RESOLUTION NO. 04-21
A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, APPROVING AND
AUTHORIZING THE EXECUTION OF THE SETTLEMENT AGREEMENT WITH ARIES
DEVELOPMENT, L.L.C., AN IDAHO CORPORATION; AUTHORIZING THE MAYOR TO
SIGN; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle, Ada County, Idaho (the "City"), Eagle Water Company,
Eagle Neighbors, Inc., and the Chase Family each filed protests to the Aries Development, L.L.C.
application for water right permit no. 63-31689 and application for transfer of water right no. 63-
5087, before the State of Idaho Department of Water Resources, and the City desires to enter into
a Settlement Agreement resolving the pending protests; and
WHEREAS, the City is authorized and empowered to exercise all powers and perform all
functions of local self-government in accordance with the law, to sue and be sued, and to
execute all necessary contracts pursuant to Idaho Code S 50-301.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EAGLE, Ada County, Idaho, as follows:
Section 1: That the City of Eagle, Ada County, Idaho (the "City") hereby agrees to
enter into the Settlement Agreement, substantially in the form annexed hereto as Exhibit "A,"
and approves the same as presented subject to the approval of the City Engineer and the City
Attorney;
Section 2: The Mayor and City Clerk are hereby authorized to execute and attest,
respectively, the Settlement Agreement on behalf of the City.
Section 4: This Resolution shall take effect and be in force immediately upon its
passage and approval.
