PLANNING AND ZONING COMMISSION
January 21, 2020

CALL TO ORDER: Meeting called to order at 6:00 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, JOHNSON, MCLAUGHLIN, and SMITH. A
quorum is present.
ALL CONSENT AGENDA ITEMS ARE ACTION ITEMS. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of January 6, 2020.
B. Findines of Fact and Conclusions of Law for the annroval of A-02-19/RZ-05-19/CU-04-
19/PPUD-03-19/PP-05-19 — Whitehurst Planned Unit Development — Mustang 35, LLC:
Mustang 35, LLC, represented by Mark Butler with Land Consultants, Inc., is requesting an
annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R -1 -DA-
P (Residential with a development agreement — PUD) and R -3 -DA -P (Residential with a
development agreement — PUD), conditional use permit, preliminary development plan, and
preliminary plat approvals for Whitehurst Subdivision, a 67 -lot (60 -buildable, 7 -common)
residential planned unit development. The 30.06 -acre site is located at the terminus of West
Breanna Drive north of Flint Estates Subdivision.
Johnson moves to approve the consent agenda as presented. Seconded by McLaughlin. ALL
AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE.
PUBLIC HEARINGS:
A. ACTION ITEM: PP/FP-02-19 — Lusk Subdivision — Alan Lusk: Alan Lusk, represented by
Pat Tealey with Tealey's Land Surveying, is requesting combined preliminary plat and final
plat approval for Lusk Subdivision, a 2 -lot residential subdivision (re -subdivision of a portion
of Lots 3 and 4, Academy Place Subdivision). The five (5) acre site is located on the north side
of West Rush Road approximately 645 -feet east of the intersection of North Ballantyne Lane
and West Rush Road at 1764 West Rush Road.
Pat Tealey, 12594 West Explorer Drive, Boise, Idaho. The applicant's representative provides a
brief overview of the application.
Tealey responds to questions from the Commission.
Alan Lusk, 1764 West Rush Road. The applicant explains that he would prefer not to be required
to install a fire sprinkler system in the residence, and states that other houses in the area have not
been required to install such systems.
Lusk responds to questions from the Commission.

Tealey provides additional information regarding the application.
City Planner, Denise Lauerman, provides a detailed overview of the application.
Lauerman responds to questions from the Commission.
Chairman Wright opens the Public Hearing.
Stan Ridgeway, 1735 West Rush Road. Ridgeway explains that many of the lots in the subdivision
have subdivided similar to Mr. Lusk's request, states that no other homes on the street have been
required to have fire sprinklers, states that there is a fire hydrant at the intersection of Ballantyne
Road and Rush Road, and encourages the Commission to waive the requirement for the house to
be fire sprinkled.
Lusk responds to concerns from the Commission and provides additional information regarding the
application.
City Planner, Mike Williams, provides additional information about the proposed pressurized
irrigation system.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission.
Smith moves to recommend for approval item 5A PP/FP-02-19 — Lusk Subdivision — Alan
Lusk with the following changes:
Site specific condition #4 to be reworded according to Mr. Williams suggestion, specifically
regarding the pressurized irrigation waiver request, that that be stricken and be replaced
with comments to the effect that the current system will be approved as stands.
Also, if I recall correctly, the drawings are available on item #12, so they just have to be
provided with the application. So basically, just comply with #12.
Seconded by Guerber.
City Planner Mike Williams requests clarification on site specific condition #4: On item 44, do you
want to strike flood and have us fix that as well?
Smith: Yes.
Williams: Also, you will need to address the accessory structure. I'd recommend adding a new site
specific condition that states "The existing accessory structure located north of the dwelling is
approved at its current location."
Smith: Yes, I concur.
Discussion.
Smith amends motion to include the suggestions of staff. Seconded by Guerber. ALL AYES...
MOTION CARRIES.
6. NEW BUSINESS: NONE.
7. REPORTS:
A. Commission: Chairman Wright welcomes Commissioner McLaughlin back to the
Commission. Commissioner Smith expresses desire to discuss height exceptions and maximum
heights for the City in order to avoid having applicants seek exceptions. Commissioner Smith
explains that he is having difficulty hearing people speaking at the podiums and requests that
a solution be found. Commissioner Johnson shares thoughts regarding height exceptions and
maximum building heights. Commissioner McLaughlin lets the Commission know about an

upcoming COMPASS meeting.
B. City Attorney: None.
C. Staff. City Planner, Mike Williams, provides a general update regarding upcoming
applications, recommends that Commissioner Johnson include Zoning Administrator, Bill
Vaughan, on email correspondence regarding building heights exceptions and maximum
heights. Williams discusses heights outlined in the Comprehensive Plan and explains the
process for updating the City Code to reflect the Comprehensive Plan. Clerk of the Meeting,
Kristl Caron, informs the Commission that the second meeting in February will be held on
Tuesday, February 18"

Johnson moves to adjourn. Seconded by Wright. ALL AYES... MOTION CARRIES.
