Minutes - 2009 - City Council - 04/28/2009 - Regular EAGLE CITY COUNCIL Minutes April 28, 2009 PRE-COUNCIL AGENDA: 5:30 p.m. - 6:30 p.m. 1. City of Eagle Police Department Report: Chief Brian Hippe distributes the Monthly Report for March and discusses the same. General discussion. Public Works Director Echeita: Reports on animal control. We are working with Garden City; they were to bring this before their Council last night and I haven't heard from them today. We are working on the contract and the amount. Right now my staff and I are taking care of the calls. Vicious dogs are going to be taken care of by Garden City as they have the staff and equipment to take care of these calls. If a dog is running loose we will pick up the dog and take it to Garden City. General discussion. 2. Zoning Administrator's Report: No report 3. Public Works Director Report: On the Senior Center parking lot we have sent the contracts to the Commerce Department for the Block Grant. They have agreed that we can spend their $100,000 first as long as we make progress on the parking lot and they will work with us on completing the project. We think we can put the parking lot in $100,000. Eagle Road Underpass. It is supposed to be finished next week. The only thing that may not be done is a chain link fence which was a change order. They have to be done next Wednesday or be penalized. Merrill Park Bridge should be put together next week and then taken to be placed. This should be completed by the end of May. General discussion. 4. City Clerk/Treasurer Report: No report 5. Mayor and Council Reports: Semanko: No report Huffaker: Are we going to make any effort to get the By-Pass up and running? City Attorney Buxton: I have had discussions with Senator Magee and St. AI's. It seems impossible to have any discussions with the Legislature in session. We will schedule a meeting with the parties and then sit down with lTD. St. Al still wants to go forward. Eagle Gravel is still interested also and they are talking to traffic engineers to get a cost on the studies. 6. City Attorney Report: City Attorney Buxton reports on the Bond Counsel meeting she attended. Reports on the M3 hearings, they applied for a water right. Discussion on their application and the Development Agreement with the City. Mayor: Ijust came back today from the Boise Business retreat in Sun Valley. We had a lot of good discussion on how to encourage economic development around the valley. We came to the consensus that we need to come together as a group to approach the Legislature. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. . Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. A. Claims Against the City. B. Municipal Clerks Week Proclamation - May 3-9, 2009. C. Approval of alcohol license renewals for 2009-2010: This approval is intended to encompass all license holders who present the appropriate documentation and fees to the Clerk's Office by April 30, 2009. The renewed licenses are to be in effect from May 1,2009 through April 30, 2010. The following license holders have submitted the appropriate documentation and fees to the Clerk's Office at time of agenda preparation: Pamela's Bakery, River Rock Alehouse, The Chicago Connection, Smoky Mountain Pizza, Bella Aquila, Pizza Hut, Russian Bear Cafe, The Stuffed Olive, Bardenay, Mai Thai, Rachelle K's. D. Open Container Permit: Andrew Jossis is requesting an open container permit to be used at Merrill Park on May 23, 2009 from 3:00 p.m. to 9:00 p.m. All standard conditions of approval shall apply. Open Container Permit: Ben Fletcher is requesting an open container permit to be used at Merrill Park on May 1,2009 from 5:00 p.m. - 9:00 p.m. All standard conditions of approval shall apply. Resolution No. 09-12: A Resolution To Change The Name Of The Eagle City Park And Pathway Development Committee To Eagle City Parks And Pathways Development Commission; Include In Their Duties The Duty Of Recommending Development; Restate Their Organization And Duties As Set Out In Resolution 99-10; And Providing An Effective Date. EXT -02-09/PP-22-06 - Preliminary Plat Extension of Time for Svmphonv Square Subdivision - Tom Kalanl!e: Tom Kalange represented by Kerrigan Kalange, is requesting a one (1) year extension of time for the preliminary plat approval for Symphony Square Subdivision, a residential subdivision consisting of 19-1ots (14-residential and 5-common). The 6.20-acre site is located at the eastern terminus of West Flint Road approximately 2,1 OO-feet east of Park Lane at 3391 West Flint Drive. (WEV) M. Minutes of April 14. 2009. PUBLIC HEARINGS: None 8. NEW BUSINESS: A. Review of public comments received rel!ardinl! the BLM Recreation and Public Purposes Act application for the Eal!le Rel!ional Park. (NBS) Mayor introduces the issue. Planner Baird-Spencer: Provides Council an overview of the public open house and public comments. Overall we had very positive comments. Discussion on some specific requests for the park. Most of the comments were in favor of a non-motorized facility. We received about half of our comments online. We sent out over 780 post cards and advertised in the local papers. Council Member Jackson-Heim does want to participate in the discussion as she has some concerns that she wants to address. Discussion on maintenance costs. General discussion. 9. EXECUTIVE SESSION: A. Pendinl! and/or threatened litil!ation: I.C. S67-2345 (f) Mayor introduces the issue. City Attorney: Semanko moves to go into Executive Session for the discussion of Pending and/or threatened litigation, I.C. ~67-2345 (f) in regards to the recent Tort Claim filed by Mr. Pooley, the pending right waters appeal, the pending motion on Charney and the Pooley matter.
