D. Revised Findings of Fact for conditional use application by Boise City Cellular
Partnership for the construction and operation of a cellular transmission site with a 120-
foot monopole (CU-8-96): The Zoning Administrator is requesting Council approval of the
revised Findings of Fact for the conditional use application submitted by Boise City Cellular
Partnership (Revisions highlighted in yellow). The tower is proposed to be approximately 400'
south of State St. and 1/4 mile west of Edgewood Rd. at the southwest comer of the Container
Supply Company parcel. (MLB)
E. Findings of Fact for rezone application by Edge Development for a rezone from R-5
(residential 5 units per acre maximum) to C-2 (general business district) (RZ-1-97): The
Zoning Administrator is requesting Council approval of the Findings of Fact for the rezone
application submitted by Edge Development. The 4.4-acre site is located on the east side of
Eagle Road approximately 600-feet south of State St. at 174 S. Eagle Road (temp. address).n

Findings of Fact for conditional use applications by Edge Development for a drive-thru
restaurant and a shopping center (CU-1-97) & (CU-2-97): The Zoning Administrator is
requesting Council approval of the Findings of Fact for the conditional use applications
submitted by Edge Development. The 4.4-acre site is located approximately 600-feet south of
State St. at 174 S. Eagle Rd (temporary address).
UNFINISHED BUSINESS:
A. Financial Consulting Services Contract: The City Clerk has submitted for Council approval
the Financial Consulting Services Contracts for financial consulting services on the additions and
improvements of the Library and City Hall Complex and authorizing the Mayor and City Clerk
to execute the same.(SKS)
B. Resolution 97-6: The City Clerk is requesting approval of a resolution approving an agreement
for Bond Counsel Services and authorizing the Mayor and City Clerk to execute the same.(SKS)
C. ACHD proposed final construction plans for Eagle Road from State Street to Highway 44
Alternate Route: To be presented to the Council by an ACHD representative. (MLB)
D. ACHD contract for improvements for Eagle Road between new Highway 44 Alternate
Route and State St.: ACHD has submitted the Roadway Reconstruction, Landscape & Lighting
Improvement contract for Eagle Road, State Street South to Eagle Bypass, ACHD Project No.
52056.0 for Council approval. (MLB)
E. Discussion of Eagle Road improvements from State Street north: An ACHD representative
will discuss proposed improvements of Eagle Road from State Street north. (MLB)
F. Kestral Cove Settlement Agreement: The City Attorney will provide an update on the status
of the agreement between the parties.
G. Ordinance 290: Per I.C. 50-611, the Mayor is returning Ordinance 290 to the City Council
unsigned with his written objections. No Council action is required. (CAB)
H. Cooperative Illumination Agreement: State of Idaho, Transportation Department, has
submitted an Cooperative Illumination Agreement - Intersection of Eagle Alternate Route &
West State Street for Council approval.(MLB)
I. 97-3-ZOA Zoning Ordinance Amendment - Ada County: To consider ordinance
amendments regarding rules and regulations of the placement, construction, and modification of
personal Wireless Facilities (Cellular Towers).
PUBLIC HEARINGS:
CU-9-96 - Lakeland Estates Gravel Extraction - Ron Bath: Ron Bath representing SDR
Development, LLC., is requesting conditional use approval for a temporary gravel extraction
operation for the construction of a lake within the proposed Lakeland Estates Subdivision. The
23.1-acre site is located approximately 1,000 feet south of State Street, adjacent to the east
boundary of the Monroc property. This item was continued from the December 10, 1996, and
January 14, 1997, City Council Meetings. (MLB) (5 min)

A. Appointment of Judges and Clerks for the May 27, 1997 Elections: The City Clerk is
requesting the appointment of one Judge and 6-10 Clerks for the up-coming May 27th elections.

B. Implementation of Personnel Policies and Procedures: The City Clerk is requesting the
Council decide how to implement the new employee manual in regards to comp time, sick leave,
and vacation time already accrued by employees. (SKS)
C. Ci.ty Clerk/Treasurer: The Mayor is requesting the Council Confirmation of Sharon K.
Smith as the City Clerk/Treasurer
D. Discussion of Flood Plain Development Regulations: At the joint City Council/Planning and
Zoning Commission/Design Review Board meeting of March 31, 1997, it was determined that
additional regulations regarding development within the floodplain might be considered for
implimentation by the City. This item is to allow the Council to further discuss this topic.
