Box 637 Eagle, ID 83616 Re: Expiration of Building Permit 06-04-050 at 971 E Winding Creek Dr Dear Wright Brothers, Building Permit issued for a New Commercial building located at Lot 12 Block 2 in the Winding Creek#1 Subdivision will be deemed expired as of April 31-d, 2009 under the Building Code stated below. Your permit was previously granted an extension to March 29'h, 2009 and under city code, is only allowed one extension. IBC & IRC sections 105.5 are amended to read as follows: 105.5 Expiration. Every permit issued by the building official under the provisions of this chapter shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced within 180 calendar days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 180 calendar days. The timeframe by which a project shall be deemed to be suspended or abandoned shall be measured from the date of the last major inspection that resulted in an approval to move to the next stage of construction by the city of Eagle or if no inspection has been required then a project shall be deemed to be suspended 180 calendar days from the date the permit was issued. b. Permit Extensions. Any permittee holding an unexpired permit may apply for an extension of the time within which work may commence under that permit, when the permittee is unable to commence work within the time required by this section. The building official may extend the time for action by the permittee for a period not exceeding 180 calendar days on written request by the permittee with written evidence provided demonstrating that a good faith effort to complete the project has been made and that reasons beyond the control of the permittee have resulted in a delay. Under no condition shall a permit be extended more than once. The City of Eagle regrets this project was never finalized.
