Box 1520 Eagle, Idaho 83616 939-6813 Re: Extend the time for action on Building Permit Application at 1334 E State St. Dear Gordon & Meredith St.Clair, Council: Steve Guerber Michael Huffaker Norm Semanko Al Shoushtarian On June 9th, 2009 the City of Eagle received your letter requesting an extension of time for action on the building permit application for a New Commercial Building. Eagle City Code Sections 7-1A-3 & 7-1A-4 has amended the 2003 International Building & International Residential Code Sections R105.3.2 which allowed a 90 day extension, to be increased to a period of 180 Days to grant more flexibility to the building community when unforeseen conditions are presented. IBC & IRC sections 105.3.2 are amended to read as follows: 105.3.2 Expiration Of Plan Review. Applications for which no permit is issued within 180 days following the date of receipt of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period not exceeding 180 calendar days on request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. No application shall be extended more than once, nor shall any extension be granted beyond the last day of the current code cycle as adopted by the city of Eagle. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee. To accommodate your request, your time for action is extended to December 9th, 2009 under Eagle City Code Section 7-1A-3 & 7-1A-4. This section, as adopted by the Eagle City Council, limits a permit holder and applicants to only one extension.
