THIS RELEASE OF WATER EASEMENT is made the ~L day of
~ , 2006 by the EAGLE WATER COMPANY, INC., an Idaho
corporation ("Company").
WHEREAS, a Grant of Easement dated August 18, 1982, was recorded as
Instrument No. 8243015 on October 18, 1982, Records of Ada County, Idaho, on a
portion of Block 1, Lot 6 and Block 1, Lot 7 AQUILA VILLAGE SUBDIVISION, filed
in Book 82 of Plats at Page 8908 through 8909, Records of Ada County, Idaho
("Easement"), for the benefit of Eagle Ranch Water Corporation as predecessor in
interest of the Company; and
WHEREAS, the fee title owner of Block 1, Lot 6 and Block 1, Lot 7 of Aquila
Village Subdivision has requested release of the Easement covering the area legally
described on Exhibit A attached hereto and shown on Exhibit B attached hereto
("Released Area"), which exhibits are incorporated herein by reference; and
WHEREAS, the Easement in the Released Area is no longer necessary to the
needs of the Company, and the Company desires to release any interest in the Easement
regarding the Released Area;
NOW THEREFORE, be it known that having been duly authorized, the Company
hereby releases the above described Easement insofar as it relates to any rights granted to
the Company thereunder in the Released Area, and hereby abandons any claims it may
have to use the Easement in the Released Area.

Partial Release of Water Easement
Being a portion of a 10.00 foot wide water easement lying in the Southwest 1/4 of
Section 9, TAN., R.IB., Boise Meridian, Eagle, Ada County, Idaho as described in Grant
of Easement recorded October 8, 1982 as Instrument No. 8243015, records of Ada
County, Idaho, relinquishing that portion of said easement, the centerline of which is
more particularly described as follows: Commencing at the Northwest comer of the said
SW 1/4 of Section 9; Thence North 88058'02" East, 2,654.24 feet along the northerly
boundary of the said SW 1/4 of Section 9 to a point marking the Northeast comer of the
said SW 1/4 of Section 9; Thence South 0001 '20" West 1,401.73 feet along the easterly
boundary ofthe said SW 1/4 of Section 9 to a point; Thence North 89058'40" West,
32.01 feet to a point; Thence continuing North 89058'40" West, 236.21 feet to a point;
