Re: Extension of Building Permit 06-05-033 at 1802 W Rush Rd
Dear Wayne Swanson,
On March 24, 2009 the City of Eagle received your letter requesting a second extension of time
for the building permit issued for a Detached Garage located at Lot 2B in the Academy Place Subdivision.
Per City code, a building permit may be extended only one time and your permit extension expired as of
March 2, 2009. Copy of your permit extension letter is enclosed.
Eagle City Code Section 7-1A-3 & 7-1A-4 has amended the 2006 International Building &
International Residential Code Sections R105.5 which allowed a 90 day extension, to be increased to a
period of 180 Days to grant more flexibility to the building community when unforeseen conditions are
presented.
IBC & IRC sections 105.5 are amended to read as follows:
105.5 Expiration. Every permit issued by the building official under the provisions of this chapter shall
expire by limitation and become null and void if the building or work authorized by such permit is not
commenced within 180 calendar days from the date of such permit, or if the building or work authorized
by such permit is suspended or abandoned at any time after the work is commenced for a period of 180
calendar days.
The timeframe by which a project shall be deemed to be suspended or abandoned shall be measured
from the date of the last major inspection that resulted in an approval to move to the next stage of
construction by the city of Eagle or if no inspection has been required then a project shall be deemed to
be suspended 180 calendar days from the date the permit was issued.
b. Permit Extensions. Any permittee holding an unexpired permit may apply for an extension of the time
within which work may commence under that permit, when the permittee is unable to commence work
within the time required by this section. The 'building official may extend the time for action by the
permittee for a period not exceeding 180 calendar days on written request by the permittee with written
evidence provided demonstrating that a good faith effort to complete the project has been made and that
reasons beyond the control of the permittee have resulted in a delay. Under no condition shall a oermit be
extended more than once.
If you have any questions, please contact my assistant Charlene Elg at 489-8760.

Dear Wayne Swanson,
On September 2, 2008 the City of Eagle received your letter requesting an extension of time for
the building permit that was issued for a Detached Garage located at Lot 2B in the Academy Place
Subdivision.
Eagle City Code Section 7-1A-3 & 7-1A-4 has amended the 2003 International Building &
International Residential Code Sections Rl 05.5 which allowed a 90 day extension, to be increased to a
period of 180 Days to grant more flexibility to the building community when unforeseen conditions are
presented.
IBC & IRC sections 105.5 are amended to read as follows:

from the date of the last major inspection that resulted in an approval to move to the next stage of
construction by the city of Eagle or if no inspection has been required then a project shall be deemed to
be suspended 180 calendar days from the date the permit was issued.
b. Permit Extensions. Any permittee holding an unexpired permit may apply for an extension of the time

evidence provided demonstrating that a good faith effort to complete the project has been made and that
reasons beyond the control of the permittee have resulted in a delay. Under no condition shall a permit be
extended more than once.
To accommodate your request, your permits are extended to March 2. 2009 under Eagle City
Code Section 7-1A-3 & 7-1A-4. This section, as adopted by the Eagle City Council, limits a permit
holder and applicants to only one extension.
