RESOLUTION NO. 08-29
A RESOLUTION OF THE CITY OF EAGLE, IDAHO, TO VACATE THE PUBLIC
UTILITY, IRRIGATION, AND DRAINAGE EASEMENTS LOCATED ON LOTS 3, 5, 6,
AND 8, BLOCK 2 WITIllN AMENDED FLINT ESTATES SUBDIVISION AS SHOWN ON
THE ATTACHMENTS HERETO, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Flint Estates Subdivision was amended and platted and accepted by the Ada County
Commissioners on January 4, 1979; and
WHEREAS, On March 21, 2000, the City Council approved Ordinance No. 368, annexing and
rezoning the Amended Flint Estates Subdivision to the A-R (Agricultural- Residential up to one
unit per five acres) zoning designation; and
WHEREAS, On April 25, 2005, the City Council approved a preliminary plat application for
Symphony Subdivision (PP-07-04), are-subdivision of Lots 5, 6, and 8, Block 2, of the Amended
Flint Estates Subdivision; and
WHEREAS, On October 1, 2007, the Planning and Zoning Commission passed a motion
recommending approval of the vacation (V AC-06-07), with conditions, to the Council; and
WHEREAS, On November 13,2007, the City Council held a public hearing on the proposed
vacation (V AC-06-07), and voted to approve the vacation with conditions; and
WHEREAS, On December 18,2007, the Eagle City Council approved a final plat application for
Arts West Subdivision (formerly Symphony Subdivision) (FP-13-07); and
WHEREAS, Exhibits A and B are attached hereto and incorporated herein by reference
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, Ada County, Idaho, as follows:
Section 1: The City Council for the City of Eagle hereby vacates the existing public utility,
irrigation, and drainage easements located on Lots 3, 5, 6, and 8, Block 2 within the Amended Flint
Estates Subdivision as shown on Exhibit A and as specifically described in Exhibit,B.
Section 2: This Resolution shall take effect and be in force from and after its passage and
approval.
