Memorandum of Understanding
Between the City of Boise City, City of Eagle and Ada County
Regarding Adjusting the Area of City Impact Boundary
Between City of Eagle and City of Boise City
WHEREAS, Idaho Code S 67-6526 requires that cities and counties adopt by ordinance
an area of city impact; and
WHEREAS, both the City of Eagle and the City of Boise City have adopted their
respective areas of city impact with Ada County; and
WHEREAS, in certain areas the City of Boise City area of city impact and the City of
Eagle area of city impact have a common boundary; and
WHEREAS, the City of Eagle wants to include approximately 189 acres of land as
described in Exhibit "A" attached hereto into the City of Eagle's area of city impact, and such
189 acres is currently contained within the City of Boise's area of city impact; and
WHEREAS, the City of Boise wants to include approximately 190 acres of land as
described in Exhibit "B" attached hereto into the City of Boise's area of city impact, and such
190 acres is currently contained within the City of Eagle's area of city impact; and
WHEREAS, Ada County has no objection to altering the respective areas of city impact
as requested by the City of Eagle and the City of Boise City, and the City of Eagle and the City of
Boise City have agreed to swap the land as described in Exhibits "A" and "B" attached hereto,
and such a change benefits both cities;
NOW, THEREFORE, it is understood between Ada County, the City of Eagle and the
City of Boise City as follows:

Within sixty (60) days from the date the last party signs this Memorandum of
Understanding (MOU), Ada County, the City of Eagle and the City of Boise City will begin the
process under Idaho Code S 67-6526 to adjust the City of Eagle's and the City of Boise City's
respective area of city impact boundaries in conformance with Exhibits "A" and "B" attached hereto.
II.
The land identified in Exhibit "A" shall be considered a referral area. Ada County and
Gity of Eagle agree to send notices of any land use application~ submitted for property contained
within Exhibit "A" to the City of Boise City, Attention: Boise City Engineer and Boise City
Planning Director, at least thirty (30) days prior to any scheduled public hearing on the
application, or thirty (30) days prior to any administrative decision if no public hearing is
required on the application.

Ada County, the City of Eagle and the City of Boise City agree that the land identified in
Exhibit "A" attached hereto is currently zoned RP (Rural Preservation) with one (1) dwelling per
forty (40) acres.
IV.
This MOD may be executed in counterparts, all of which counterparts taken together
shall be deemed to be but one original.
