The above-entitled design review application came before the Eagle Design Review Board for their action
on December 11, 2008. The Eagle Design Review Board having heard and taken oral and written
testimony, and having duly considered the matter, makes the foIIowing Findings of Fact and Conclusions
of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
25 Properties, LLC, represented by Jim Stroo with Sign-A-Rama, is requesting design review
approval to modify the master sign plan for a multi-tenant office building. The site is generaIIy
located north of East State Street approximately 150-feet west of Plaza Drive within the Winding
Creek Development (Lot 11, Block 2) at 1005 East Winding Creek Drive.
B. APPLICA TION SUBMITTAL:
The City of Eagle received the application for this item on November 5, 2008.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On April 12, 2005, the Eagle City Council approved a design review sign application for the
master sign plan for a multi-tenant office building (DR-l 0-05).

STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT:
A. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
. Protect and enhance the smaIl town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:
. Eagle City Code Section 8-2A-2(B)
The general theme of the Design Review Overlay District is to specify desirable building and
landscape architectural styles and materials to create a sustainable and pleasing environment
for residents and visitors alike. The architectural designs, materials, and graphics set forth in
this article are complied to create a theme unique to the area caIled "Eagle Architecture".

The size, location, design, color, texture, lighting, landscaping, and hours of operations of all

proposals do not detract from the function of, or design of, buildings, structures, surrounding
properties, neighborhoods, or streets.

The design review board must find that any illuminated sign permitted under the specific
regulations within this chapter is designed such that brightness levels are controIled to assure a
soft, subtle effective light in accordance with other city regulations intended to create and
maintain the Eagle Architecture theme. Illumination types, styles, and practices not listed
herein shaIl be prohibited unless otherwise deemed by the Design Review Board and City
Council to be consistent with the Eagle Architecture theme.

Prohibited Illumination:
a. Internal Illumination: AIl types.
. Eagle City Code Section 8-2A-8(K)(1)
No signs shaIl be erected or maintained in any district as established by the Zoning Ordinance
except those signs specificaIly enumerated in this Chapter. The number and area of signs as
outlined in this Chapter are intended to be maximum standards which do not necessarily
ensure architectural compatibility. Therefore, in addition to the enumerated standards,
consideration shaIl be given to a sign's relationship to the overaIl appearance of the subject
property as weII as the surrounding community. Compatible design, simplicity and sign
effectiveness are to be used in establishing guidelines for sign approval.
C. DISCUSSION:
. On April 12,2005, the Eagle City Council approved a design review sign application for the
master sign plan for a multi-tenant office building (DR- I 0-05). The master sign plan criteria
aIlowed tenant signage on the monument sign. No building waIl signage was permitted with the
master sign plan criteria. The applicant is requesting approval to modify the master sign plan
criteria to aIIow signage on the building. During the pre-application meeting, the applicant's
representative indicated that halo illuminated building waIl signs were going to utilized on the
building. The master sign plan criteria indicates that the building waIl signs are to be back lit -
illuminated, individual channel letters. It is staff's interpretation that back lit - illuminated is
internaIly illuminated letters. Per Eagle City Code, internal illumination is prohibited. Staffwill
specificaIly address this in the criteria below.

GENERAL REQUIREMENTS
1. Each t+enant shaII be required to submit signage plans to the Landlord or managing entity for
written approval prior to fabrication and instaIIation~, ONe (I) eopy of aetailed drawings

or managing entity, shaII be submitted to the City for any proposed buildiNg waIl signs for

specified herein. the more restrictive requirements shaII apply.
2. Tenant must obtain and pay for all permits for signs and instaIIation.
3. Landlord has the right to disapprove of tenant sign and/or instaIIation.
4. AII of Tenant's signs shaII be constructed and instaIIed at Tenant's sole expense.
5. Even after design approval, no signs shaII be instaIIed without advance notice to Landlord, and
if Landlord elects, under the supervision of Landlord or its agent or contractor

b) Construction materials shaII be stone base with wood siding and a metal cap per
attached design (Exhibit A)

c) Colors of stone base and siding shaII be the same colors combination used on the
building.
d) Monument sign shaII have a two sign faces with two spaces to all ow for a maximum
of two tenant's business names per sign face (Exhibit B).
e) Sign face dimensions shaII be 60" wide maximum by 33" high maximum constructed
from .080 aluminum and powder coated Dupont Almond 1373 to complement
building exterior color.
f) Text and/or logo shaII be 5" high maximum by 66" wide maximum constructed from
1/4" routed aluminum and painted flat/matte colors per tenant's identity program.
g) The floodlights used to illuminate the monument sign shaII be screened or located so
they do not shine onto the roadway or onto any nearby property. The light fixtures
shaII be concealed or screened with perimeter landscaping provided a 12 month screen
of sufficient height and density to conceal fixtures.
h) Interior illumination is not permitted for monument signs.
5. Building waIl signage will be constructed as foIIows:
a) Each tenant will be entitled to one building waIl sign on the north elevation and one
building waIl sign on the south elevation.
b) Building waIl signage shaII be placed within the approved sign areas as designated on
Exhibit C showing the primary location on the north elevation and the secondary
location on the south elevation designate on Exhibit D.
c) No waII signs are permitted on the east or west elevations.
d) On the south elevation, the bottom of the building waIl signage must be a minimum of
10 feet from grade.
e) On the north elevation, the building waIl signage must be placed within gable as
shown on Exhibit C.
f) AIl building waIl signs are to be halo baek lit illuminated, individual pan channel
letters.
g) The building waIl sign may include a logo mark. Such logo mark must also be halo
illuminated baeIe lit.
h) AII text and/or logo are to be painted flat/matt colors per tenant's identity program.
i) AIl waIl sign elements shaII be stud mounted with a minimum of 1/4" off the face of the
building to aad a maximum of2" from waIl surface.
j) The waIl signage illumination shaII be LED lighting provided sueh lightiNg eomplies
with Eagle City Coae.
k) No electrical conduits or raceways are permitted.
6. Any other signage such as temporary, grand opening, etc. shaII comply with Eagle City Code.
7. Any signage on doors or windows shaII comply with Eagle City Code.
8. Upon termination of their lease, the tenant or managing entity shaII neatly seal all penetrations
of the building structure in a watertight condition that matches the texture, color, and material
used in the construction of the building.
9. A sign permit is required for all proposed signs within the Multi-tenant office building.
. Staff defers comment regarding design and color of all proposed signs to the Design Review
Board.
STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT:
Based upon the information provided to staff to date, staff recommends approval with the site
specific conditions of approval and the standard conditions of approval provided within the staff
report.

PUBLIC MEETING OF THE BOARD:
A. A meeting was held on the application before the Design Review Board on December 11, 2008, at
which time the Board made their decision.
B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one.
C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not
including the applicant/representative).
BOARD DECISION:
The Board voted 6 to 0 (McCuIIough absent) to approve DR-l 0-05 MOD for a design review
application for a modification to the master sign plan for a multi-tenant office building for 25
Properties, LLC, with the foIIowing staff recommended site specific conditions of approval and
standard conditions of approval.
SITE SPECIFIC CONDITIONS OF APPROVAL:

STANDARD CONDITIONS OF APPROVAL:
I . A building permit/zoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shaII expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from the Design Review Board approval date).

3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. AIl design and construction
shaII be in accordance with all applicable City of Eagle Codes unless specificaIIy approved by the
Commission and/or Council.
4. New plans which incorporate any required changes shaII be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for
review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those
required by the above conditions, wiII require submittal of an application for modification and
approval of that application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this application,
shaII require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory
and legal restrictions in force at the time the applicant or its successors in interest advises the City of
Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is
sought.
7. Any modification of the approved design review plans must be approved prior to
construction/instaIIation of such changes. Failure to do so may result in the requirement to modify the
project to comply with the approved design review and/or result in the inability to issue a certificate of
completion for this project.
CONCLUSIONS OF LAW:
1. The application for this item was received by the City of Eagle on November 5, 2008.
2. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR-I0-05 MOD) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design
Review Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.
