PRE-COUNCIL AGENDA: 5:30 p.m. - 6:30 p.m.
1. Library Director's Report: Ron Baker, Library Director, discusses the statistic trends for the
last three months. We have seen a 17% decrease largely because of the cut back in hours and
also because of the Cole/Ustick Branch Library. 66% of circulation is going to Eagle residents.
This month shows an increase of Eagle residents going to the Boise Library, especially the new
Cole/Ustick branch. Our collection is over 90,000 and the collection will be stabilized between
90,000 to 100,000. We have cut back in the purchase of new materials. We had a $14,000.00
overage in the carry forward and the Library Board authorized me to hire a 19 hour Library
Assistant 11 for the children's services. We have now been able to double the programs for
children. We just started a new pre-school program. Discussion on the Strategic Plan.

2. Quarterly Report by Eagle Chamber of Commerce: Teri Bath, President, I don't really have
anything new from the round table discussion that we had with the Council. We do have a new
recycling business that is coming in. I appreciate the Council granting the developers the
extensions that they have been requesting. Thank you very much for working with Chamber.
1. Public Works Director Report: None
2. Zoning Administrator's Report: I need to start a dialog with Idaho Power on the 2% franchise
fees. In our meeting with Ada County we will be discussing the 14 points in regards to the area
of impact agreement.
3. City Attorney Report: We are working the Library on the Lynx contract and we are going to
be working on updating the impact fee plan. We will need to update the committee. We are
working with the Clerk's office on updating the personnel manual. Discussing how the capital
improvement plan will affect the Urban Renewal Agency.
4. City Clerk/Treasurer Report: None
5. Mayor and Council Reports:
Semanko: The Eagle Sewer District met last night. They approved the dry creek crossing
project and the purchase of a vehicle. Discussion on the February election. Only Jim Brooks
filed for his spot and Ed Hendershot filed for his position and they were declared winners under
state law and will be sworn in at their next meeting.
Huffaker: The Parks and Pathway Commission is meeting next week and they will be electing
two more Commissioners. We have had a great number of applicants apply. If possible for the
January 26th meeting, Trautman would like to give us an update.
Shoushtarian: Senior Citizens met this morning. Discussion on the senior's having a tab on the
City's website. They want to apply for some grants and think this would help their process.
Jackson-Heim: Reports on the Census Committee meeting. I will be happy to work on this
committee until it disbands. I am working on the Library's Strategic Plan.

City Clerk Sharon K. Bergmann administers the oath of office to Norm Semanko and John
Grasser and presents them with their Certificates of Election.
Semanko: I want to thank everyone on the Council for their support the last two years and
certainly the support from the community for electing me to a four year term. I don't believe this
is an us and them thing. I feel strongly that is about we in the community. I appreciate the
service of the folks that I served on the Council with and are not longer on the Council. I had the
pleasure to sit by Steve Guerber, I learned a lot from him as to the way the Council works.
Jeanne, I'm really appreciative of the fact that the Mayor appointed you. Jeanne did a great job
and it was a pleasure to work with her. I look forward to her continued involvement in the
community. I look forward to the opportunity to work with all of you.
Grasser: I feel quite honored and humbled by the support from the community. I felt a certain
obligation to help our community to increase sensibility and common sense to our city. I will do
the best I can to serve the best interest of the community. During my term I hope to make a
positive difference. I pledge to work to the best of my ability with these gentlemen on the panel,
working together for our community. I'm confident that we will create a much improved
experience in Eagle and increase the community's level of trust in its City Leadership.
Huffaker: I want to re-welcome Norm and congratulate him on his election and welcome John to
the Council. I want to thank Jeanne for her service to the community. Whe was a great
contributor to the Council. She came well prepared to the meeting, always knew what she was
talking about and did her homework. She was always very cordial, courtesy and respectful no
matter whether she agreed or disagreed with folks. During our budget process Jeanne answered
all of the e-mails that we received, she was the only person on the Council to do that. She is
always the first one to step up and answer the e-mails. She was a great asset to the Council and
we will miss her for all of the things that she added. It is nice to see that she is doing so much
work the community. Jeanne is a true community servant and will be a great asset to the
community.

Mayor introduces the issue.
Semanko nominates Mike Huffaker to continue as Council President.
City Attorney Buxton discusses the duties of a Council President.
Grasser nominates Al Shoushtarian as Council President.

Mayor: We will take a poll of the Council on Council Member Huffaker. All of those in favor
of Council Member Huffaker to be the President say AYE: 2 AYES: 2 NA YES: SPLIT VOTE.

Mayor: It comes down to me to break the tie. My comfort level is siding with Mike on the
Presidency; he has done a fine job this last year, so I vote for Mike and he will be the President
of the Council.
B. Review of Council Liaison positions for 2010:
Mayor introduces the issue. I would ask Council to look at the list and let me know what liaison
positions each of you are interested in. Also, is there are some positions that you feel that aren't
necessary let me know.
Grasser: I have limited time but two of the positions that I would be interested in are the police
and the fire department.
Semanko: I have had a difficult time to attend the Transportation Committee meetings so if
someone else is interested it is a very good committee. If no one else is interest I will try to cover
the committee.
Shoushtarian: I would take the responsibility of Jackson-Heim's positions and share with
Council Member Grasser. Also, Council Member Semanko has the liaison position with ITD &
ACHD and has not given one report.
Semanko: !TO and ACHD come to the Transportation Committee Meetings.
Mayor: We will revisit this at our next meeting.
7. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Mayor, a
Councilmember, member of City Staff, or a citizen requests an item to be removed
from the Consent Agenda for discussion. Items removed from the Consent Agenda
will be placed on the Regular Agenda in a sequence determined by the City Council.
. Any item on the Consent Agenda which contains written Conditions of Approval
from the City of Eagle City Staff, Planning & Zoning Commission, or Design
Review Board shall be adopted as part of the City Council's Consent Agenda
approval motion unless specifically stated otherwise.
A. DR-35-09 - Multi-tenant Office Buildinl! - The Forum at Eal!le. LLC: The
Forum at Eagle, LLC, represented by James Gipson with Gipson Associates, are

requesting design review approval to construct a 7,090-square foot two story multi-
tenant office building. The 0.62-acre site is located on the southwest comer of South

Eagle Forum Building. The 0.62-acre site is located on the southwest comer of

A. Confirmation of appointments to the City Hall Location Options Task Force. (PB)
Mayor introduces the issue. We had 25 applicants and I want to thank all of the applicants.
Based on the feedback I received from the Council, I have selected 12 individuals. My
appointment will be in the from of Resolution 10-05. The following are the people I have
appointed: Eric Jacky, Jane Krammer, Jason Pierce, Jean Walker, Jeanne Jackson-Heim, Jeff
Kunz, Lynne Sedlacek, Matt Mahoney, Ron Bath, Suzie Boyle, Terry Sayer and William
Laubner. Jeanne Jackson-Heim would head the task force.
Huffaker moves to amend the agenda to add Resolution No-05 establishing the Eagle City Hall
Task Force. Discussion.
City Attorney Buxton: Discusses the need for adopting the Resolution. General discussion.
Huffaker retracts the motion to amend the Agenda.
Huffaker moves to approve the appointments of all twelve members that the Mayor has
nominated and that we allow the Task Force to decide on their own chairperson. That we
have the City Attorney bring the Resolution to our next meeting and also that language be
included as to what their responsibilities are. Semanko withdraws his second on the

Semanko: I am making a Substitute Motion: that the Resolution be posted on the web site
inviting public comment and secondly that the Mayor communicate with the local reporter
of record to see if we can't get some mention in the next paper or two that this is going to
be the subject of the next Council meeting and third that the Agenda include that public
comment will be accepted on this agenda item instead of doing a public hearing
requirement that is required by ordinance for certain activities that we conduct.

10. PUBLIC HEARINGS:
A. A-04-09/RZ-04-09 - Annexation and Rezone from RUT (Rural-Urban Transition - Ada
County desil!nation) to MU-DA (Mixed Use with a development al!reement) - Capital
Development. Inc.: Capital Development, Inc., represented by Dave Y orgason, is requesting
approval of an annexation and rezone from RUT (Rural-Urban Transition-Ada County
designation) to MU-DA (Mixed Use with a development agreement). The 11O.56-acre site is
generally located on the west side of S. Meridian Road and the north side of W. Chinden
Boulevard (Highway 20/26) approximately 835 feet west of S. Meridian Road. (WEV) This
item was continued from the December 15, 2009 meeting. The applicant is requesting this

C. "No-Sort" or "Cominl!linl!" Recvclinl! Options: The purpose of the hearing to consider the
following:
1. Are the citizens of Eagle interested in converting from the current form of
"source separated" recycling in the small 18-gallon blue bins to "comingled"
(mixed together) recycling in the large 95-gallon recycling carts?
AND
2. If so, are they willing to pay for the opportunity?
**NOTE: Depending on the length of time it is decided to depreciate the assets, it may result
in a fee increases for services. The proposed fee schedule may exceed prior fees by more
than 105%
· Allied Waste has made significant investments to support comingled recycling
throughout their service territory in the Treasure Valley. Although the 95-gallon
recycling carts cost approximately $50 each, additional investments have been
made for Compressed Natural Gas (CNG) recycling trucks ($300K ea), and CNG
compression and fueling facilities for these trucks (~ $1.5 M).
· An additional cost of recycling to the customer depends upon the length of time
the recycling assets are depreciated. If costs are depreciated over 3 years, the
cost would be approximately $2.25 per household per month. Over 7 years the
cost would be $0.98 per household per month. Over 10 years, the cost would be
$0.69 per household per month.
· Customers will continue to have a choice of 48, 64, or 95-gallon trash carts with
limited or unlimited service. Should customers choose to reduce their trash
service by selecting a smaller trash cart and/or requesting limited service, the
associated reduction in trash service rates should offset increases in recycling
rates.

Jeanne Jackson-Heim, 463 Moraine Place, I want to speak in support ofthe recycling program. I
think it is unfortunate that there will be a fee increase. Discusses her experience with the same
recycling program in Boise, which has been a cost reduction in her office.
Ron Marshall, 740 Palmetto, I understood that there was only one size and now I realize that
there is a choice of three sizes. Where I live we have trash enclosures outside and they are
fenced. If! have two 32 gallon containers it will fit in the trash enclosure. I don't have any room

in my garage. The $.69 a month is not an unreasonable increase in this day and age. I support
the program and keep the bin size down. Lets get everything recycled.
Bob Van Arnem, 3041 S. White Post Way, there is a tendency to dismiss these little increase and
they accrue over time. Discusses the bin sizes, the pick up times and the labor. This is a revenue
stream for some company and seems like they should be the ones to pay. Discusses his historical
costs for trash. I have recycled since it was made available. Is the cart fee just for households
that recycle? If a fee increase is forced on us we will simply quite recycling. I don't support this
proposal or any amendment to the current contact that supports a fee increase for trash recycling.
Angel Deckers, 2249 Dickey Circle, I am an Eagle resident and I work for the City of Boise, I
work in the Environmental Division of the Public Works and I am directly involved with solid
waste. Distributes a graph to the Council and discusses the same. When the recycling program
was instituted in Boise our recycling skyrocketed. Discussion on landfill expenses. Discussion
on the Boise program.
Vince Tramboli, 499 E. Knoll Drive, I work for the City of Boise, and worked on the Boise
Curb-It program. There is great interest in the City of Eagle to have this type of recycling. We
have doubled the amount that we are recycling and this will increase. This is much easier for
recycling. I think public opinion is for this.
Andrea Bruce-Niederer, I have been tracking this issue and I worked with Devri and the survey.
I am in support of this recycling as it is the right thing to do. I feel that it is no brainer that we
should adopt this recycling.
Eric Jakey, 371 E. Rockingham Drive, I am in support of this. Two years ago the Council gave
me the opportunity to institute the recycling program at Eagle Fun Days which has been a
tremendous success. When I saw this program I was very excited. Our blue bin is not enough so
we go down to Glenwood to recycle.
Mark Miller, 646 Palmetto Drive, I chaired the Citizens Committee that structured the current
trash and recycling program for Eagle. I support this program. Running a landfill is expensive.
For the cost we pay it is a bargain. I think the Council should vote in favor of this.
Lorie Barrera, 3190 W. Jarrod, I am in support of the recycling program. I work in Eagle and we
have to haul our recycling away. As a real estate person it will help market the Eagle area.

Bob Van Arnem: I am still not clear on the bill. Discusses his bill and what is the rental charge
on my bill. We don't generate a lot of trash. We have lifelong recycled.

John Sayer, to me this is a no brainer. Discussion on extending the contract and the fee increase.
This will save me some money.

Huffaker moves to instruct the Council, Mayor, staff, whoever is going to be involved in
drafting a contract, to prepare the contract for both 7 years and 10 years and have them
ready for the meeting on January 26th; it seems to be the consensus of the majority of the
Council is that we would like to go to comingled recycling. Seconded by Shoushtarian.

A. Ordinance No. 613 (Harris): An ordinance annexing certain real property situated in the
unincorporated area of Ada County, Idaho, and contiguous to the corporate limits of the City of
Eagle, to the City of Eagle, Idaho; changing the zoning classification of said real property
described herein from RUT (rural-urban transition) to R-E-DA (residential- estates with a
development agreement); amending the zoning map of the City of Eagle to reflect said change;
directing that copies of this ordinance be filed as provided by law; and providing an effective

preliminary plat approval for Eagle Commons (aka Bald Eagle Pointe) Subdivision, a 55-lot (45-
residential,9-common, I-right of way) single-family residential subdivision. The 49.5-acre site is
located approximately 1,800-feet west of Linder Road on the south side of West State Street

the preliminary plat approval for Lonesome Dove II Subdivision, (a re-subdivision of Lot 1,
Block 1, Lot 1, Block 2, and Lot 5, Block 4 of the approved final plat for Lonesome Dove
Subdivision), a 74-lot residential subdivision (70-residential, 4-common). The 4.35-acre site is
generally located on the southwest comer of Riverside Drive and State Street at 1505 Riverside

To whom it may concern:
I'm writing in reference to the proposed switch to the 95 -gallon comingled recycling
bins. I support the switch and would happily pay the proposed monthly fee.
Additionally, I personally think having a comingled container would lead to more people
using them. I have heard that the recyclables are not sorted here locally, which is
disappointing, but ultimately, if more people recycle because of the change, I think it's
worth it.

It has been brought to my attention that residents of Eagle may be given the opportunity to have our
current recycling program, provided by Allied Waste, enhanced by changing to a "no sort" program. I
understand that there will probably be a slight increase in fees for this convenience. I strongly
encourage the adoption of this change. It would certainly simplify the process of recycling. For
example: This past week, in order to protect items from the rain, I had to re -package them all into plastic
bags, knowing that the paper and paper bags would become soggy and unmanageable for our collectors.
It would be so nice to have a covered container into which I could place all recycling without going to all
this trouble.

Hi all,
Tomorrow night (Tuesday, Jan. 12) there is a city council meeting on bringing single -stream recycling to
Eagle. Single -stream recycling is when you have one big container and can throw all of your recyclable
stuff (paper, cardboard, tin, plastic, etc...) all in one big container without any sorting. It enables you to
have a lot less trash and a smaller (lower cost) trash can. If you are interested in seeing this service
in Eagle please copy and paste the following statement into an email and then email it to this person.

Just so you know here are the details regarding the fee. Basically, there will be a small fee as low as
$0.69 or as high as $2.25 per month for the new recycling method but you are enabled to completely
offset this fee with the savings you get on having a smaller trash container. The following details are from
the press release the city issued.
Additional costs of recycling to the customer depend upon the length of time the recycling assets are
depreciated. If costs are depreciated over 3 years, the cost would be approximately $2.25 per household
per month. Over 7 years the cost would be $0.98 per household per month. Over 10 years, the cost would
be $0.69 per household per month.
Customers will continue to have a choice of 48, 64, or 95 -gallon trash carts with limited or unlimited
service. Should customers choose to reduce their trash service by selecting a smaller trash cart and/or
requesting limited service, the associated reduction in trash service rates should offset increases in
recycling rates.

I am writing to urge the city council to approve no sort recycling when they vote at the meeting this evening. I am a huge
supporter of recycling and feel we do not do enough of it. I really wish we could get glass recycling going as well. I will
continue to sort and recycle if needed, but I feel no -sort will really encourage people who would not otherwise make the
effort to participate. It will also reduce waste blowing around our neighborhoods because we will not have open
containers of paper, can and plastic sitting curbside overnight and for several hours the next day waiting to be picked up.
I also feel it will show Eagle continues to be a progressive city that cares about the environment and doing what we can to
help others protect it.

We are unable to attend the council meeting on Tuesday, January 12th 2010 but want to go on
record as being opposed to the co -mingle recycle program.
We fully believe in recycling and believe that is it crucial that all citizens of our
community recycle everything they possibly can. However with the co -mingle system, as it is
proposed, doesn't seem appropriate.
The 95 gallon carts are too big for many to accommodate. In many subdivisions the trash
receptacles have to be concealed and garage space is limited. We currently recycle everything
we can. We use the 18 gal blue bin and take glass to a recycling center. We usually have
only one
8 gallon trash bag that goes to the landfill. Please consider our comments in any decision on
this subject.

I saw the article that ran in the Eagle Independent and wanted to ask a question.... how come in the press
release the city issued it states upfront that the prposed fee schedule may exceed prior fees by more than
105%. This seems very misleading when you read the rest of the press release. Am I incorrect in
thinking that the cost (no matter if it is 2.25 per mo or .69 per month) could be completely offset by
enabling residents to use smaller size trash containers that would reduce the cost of Allied's garbage
service? Also, what does it refer to when it says " prior fees?" I didn't know there were any prior fees for
recycling? I don't' see any on my monthly bill, etc...

As far as you know, will the city of Eagle experience some savings if single -stream is implemented due to

There is a problem with the survey. You cannot fill it out on-line and submit it. It looks as if you have
to print it out, fill it out, get an envelope, find the address and then mail it somewhere. The majority of
people will not do this for this topic. (They barely will put this much effort into voting for the
President.) The survey needs to be web -based so you can fill it out on-line and submit. Most surveys
are done this way now -a -days.

I hate to say it but I doubt many survey responses will be gathered with this being the process. As we
all know, many people don't recycle because it takes a little bit of extra time and the current system
where you have to sort the recycle material seems to be even more 'laborious' to so many people. The
whole point of the single -stream is to make it easier and faster for people to recycle. The survey needs
to be set up the same way to get their responses. It has to be easy and fast for people to share their
opinions on this topic.
Please make the survey web -based so that we can tap into Eagle residents' thoughts on recycling.
