RESOLUTION No. 04-20
A RESOLUTION OF THE EAGLE CITY COUNCIL, EAGLE, ADA COUNTY,
ADDRESSING THE EAGLE RURAL FIRE DISTRICT'S ACCEPTANCE OF THE
CITY'S TENDER OF DEFENSE IN LITIGATION FILED BY THE MERIDIAN
RURAL FIRE PROTECTION DISTRICT AGAINST THE CITY OF EAGLE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Eagle City Council, being aware of a lawsuit filed by the
Meridian Rural Fire Protection District Case No. CV OC 0405589D against the City of
Eagle; and
WHEREAS, the Board of Commissioners of the Eagle Rural Fire District, being a
necessary party to this litigation, has agreed to accept the City's tender of defense in this
matter as evidenced by the Eagle Rural Fire District's Resolution attached hereto as
Exhibit "A."
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF EAGLE, IDAHO.
Section 1: The Eagle City Council hereby authorizes John Lerma, legal counsel
for the Eagle Rural Fire District, to defend the City of Eagle in the Complaint for
Declaratory Judgment filed by the Meridian Rural Fire Protection District and hereby
waives any and all potential conflicts which may arise.
Section 2: This Resolution shall be in full force and effect immediately upon its
adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 1Jlrday of October, 2004.
