Minutes - 2009 - City Council - 06/09/2009 - Regular EAGLE CITY COUNCIL Minutes June 9, 2009 PRE-COUNCIL AGENDA: 5:30 p.m. - 6:30 p.m. 1. Idaho Power: Blake Watson with Idaho Power will make a presentation on Idaho Power Energy Future. How is Idaho Power planning for future energy needs, how we got where we are, challenges currently and going forward plus the current energy landscape. Blake Watson, Idaho Power, updates on what is happening with Idaho Power. Discusses the new poles that went up on Highway 55. Will provide Council with a packet of information on projects. The economy has also had an affect on Idaho Power. Discussion on new connects. Discussion on Idaho Power being able to identifY our customers to particular transformers. General discussion. We have seen a substantial increase in calls to our call center. Discusses automated meter reading. General discussion. Discussion on rates. Discussion on energy efficiency programs. Discussion on peak irrigation rewards program. Discussion on projects. 2. Mayor and Council Reports: Semanko: Discusses the Library reports. Discussion on the usage of the Library. No complaints on reduced Saturday hours. There have been some complaints on the lack of evening hours. Sewer District meeting discussed the idea of whether people have to pay for sewer services when they are not using the services. Huffaker: Reports on the Government Relations Committee with the Chamber of Commerce. We discussed the connection on Plaza. We have had some assistance from Senator McGee on a go-between with !TO and us. The issue that is the most concerning is that we may have to redo our traffic studies. There is broad consensus that this should happen. General discussion. Shoushtarian: No report. Jackson-Heim: I just want to say that the grounds at City Hall are just beautiful. I'm wondering if we could get a report on animal control and if we could get a report from the Planning Department on what projects they are working on. I would also like to get a copy of the check register that we sign at the meetings with our packets. How are the Transportation Committee and the Parks and Pathway Commission different? General discussion on the Committees. Mayor: I have been involved with the Eagle Stimulus Group meetings. Their event will be on June 27th and they are doing a lot of advertising. We had a Youth Action Council final meeting last week. We are looking at changing the focus of the group for next year. I met with Mary Barker and Kellie Fairless with Valley Regional Transit, they are adding additional buses. The total cost to the City of Eagle will be $13,500 and they will get us information to include in our budget. General discussion. 3. City Clerk/Treasurer Report: Moved to end of agenda 4. The City of Eagle Police have reviewed and submitted written approval of this application. (SKB) 9A. Request of waiver of open container permit fees: The Koyn G. Hedrick Foundation is requesting a waiver of fees for the open container permit to be used on July 11, 2009 at ReDesign Consignment. (SKB) Mayor: The concerns that I have are first, the way I look at the City Code the Council cannot act on the application unless the fees are paid. This is really a processing fee and covers the costs that the City incurs to process this information and to work with the Sheriffs office to make sure everything is in order. If we waive everyone's processing fee then we lose revenue to the City and we can ill afford to do at this point time. On Item 9A we were provided that tickets for this event could be obtain at their Eagle Office and this business does not have a Business License. General Council discussion. Berman (property owner) are appealing the Zoning Administrator's decision regarding the requirement to stop the operation of Sparrow Salon and Retreat (beauty shop) at 2205 Mace Road. The 5. Huffaker moves to direct staff to accept the offer that was made to withdraw their appeal to give them until July 31st to cease and desist the business operations and to include in the agreement not only that they cease and desist but that there is a time frame for them to fix whatever permit problems that have been mentioned here. Council's concerns: Job creation retention Insurance provision City building and owning a Viticulture Center and the City responsible for paying additional money necessary to complete it if it doesn't come in under budget. General discussion on the changes to the Ordinance. Mayor opens the Public Hearing Heidi Lowe, American Cancer Network, discusses Proposed Clean Indoor Air/AKA Smoke Free ordinances. I was at the Chamber meeting and they did seem to be under the radar. Discussion on local versus Statewide. General discussion. Jay Clement, 1743 Stream Point Lane, 1 am a resident of Eagle. I wanted to come out and show my support ofthe ordinance. Discussion on legislation from the State down. I don't think you can argue with the data on the health risks and I understand the economic concerns. General discussion. John Walker, I am in support of the ban. I have also taken a look at that study. It wasn't a good study. Discussion on where it is appropriate for the government to intervene. General discussion. Nat Schallman, I am a show host on KBCI, this is not the first time I have talked about this issue today. One of the things that we have is freedom on choice. Today I broadcast on the patio of Busters. Members of Smoke Free Idaho was there and they did not complain or say anything about being bothered by the smoke or felt that their life was at risk. Some of the workers at Busters signed the petitions today; they knew what they were getting into. Adrian Casper, I'm here today as the member of Smoke Free Idaho that was invited to be on Mr. Schallman's program and we took up the offer because it was an outdoor venue. Rodger Hawk, I've been a resident of Eagle for 6 years. I don't smoke, I used to. My problem is that I am supposed to abide by the Laws of the City of Eagle, the State and the United States. I don't understand why we are doing this on a local level instead of the State level. I don't see where this is a problem in Eagle. I personally think this is a non-issue. Mayor closes the Public Hearing General discussion. Semanko moves to table this Ordinance and that we instruct staff to draft a letter to the leadership of committees with jurisdiction in the Legislature informing them that we have had this issue brought to us and that we think this is an important issue, that it is a matter of public health, including employees, and it is time that they look at this issue noting the fact that they passes a comprehensive law in 2004 that they fully informed themselves on the issues and passed that wisely and that in 2007 they revisited the ban and added bowling areas and it is item that they look at other areas that are exempt and determine whether the public health benefits would outweigh any other concerns that would be raised. I would note that not a single person testified against extending the ban to bowling alleys. Seconded by Jackson-Heim. Page 5 KICOUNCILIMINUTESITemporary Minutes Work AreaICC-06-09-09min.doc Huffaker makes an alternative motion: I move that we pass this Ordinance with the changes I would stated and as part of my motion I'm going to state that I would also like to do exactly what Councilman Semanko just suggested and that we pass the Ordinance and send that letter to the State Legislature indicating that we have made this decision and that we would like them to revisit the issue and make this a statewide law as opposed to being something that the City of Eagle has adopted by itself. As to the ordinance: I would eliminate 4-11-6; change 4-11-7 A: remove the words private so it reads all semi-private rooms; change 4-11-8B to 10' perimeter; remove 4-11-11 in its entirety; 4-11-13A: 1,2 & 3 can remain as they are, subsequent offense after the third offense $100.00; subsection B: #1 states a written warning, #2 $100.00, #3 $200.00, and #4 as stated, eliminate subsection C in its entirety.
