferred to have kept at least one more P&Z person and I think we could have lowered property taxes over all and found a way to keep 5 of the 6 people in the department. Everyone had to give something to get to a budget and that is the one place where I had to give the most. Maybe we will be fortunate and we will see an upturn and we can bring some of them back. Grasser moves to refund the money and do an explanation stating these things are beyond our control and state the process and the procedure; that it was cleaned in the morning and that people got there before your reserved time and made a mess of it our normal course of operation is not to go there before your reservation. As you are aware, Eagle became a wonderful place to live because of the leadership of a lot of wonderful people, most of whom I knew or know quite well. We have had farmers, business people, planners and lots of others who, in the past, have made some mistakes we have to live with today. However, if you had been on this council at the same time, and all factors were the same, you might have made the same mistakes. At this point, I am afraid this council is on the verge of making even greater mistakes. In the past, when the going got tough, the tough got going. Eagle is Eagle because of people like Marvin Adams, Jerry Deckard, Otis Young, Rick Yzaguire, Nancy Merrill, Steve Gerber and many others. When we needed a fire department, we had volunteers to do everything including build the original firehouse. Roy and Joey Cullen, the Hicks brothers, my dad, Carl Marshall, and many others helped complete the task. Floyd Calhoun and Wayne Crosby raised more money through Disaster Auctions than you can imagine. The Senior Center and the prior City Hall wouldn't exist except for the efforts of Wayne Crosby. Thanks to a group of proud locals who passed a design review ordinance and sign ordinance about 1980, we made Eagle a wonderful place to live even though a lot of developers and others didn't like the rules we made. Not to brag, but you can verify that Heritage Park, its lease purchase deal from previous owners, and the museum were two of the many things that I am responsible for. I was the chair of the Design Review committee the first five years that it existed, served eight years as Eagle's representative to the Air Quality Board and eight or ten years as Eagle's representative to the Ada County Industrial Development Commission. Those and many other odds and ends including working for the Meridian School District to acquire the sites for both the Eagle Academy and the present Eagle High School. I'm concerned that we now have a member of the community who owes the city quite a sum of money and seems bound and determined to destroy our fair city piece by piece, using a lot of questionable numbers and comparisons that he regularly gets published. Should we really be compared to Rexburg? I'm waiting for this party to suggest next that we un-incorporate and let Ada County take over. According to information from the 2000 census published in the Idaho Statesman on Sept 4, 2002, Eagle had the fourth highest median income in the state of Idaho at 65,313 compared to Boise at 42,432. Sun Valley was the highest at 71,000. 1 think we can afford what we have here built here in Eagle. I recently had a short discussion with a previous councilman about out City Hall, that he says we can't afford now and never could. He informed me that he had moved out of the city Limits, however his address is still Eagle, Idaho, 83616. If he didn't like Eagle as it is, why didn't he move farther away. Your own Task Force concerning the City Hall problems came to the obvious conclusion: Buy the Existing Building! Also, remember, 60.5% versus 39.5% did pass a bond to build and own city hall -- that was a sizable majority. You consider the museum a bother after all of the donations of exhibits and time and money we have put into this wonderful display of Eagle's past — when was the last time each of you has visited the museum? All we are hearing is doom and gloom and how bad everything is and a council that can't seem to agree on much of anything. Where is the spirit of the past officials whose enthusiasm carried us to where we are today? We have a proud heritage in Eagle that we can get the job done in spite of a few conflicts along the way. We need the dedicated city employees we have to be able to deal with our comp plan and ordinances that we have enacted. We need to have a full service library that we can be proud to offer to our citizens. We need to get fired up, stop the bickering and move forward. Ask yourselves, why did we move to Eagle when we could have lived in some other Treasure Valley city or even Rexburg? I urge you not to cut the budget more, but to add the allowed 3% to the budget and get back on track. And, while you're at it, pick someone from the list you solicited in March, and appoint them mayor. I sincerely believe none of you will face a recall or be run out of town for doing the job you were elected to do. Guest opinion by Councilman Steve Gerber supports the proposed new building Guest opinion Morgan Masner disputed the need for a building size and uses and refers to the building as a Taj Mahal Results reported Wed, May 28, 2003: City Hall proposal rejected by voters with only 48% approval Mav 22, 2004 Eagle City leaders propose a much smaller City Hall, size reduced from 22,000 to 12,500 sq ft on the ballot on Tues, May 25. Statesman Editorial urges approval of the bond commending the Eagle City leaders for doing a good job of scaling back the proposal and size of the building. Readers View by Ted Martinez, local contractor, supports the building and gave numerous reasons why the proposal was much better than the previous larger building proposed in 2003. Readers View by Morgan Masner, former Eagle City Councilman, accused the Eagle City government of deception in seeking approval of the bond issue. Results reported May 25, 2004: defeated. 1,030 "yes" votes and 671 "no" votes (60.5% yes and 39.5% no votes) CONCLUSIONS Ron Marshall, Eagle Resident In reality, the people have already spoken with their majority votes, and if it were not for our outdated 2/3 majority law, we would have passed the bond, owned the Eagle City Hall and wouldn't be having to go through this process now. The Eagle City Council did what they had to do at the time they built the City Hall. They had to get out of the old existing City Hall that was really built for a Senior Citizens' Center. Eagle City owned this land and it appeared the economic boom would continue, and we would need the space. We could be critical of our city leaders if they were the only ones we could find fault with for optimism. It seems the rest of the country and, in fact, the world have a lot of problems bigger than ours. Let's get this lease renegotiated and reduce out outlay, or, better yet, purchase the City Hall building. The is the 4th event this year that the music is WAY TOO LOUD. I reside about 400 yards due southeast of the Eagle City Hall. The music is so loud I can hear every word the guy is singing and the bass is up too far also. I have a 3 year old son that goes to bed at 9pm with the exception of these "musical" events. I am completely opposed to this venue as it does not need to be this loud. If by chance it does need to be this loud then it should be relocated up near the Firebird Speedway away from our residential area that has LOTS of babies, toddlers and I would presume elderly folks that have an early bedtime. RECEIVED & FILED CITY OF EAGLE AUG 2 3 2010 We feel the budget for the library should not be reduced even in .... especially in these difficult economic times. We regularly check out books, videos and music. We have taken evening classes and used the Internet computers at the library. We donated funds so the library could maintain some of its periodical inventory and we use the reference section and appreciate the assistance of the reference librarian. We donate to, and buy, from the fall and spring book sale every year. The library is a large part of our lives. It has also been a social hub where we meet friends and neighbors coming and going. We have no children but realize the importance of the library in their lives. Not only is it a safe haven for children but it is a place where learning and imagination flourish. These are key elements in the development of the youth of today that will be the citizens and leaders of tomorrow. From a previous meeting of the Council regarding library funding, I realize there are those of you and your families that do not frequent the library or utilize its many services and programs. That is your choice and your loss. But as Council members you have an obligation to the citizens of this community, both young and old, to provide the means for the library to continue functioning as a full service operation. We ask that you meet your obligation by securing that there will be no reduction in the library's allotment of budget funds. It is difficult to pick-up materials when the hours are so limited.
