RESOLUTION NO. 07-21
A RESOLUTION OF THE CITY OF EAGLE, COUNTY OF ADA, STATE OF IDAHO,
TERMINATING THE EMERGENCY MORATORIUM DECLARED BY RESOLUTION NO.
07-03, ADOPTED ON FEBRUARY 13, 2007; PROVIDING FOR RELATED MATTERS;
AND, PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle, Ada County, Idaho (the "City"), adopted Resolution 07-
03, on February 13,2007, declaring an emergency moratorium on all real property located within
the Eagle Water Company, Inc. water system; and
WHEREAS, based on representations by the Idaho Department of Environmental Quality
("DEQ"), the City has determined that there is no longer imminent peril to the public's health,
safety or welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EAGLE, IDAHO, as follows:
Section 1.
Based on representations by DEQ, the City finds that there is no longer an
emergency or threat of imminent peril to the public's health, safety or welfare.
Section 2.
The emergency moratorium declared on February 13,2007, is hereby terminated.
Section 3.
This Resolution shall be in full force and effect from and after its passage and
approval.
Regularly passed, arproved and adopted by the Eagle City Council for the City of Eagle,
Ada County Idaho, this 1 i day of July, 2007.
