Resolution - 2009 - 22 - Discontinure Payement To Members Of The Design Review Board For Actual And Necessary Expenses For Attending Regular And Special Board Meetings - 11/10/2009 RESOLUTION NO. 09-22 A RESOLUTION OF THE CITY OF EAGLE, IDAHO, TO DISCONTINUE PAYMENT TO MEMBERS OF THE DESIGN REVIEW BOARD FOR ACTUAL AND NECESSARY EXPENSES FOR ATTENDING REGULAR AND SPECIAL BOARD MEETINGS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle, Ada County, Idaho (the "City"), is a municipal corporation organized and operating under the laws of the State of Idaho; and WHEREAS, the change to the Expense Payment Schedule for reduction in compensation to members of the Design Review Board has been set forth in 2-2-5 of the Eagle City Code to be updated by Resolution. WHEAREAS, the City Council has approved amending and updating the City's Expense Payment Schedule regarding compensation to members of the Design Review Board by this resolution NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, IDAHO: Section I: The Expense Payment Schedule found within Eagle City Code 2-2-5, states: "EXPENSE PAYMENT SCHEDULE: Each member of the Design Review Board shall receive payment for actual and necessary expenses in the amount of fifty dollars ($50.00) for each regular Board meeting attended and twenty dollars ($20.00) for each special Board meeting attended. No Board member may receive in excess of thirteen hundred dollars ($1,300.00) during any fiscal year. The City Council reserves the right to refuse to appropriate such expenditures or reduce them in any budget year. Whereby this expense payment schedule may be amended by Resolution of the City Council at any time." Section 2: The Eagle City Council did not allocate funding for FY 2009/2010 for payment to members of the Design Review Board for actual and necessary expenses incurred for attending regular and special Board meetings. Section 3: Since no funding was allocated for FY 200912010, members of the Design Review Board will no longer receive payment for attendance of regular and special Board meetings. Section 4: That this Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Eagle City Council, Eagle Idaho. This /1l.H... day of November, 2009. We would like to take this opportunity to express our thoughts and concerns with regard to the continuance of the DR Board. As professionals in our fields, we have worked in many jurisdictions throughout Idaho and numerous other states and it is our professional opinion that to disband the Eagle Design Review Board would be a step in the wrong direction for the City of Eagle. So many other local communities have strived to become like Eagle by creating codes and DR Boards to help enhance the general appearance of their cities and to protect property rights and values. Eagle has been a model for these communities. We believe the design standards that were established by previous city leaders have created an attractive place for businesses and will continue to do so in the future. We agree that codes and timelines could be modified to help expedite the process for the applicants but again, we feel it is still important to have a Design Review Board. While there are things that can be done administratively, there will still be those individuals that are going to push the envelope and try to get an application passed that is not in the best interest of the City of Eagle. Each of us recognizes that we are in hard economic times and that everyone is doing what they can to conserve and save money. We believe that as a Board we are able to provide a balance of cost-effective design while keeping with the architectural theme the City of Eagle desires. Because each of us are professionals in our -Lield, every application is given the same level of review with regard to landscaping, architecture, materials, colors, site sign, etc. This level of review should be given to all future applications as it was given to all past applications in order to continue to make this city great. Our hope is that each of you will see the importance of the Eagle Design Review Board and the benefit of having a variety of professionals here to review potential development in the City of Eagle. We recognize that we will no longer be paid for our attendance to future Design Review Board meetings but want you to know that we are committed to serving the City of Eagle.
