RESOLUTION NO. 08-34
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAGLE, ADA COUNTY, IDAHO,
ADOPTING RESOLUTION NO. 08-34 WHICH ESTABLISHES A CONVENIENCE FEE FOR THE
PROCESSING OF AUTOMATED CLEARING HOUSE (ACH) AND/OR CREDIT CARD
PAYMENTS MADE WITHOUT THE CARDHOLDER BEING PRESENT; AND PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, The City of Eagle, Ada County, Idaho (the "City"), is a municipal corporation duly
organized and operating under the laws of the State of Idaho; and
WHEREAS, in the modem world of electronic conveniences, consumers have access to a wide variety of
services and products via A TMs, electronic kiosks, and the Internet; and
WHEREAS, government agencies providing these services often charge fees to recover the costs of
providing and maintaining these services and electronic equipment; and
WHEREAS, government agencies often recover the costs of providing online or convenience services by
charging a fully disclosed convenience fee; and
WHEREAS, the convenience fees are charged only to customers choosing the "option" of doing business
via Automated Clearing House (ACH) or credit card payment without the cardholder being present, rather
than receiving personalized attention at Eagle City Hall or mailing their fees via mail; and
WHEREAS, notification of public hearing was published in accordance with Idaho State Code S63-
l3llA in The Valley Times, the official newspaper of the City of Eagle on November 10,2008 and
November 17,2008; and
WHEREAS, a public hearing was held on November 25, 2008.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EAGLE, ADA
COUNTY, IDAHO, as follows:
Section 1: That the City hereby establishes a convenience fee of 50~ for customers choosing the payment
method of Automated Clearing House (ACH) and/or credit card payment when the cardholder is not
present.
Section 2: This Resolution shall take effect and be in force from and after its passage and approval.

Re: Convenience fee Resolution No. 08-34
The public hearing notice for this item was originally noticed with a $1.00 per item proposed
fee. After further analysis staff is recommending the fee be reduced to a 50~ convenience fee
per item for those choosing to utilize ACH and/or credit card payments when the cardholder
is not present. This fee is suggested to offset the fees incurred by the City to make this
method of payment available to those who choose to utilize it.

November 25,2008 at 7:30 P.M. at Eagle City Hall, 660 E. Civic Lane, Eagle, Idaho. The purpose
of the hearing to consider establishing a convenience fee for customers utilizing the payment
method of Automated Clearing House (ACH), or credit card payments made without the cardholder
being present. The proposed convenience fee would be charged only to customers choosing the
"option" of remitting payment via ACH or credit card payment absent the cardholder. The
proposed fee is $1.00 per transaction.
Public testimony is encouraged at the public hearing. Written comments about the proposed rate
increases will be accepted by the City Clerk up until 5 working days prior to the public hearing.
