RESOLUTION No. 04-17
EMERGENCY SPECIAL MEETING
Whereas, over the course of the past three years, the City of Eagle has been negotiating
with Idaho Power Co. regarding Idaho Power's intent to install transmission lines through
the corporate limits of the City of Eagle; and
Whereas, the City, Idaho Power, the Idaho Public Utilities Commission and Eagle River,
LLC, have conducted lengthy and complex negotiations regarding the construction,
installation, and cost of the transmission lines; and
Whereas, the proposed cost of the transmission lines, and/or various alternatives, range
from $1.35 million to $9.5 million; and
Whereas, the City must make an immediate determination whether to enter into the
Stipulation presented by Idaho Power to the City, the Idaho Public Utilities Commission
and Eagle River, LLC, to construct the power transmission lines; and
Now Therefore, It is hereby RESOLVED:
That pursuant to Idaho Code ~67-2343(2), the City may avoid the notice
requirements for special meetings in the event of an emergency; and
That an emergency exists, pursuant to Idaho Code ~67-2343(2), in that the City
must make an immediate decision regarding the pending negotiations with the Idaho
Public Utilities Commission, Idaho Power Co. and Eagle River, LLC, or risk suffering a
financial loss amounting to several million dollars; and
That pursuant to ~67-2343(2), the Mayor and Council do hereby declare an
emergency and call an emergency special meeting to be held to discuss the pending
negotiations regarding the power transmission lines.
PASSED AND APPROVED by the City Council on the 26th day of August, 2004.
