Findings of Fact for Revised Preliminary Plat of Echo Creek Subdivision #5, 6 & 7 (PP-3-96) - The Zoning Administrator is requesting City Council approval of the Findings of Fact for the Revised Preliminary Plat of Echo Creek Subdivision #5, 6 & 7 (PP-3-96). The site is located at the northwest corner of Floating Feather Road and the new alignment of Highway 55. (MB) D. Minutes of November 26, 1996 -- The City Council during the December 19, 1996, meeting requested the City Clerk to review, correct, and report on minutes of the November 26, 1996, meeting of the City Council. Upgrade City Workstations to Windows '95 -- The City Clerk is requesting the City Council approve the expenditures necessary to upgrade the existing workstation operating system to Window '95 from Windows 3.11. Transportation Task Force -- The Mayor is asking the City Council to confirm his appointments to the Transportation Task Force. (CB) UNFINISHED BUSINESS: A. Library Board Report on New Library Facilities - The Library Board will report to the Mayor and City Council on their Board action and recommendations regarding the development of a new Eagle Library. This issue was continued from the December 19, 1996, Council meeting. (20 min) B. Committee Appointment Authority. The City Council at the October 22, 1996, meeting asked the City Attorney to prepare a legal opinion, and asked this issue be continued for discussion at the next regular meeting. (JMF) (15 min) PUBLIC HEARINGS: A. Conditional Use (CU-9-96) - Ron Bath representing SDR Development, LLC., is requesting City conditional use approval for a temporary gravel extraction operation for the construction of a lake within the proposed Lakeland Estates Subdivision. The 23.1-acre site is located approximately 1,000 feet south of State Street, adjacent to the east boundary of the Monroc property. This item was continued from the December 10, 1996, City Council Meeting. (MB) (5 min) B. Conditional Use (CU-13-96) - D. Korey Lowder, City Clerk/Treasurer with the City of Eagle, is requesting conditional use approval for a 672 sq. ft. temporary mobile office located directly behind City Hall. The site is located at 310 E. State St. approximately 200 feet east of Second St. (MB) (5 min) C. Rezone (RZ-4-96) - David Koga, with the Land Group, is requesting a rezone from R-5 (residential 5 units per acre maximum) to C-1 (neighborhood business district). The applicant is proposing to use an existing residence as a professional office. Approval of a Design Review will be required prior to site modifications. The 0.35-acre site is located at 128 S. Eagle Rd. on the southeast corner of Eagle Rd. and Aikens Rd. (MB) (30 min) D. Zoning Ordinance Amendment (ZOA-5-96) - The Eagle Planning and Zoning Commission is recommending amendments to the Eagle City Code to modify the definition of a monument sign to allow more flexibility with regard to its construction; to establish specific criteria for signage on fuel island canopies; and to consider modification to the section of code that states, "Each individual free-standing business shall be limited to two signs, including the monument or detached street sign. The second sign shall not exceed eight square feet (8 sq. ft.)". (MB) (20 min) NEW BUSINESS: A. (CB) XTAT B. ~[The applicant is requesting that Ada County allow a variance of the 100-foot river setback requirement in the floodway district to allow construction of a single family dwelling 50-feet from the floodway line. The site is located at 1727 S. Trout Road approximately lA mile south of Hatchery Road and 1A-mile east of Linder Road. The site is within the Eagle Area of Impact. (MB) (20 min) C. Extension of Time for Fall Creek Preliminary Plat - Dennis M. Baker, with B.W. Inc., is requesting a one year extension of time for the Fall Creek Subdivision preliminary plat. The residential subdivision consists of 233 lots. The 140.23-acre site is located on the east side of Eagle Rd., approximately 1/4 mile north of Chinden Blvd. (MB) (10 min) D. Final Plat for Channel Center Subdivision - Dennis M. Baker, with B.B. One, LC, is requesting final plat approval for Channel Center Subdivision. The commercial subdivision consists of 11 lots. The 15.8-acre site is located on the southwest corner of Eagle Rd. and the Alternate Route. (MB) (15 min) E. Subdivision Ordinance Amendment for Lot Drainage - The City Council has requested that the Zoning Administrator provide the Council with proposed language for a possible amendment to the Subdivision Ordinance. The amendment would be to establish more specific criteria for the control of lot drainage. (MB) (15 min) F. Waiver of Private Road Application Fee - Chuck Palmer is requesting a waiver of the private road application fee for Buckwheat Acres as provided for in Eagle City Code Section 1-7-4 (E). The subdivision is located approximately 3/4 mile north of Beacon Light Road, and 3/4 mile east of Eagle Road, and is within the Eagle Area of Impact. (MB) (30 min) G. Amendment of CEDA -- Councilmember Merrill requests the City Council consider the amendment of the boundaries of the CEDA. (NM) (10 min) H. City Council as Approving Body -- Councilmember Merrill requests the City Council consider modifying Title 8, Chapter 2A to change the approving body from the Planning and Zoning Commission to the City Council. Amendment of the Design Review Ordinance -- Councilmember Merrill requests the City Council consider reenacting Title 6, Chapter 7, Sections 1 -- 14, for purposes of including the Parks Committee into the Design Review Board to maintain eligibility for the Tree City USA Grant. Amendment of Desi;~n Review Ordinance~ Ordinance #284 -- Councilmember Merrill requests the City Council consider repealing the existing Title 2, Chapter 2, Sections 1 -- 4, and enact a new Title 2, Chapter 2, Sections 1 -- 4.
