BYLAWS OF THE EAGLE PLANNING AND ZONING COMMISSION
ARTI CLE 1
APPOINTMENT, MEMBERSHIP AND QUALIFICATIONS: The Commission shall
consist of from three (3) to twelve (12) members who shall be
appointed by the Mayor and confirmed by a majority vote of the
City Council. AII~members must have been residents of the County
for at least five (5~ years, and must reside within the County
while serving on the Commission. Persons residing within the
Eagle impact area shall be entitled to representation on the City
Planning and zoning Commission. Such representation shall as
nearly as possible reflect the proportion of population living
within the City as opposed to the population living within
membership in the Eagle impact area. To achieve such
proportional representation, membership on the City Planning and
zoning Commission may exceed twelve (12) persons. Members shall
be selected without respect to political affiliations and shall
serve without compensation.
TERM OF OFFICE, VACANCIES AND REMOVALS: The term of office for
appointive members shall be three (3) years. Said terms shall be
staggered in such a manner that not more than thirty five percent
(35%) shall expire in anyone year. All vacancies shall be
filled in the same manner as original appointments and members
may be removed after public hearing by a majority vote of the
governing board.
DUTIES: It shall be the duty of the Planning and zoning
Commission to:
A. Conduct a planning process designed to prepare,
implement, review and update a comprehensive plan that
includes all lands within the governing board's
jurisdiction;
B. Hold public hearings prior to recommending the
comprehensive plan, changes to the plan and ordinances,
special use permits, rezone applications, planned unit
development proposals and variance applications, and zoning
ordinance amendments;
C. Provide ways and means to obtain citizen participation
in the planning process;
D. Recommend subdivision and zoning ordinances;
E Recommend changes to a comprehensive plan and zoning
ordinance prior to annexation of an unincorporated area;
F. Recommend a map, a governing plan and ordinances for an
area of City impact that is within the unincorporated area
of the County; and
G. Such other duties as are required by Idaho law and
this Code.
EMPLOYEES AND EXPENDITURES: Any expenditures of the Commission
(exclusive of gifts) shall be within the amounts appropriated and
set aside by the City Council for the Commission. ' Within suc,h
limits, the Commission is authorized to hire such employees and
technical advisors as it deems necessary for the acqomplishment
of its authorized purpose and work.
ARTICLE 11
OFFICERS: The general officers of the Eagle Planning and zoning
Commission shall be Chairman and Vice-Chairman, who shall hold
office for one year and until their successors are elected.
Officers may hold successive terms.
Section 1. Annually, at the first regular meeting of the
calendar year, the Eagle planning and Zoning Commission shall
elect a chairman and vice-chairman, who will take office
immediately after being elected. Vacancies in these offices
occurring during the course of the year will be filled by
election at the next regular meeting.
Section 2. The Eagle City Clerk/Treasurer shall serve as
the secretary/treasurer of the commission. If otherwise
qualified, the secretary/treasurer may be appointed as a regular
member of the commission.
Section 3. The principal duties of the chairman shall be to
preside at all meetings and to have general supervision of the
affairs of the Eagle Planning and Zoning Commission. The
chairman shall make such appointments as may be required, subject
to approval of the commission membership.
Section 4. The principal duties of the vice-chairman shall
be to discharge the duties of the chairman in the event of the
absence or disability, for any reason whatsoever, of the
chairman.
Section 5. The pri.ncipal duties of the secretary/treasurer
shall be to keep a record of the proceedings of the commission,
and systematically keep all books, papers, records and documents
belonging to the commission, or in anywise pertaining to the
business thereof. The secretary/treasurer shall give notice of
all meetings and keep a record of all meetings and shall be the
custodian of all official records, hearings, resolutions,
studies, findings, permits and actions of the commission. All
records shall be open to the public.
ARTI CLE 111
MEETINGS:
Section 1. The Eagle Planning and Zoning Commission shall
hold its regular meetings the first Monday of the mpnth at 7:30
P.M. At least one (1) regular meeting shall be held each month
for not less than nine (9) months in a year. All meetings shall
be open to the public.
Section 2. Special meetings may be called at any time by
the chairman, or by the request of three (3) or more members of
the commission. A written notice stating the time, place and
purpose of such meeting will be mailed except that such notice
may also be given orally or by telephone. No business shall be
transacted except that mentioned in the notice of the special
meeting.
Section 3. A majority of voting members of the Eagle
Planning and Zoning Commission shall constitute a quorum.
ARTICLE IV
COMMITTEES:
Section 1. A subdivision/planned unit development/major
impact committee shall be formed as a standing committee. The
chairman, with approval of the commission, shall appoint no less
than three (3) nor more than five (5) members to this committee.
The duties of this committee shall be to review all subdivision/
planned unit development/and major impact application and
recommend for approval/denial to the commission. The committee
shall elect its own officers and adopt its own standing rules.
All other members of the commission may attend committee meetings
as ex-officio members.
Section 2. The chairman, with approval of the commission,
may establish at any time, such other standing and/or special
committees as are deemed necessary to carryon the work of the
commission.
Section 3. The appointment or reappointment of standing
committee members shall be made at the second regular meeting of
the year, and their term shall not exceed one year; however, they
may be reappointed by the chairman.
ARTICLE V
PARLIAMENTARY AUTHORITY: The rules contained in the current
edition of ROBERT'S RULES OF ORDER NEWLY REVISED shall govern the
commission in all cases to which they are applicable and in which
they are not inconsistent with these bylaws, any special rules of
order the commission may adopt, or any federal, state, county, or
city statutes applicable to this commission.
ARTICLE VI
AMENDMENT OF BYLAWS: These bylaws can be amended at any regular
meeting of the commission by a two-thirds (2/3) vote~ provided
that the amendment has been submitted in writing at the previous
regular meeting, or included in the agenda of the 'next regular
meeting.
