Dear Ryan & Tamara, This letter of revocation of Certificate of Occupancy pertains to your property located at 3595 Sella Ct. legally described as Lot 3 Block 4 Cavallo Estates. The City of Eagle under the International Residential Code 2003 edition takes this action under Section Rll 0.5 which reads: Rll0.5 Revocation. The building official shall, in writing, suspend or revoke a certificate of occupancy issued under the provisions of this code wherever the certificate is issued in error, or on the basis of incorrect information supplied, or where it is determined that the building or structure or portion thereof is in violation of any ordinance or regulation or any of the provisions of this code. The subject property has a residential building located in the Residential Estate District that was constructed in violation of the Eagle City Code Section 8-2-3 requiring building to be setback a minimum of twenty feet (20') from the interior property line. The building was constructed approximately ten feet (10') from the property line to the West. This condition is in violation of Eagle City Code and the City must require that affirmative action be taken to correct this violation.
