Box 1520 Eagle, Idaho 83616 208-939-6813 July 2, 2010 Will Brassfield 3 Spur Drive Horseshoe Bend, ID 83629 RE: Request for Building Permit at 1093 Parkinson Street Dear Mr. Brassfield, Council Members John Grasser Michael Huffaker Norm Semanko Al Shoushtarian This letter is in response to your request for a Building Permit for an accessory building (shed) to be located at 1093 Parkinson Street (Lot 20, Block 1 of Randall Acres No. 15). Your request for this permit has been denied for the reason explained herein. The property in question is zoned MU (Mixed Use) upon which currently exists a mobile home. Eagle City Code 8-2-3 states that a mobile home requires the approval of a conditional use permit to be located within the MU zoning district. The City has no record on file of issuing such a permit. As such, the property referenced herein is considered non -conforming. Eagle City Code Title 8, Chapter 5 "Nonconforming Uses", states in part that nonconforming uses are allowed to continue, provided that the buildings and site (or combination thereof) of such nonconforming use cannot be enlarged, constructed, reconstructed, or extended to occupy any additional land area except in changing the use of the structure to a use permitted in the district in which it is located. In this instance, the accessory building cannot be permitted to be located on the site as it is considered an enlargement or extension occupying additional land area.
